What about the education LKB gave us on bench notes? Don't (forensic) defense witnesses keep those?
I totally agree. JB's saying that he didn't ask his experts to create reports or notes contradicts LKB's education and arguments on the importance of having these notes. Uhh... JB I'm confused...:waitasec:

wouldn't be the first time that an atty left due to non-agreement with jb....TL the first death penality lawyer left due to jb/ICA not wanting to agree with his projected defense (granted it wasn't really stated but come on peeps we read between the lines----jb and crew I don't think even read---they skim and pray that they find something to spit out....) I still want to know what is up with always looking towards the ceiling in court---he is always looking up their....

BBM: I believe someone who was in the courtroom said he is looking at the clock which is high on that wall.

Nope, not at all.

I believe there are, some form or fashion, notes from the examination of the evidence by the Defense.

Baez stated he did not ask the Expert Witnesses to write reports...okay..BUT I don't believe NO ONE has notes regarding the examination of the evidence.

IMO Baez recorded (either via video or other electronic recording device) the meetings with his Expert Witnesses or even took notes himself after the Experts examined the evidence, so it is HIS work product.

Remember the Hearing when Mason was complaining about not getting notes from the SAO from a Depo..and Ashton stood up and informed the Court that he knew for a fact that Mr Baez personally RECORDED the Depo.

IMO

Does this order mean that Baez fulfilled his duty to JA?

I can't answer that, if we're lucky MuzikMan made it to the courthouse today and will be able to tell us who filed the Supplemental Discovery posted on the court docket.

The order is to memorialize what transpired in court on Monday.

The loophole might be that the order talks to the experts notes, video and, photos ... if JB took the notes, video or, photos then per upthread ... he has an out to withhold IMO.

ETA: The statement on subject matter for the experts is sadly open to much interpretation and, JB is interpreting it at one minimalist extreme.

If he attempts such a loophole, it won't last long. sorry but I can't see ANY professional "expert" being willing or able to testify in a capital murder trial without some sort of written record with which to reflect back on their findings at the time examination. No expert can or will attempt to do so from memory. And if they were to try they would get chewed up in court and completely discredited. Nor would any professional expert accept notes written by JB or any attorney. It would essentially be the attorney writing the report and then just paying them to say it in court. In other words much too blatant to get past a jury. Somewhere those experts have written notes. They have been ordered to be produced. It's as simple as that.

BBM: I believe someone who was in the courtroom said he is looking at the clock which is high on that wall.

Typically when someone is lying they have a tendency to look up and slightly to the left (may be reversed for lefties) because they are accessing the visual construction part of the brain (ie visually fabricating something in their mind). Where as someone being truthful will have a tendency to look down or to the right (once again possible reversal for lefties).

Now I've always heard that and anecdotally (is that a word?) it does tend to work.
