2010.11.18 - Hearing on Clarification of DNA Testing

  • #21
One thing I find interesting is that the media doesn't seem to know which two pieces of evidence the motion is addressing. It only said "two items".

The other day WESH saiid it was about hairs as did WKMG today. IIRC, hairs were mentioned at the September 28 hearing in that Casey had to sign stipulations for them.

However, the main DNA testing issue at that hearing concerned touch DNA testing on the shorts and laundry bag. That's what the Orlando Sentinel is reporting right now.

Those who go, please let us know WHICH items are involved, please!

Maybe it's via phone because HHJP is going to tell Mr. Baez the way it is and not have to worry about the cameras. I really think HHJP is at the end of his rope with JB. jmo

  • #23
I suspect HHJP will grant the JACs motion and have the DNA testing done on those two items in Florida. I was somewhat surprised HHJP at the last hearing did grant the DNA testing could be done in PA.

What I am glad about is JAC is keeping smack on top of this and JB isn't getting away with what he thought he could.

And that most deservedly needs a :woohoo:
imo

Was it mentioned that it could have been a missing prostitute? :croc:

Or did I dream that?

According to Cindy, it must have come from the body that someone snuck into the trunk when the car was at the impound lot, then snuck back out again just before George got there.

What about the 17 hairs that Henry Lee supposedly found? Why weren't they tested? No money to spend on that ? Just take the taxpayers? Seriously , what did Baez pay with all that money?

LOL - I think your answer is up in the myth busters thread - he did not find 17 hairs. The LE processed the interior of the car and found them. He forgot to mention that - what was it he found in the interior of the car - not the trunk? One in the interior then left?

I am thinking it is by phone because it is just a money and JAC question, and is really not a direct element of KC's criminal trial or proceedings. this is not anything that has to do with the SA or the criminal case, and is not something that the judges orders would require KC to be present for. As such the judge is probably looking to accomplish it in the most expeditious manner.

What is the second hair?

  • #32
Did the hair they found with a death band have a bulb for them to even get a nuclear DNA sample?

  • #33
I was led the believe.....

that the lab in PA was one of few that did "Touch DNA" testing, which is why HHJP let it go through. Better there than Holland.

Now Baez is trying to sneak regular DNA to that same lab.

I think.

I've been wrong before.

rbbm: This is how I read it too. Oh well, I have been wrong before too, so I will be in good company with you if we are both wrong!

You bring the chips, and I'll bring the beer. If we go down, we deserve to go down in *style!*

:D

I'll bring the Salsa

I understood it the same as the both of you....I thought the latest DNA testing was about the hair.

Reading over the motion for clarification..

Point 1. on sept 27, 2010 motion filed for " DNA testing on 2 items evidence"..

Point 6b "There are 2 items to be tested as outlined in the defense motion.."

Baez he did not specify the 2 items to be tested in this motion which he did in his original motion..and the original is not attached to this motion in order to reference the "2 items"..

I don't believe it did. It was determined to be either from KC or Caylee. And remember KC said she was still alive.

Casey's defense: We want to spend $2,000 in public money on DNA tests
snipped
"Her attorneys want to spend just over $2,000 to have an out-of-state laboratory check for DNA on the victim's shorts and on a bag found with her remains."

Other media stations are reporting it is about the "2 hairs"...

http://www.clickorlando.com/news/25824542/detail.html

"At the hearing, Anthony's defense team is expected to argue to have new DNA tests performed -- at taxpayers' expense -- on two hairs that prosecutors say prove Caylee's body was in the trunk of her mother's vehicle at some point."

This is where the confusion is coming from...I believe the Sentinel is correct.

I thought Dr. Lee does this for oranges....wasn't he on the forefront of touch DNA during the Ramsey case? (Obviously he is not a one man lab, but still....$2000 or a crate of navels?)

A now famous quote of Mrs. Linda Drane-Burdick in court, arguing to Judge Strickland, "Again, we have the perennial issue of the defense not serving notice on the proper parties".

Perennial!!! Love it!
He just never learns. Mason for all of his 30 plus years of expertise, sure hasn't improved Jose's track record of filing motions, wrong on the facts, wrong on the law and not properly served. Heavy sighs will be audible from the judge.

The judge agreed to a phone hearing because he is going to make very short order of this. He has his ruling typed up and ready to announce, just as sure as the sun came up this morning. He has real work to be done today, already on his docket and it wouldn't be prudent to have a protracted hearing on a very simple matter and put his entire schedule of other matters and hearings and witnesses, etc out of whack. I'd be shocked if this took 22 minutes.

Yep and that was due to CA giving the hairbrush used by both Caylee and ICA. She never gave Caylee's exclusive hairbrush, which IMO, manipulated the outcome of a positive match to Caylee's hair...one of the obstructions CA put out there...JMHO

I think the defense is wasting their time. Especially after Dr. Haskell's report...JMHO

According to HHJP's order

http://www.ninthcircuit.org/news/Hig...20Evidence.pdf

it states:

"Mr. Eikelenboom is described as a pioneer in the field of touch DNA and is willing to test the items of evidence pro bono."

So can someone tell me why JB is asking for JAC payment?

Don't get it. TIA

Actually, they just couldn't get nuclear DNA from that hair. They could only get mitochondrial DNA, which can tell you the maternal "line" that the DNA came from, but not the specific person.

CA's attempts to mislead LE by giving items with mixed DNA didn't do her much good. LE had Caylee's full and separate DNA profile from the paternity test that Jesse had done after she was born.
