I am so happy the State is not using Maya D or the jailhouse tapes. Best news I've heard all day!
 
I totally agree. Intially I hoped ICA didn't do this, and looked for things to prove she didn't do it. I think after hearing that call it was the turning point for me. I knew she was guilty at that moment. That phone call is detrimental to her.

It is. If you listen after Kristina says something to the effect of she'll die if anything happened to Caylee, you can hear ICA say "whatever"..that was one of my A-HA moments.

ETA- It was actually "OH WELL" even worse IMO

Casey said "Oh wow (or well?). Oh. My. God. Calling you guys? A waste... a huge waste." Yes, this was after Kristina sobbed to Casey... begging for Casey to tell her that something didn't happen to Caylee. That should would DIE if anything happened to Caylee.

I really hope they play this phone call at the hearing this week. I want to see how Casey reacts to her own words in that phone call.
 
So do you all think without a doubt that jailhouse call ("All they care about is Caylee... gimme Tony's number!) will be played during the motions hearing this week?

I do hope so. I want it to be blasted full volume in its entirety.

This is going to be HIGH THEATER. Major big. Major big.

It hadn't occurred to me it would until now. I kinda think it won't be played. They're trying to keep it out and I think they'll object to high-heaven if it's heard before the motion is decided. Talk about inflaming the potential jury pool!

I hope it's played but I dunno how that's possible.

OK well as much as I hate to say it, I'm voting it will NOT BE PLAYED in open court.

It would be like them showing the tape of her reaction to the remains being found in a motion hearing to keep it out.

It ain't gonna be played, folks.

Maybe in chambers but not for the world to see. Not yet.

I hope it is played, but I can not say that it will be played? They could just use a transcript... but the words in black and white don't do it justice, so I am really hoping that they play it.

I don't see how they can deem it too prejudicial? This is Casey. In her own words. It shows her state of mind, imo. She could care less about Caylee. She was actually irritated when anyone would even mention Caylee. She didn't call to talk to them about Caylee... she called them to get Tony's number. Tony's number! Tony's number! Yes, it is shocking to listen to, but it happened and what isn't shocking about Casey's behavior during this entire case? She can't even fake caring about Caylee. It's just who she is. I don't see anything prejudicial in showing to a jury exactly who Casey is?

The phone call is public record. It's been available since 2008. Anyone can find it on youtube so I don't see how playing it during an official hearing is going to be any different from someone simply looking it up on youtube?

I could be wrong though?
 
Oh I agree. The jury MUST hear it. Nobody's fault but Casey's it's so damaging.

It's what she said and it was legal to tape those conversations. Every inmate has the same situation. She's not speshul.

I'm telling you, if the Judge doesn't allow this in, and if he deems the family agents of the state (laughable) I will not watch this trial.

I think he'll let them in though.

That's a great point, unlike the jail reaction vid, it has been available for a long time. Hey, I'm feeling more hopeful now!
 
just wondering. When they play any videos to the jury during the trIal. Will they blot out all the F bombs KC expresses like they do for the tv audience. That goes for the rest of the family. I know CA uses that language also. Might not go over very well with a more mature jury.

That thought has occurred to me too.

But on balance, the jury is going to see and hear a lot worse. This ain't no TV show with a censor board. Let the F-bombs begin.
 
Hey, if she'd been more cunning she'd have proclaimed her love and devotion to Caylee in those jailhouse tapes and the defense would be proud to show them to the jury. They'd play heavily in her defense. Poor dear.

Too bad that's not what she said or felt. Her words. Too bad, so sad.

I wonder if it's too late, because HHJP already set it for hearing. I can't wait to see this one!

They can still make a written argument. It's not like this would preclude or cancel the hearing. All it is is the defenses response to the states Motion to Show cause. It will be heard as part of that hearing.

I figure if nothing else it will make for some typically amusing reading.

Nums has posted a link in the news thread to Bill S commenting on the jail vid and Maya. He states they will not be used because it may play into the defenses sad theory that KC was being set up by the sheriffs office and affect an appeal. It was KC's choice to make that first call home. She probably asked to make a call and called whom she wanted to call. No set up, just ICA's priorities taped for all the world to hear. I see no reason for it not to be entered into evidence. KC had a lawyer and the whatever ammendement right (Sorry Cdn here) to call and did.
They can play it while TonE testifies because you know the defense will attempt to shred him up and paint him as an accessory or the mastermind behind the accidental drowning. :twocents:
