OMG. Just when I think a dumber motion couldn't possibly come up...are you telling me, Mr. Baez, that you are WHINING that you won't be able to say the smell of decomp in the back of Casey's car is garbage because the meanie LE let took the empty containers out of the garbage bag and let them air out? Seriously? So you want the decomp smell out because there's no garbage smell to compare it to? You whined about the sniffer stuff, but now you're saying there's no stuff to sniff? OT somewhat, but I am really starting to get a bad taste in my mouth for Defense attorneys. I know they have a job to do, but JB really takes the cake in being slimy. How many times can one's jaw drop the floor in one case??

If LE went out today and purchased all the items in that bag and let them sit in a hot trunk for 12 days right before the trial. Then brought the bag to court, along with a sample from the trunk it would be easy to smell the difference between the two. So it makes no sense to complain that trash that did not smell like garbage would do so after 3 years in storage. JB just does not want anyone to smell anything, including the "roses." jmo

The defense states that Simon Birch (the junk yard owner) states when he opened the trunk he thought the smell came from the garbage bag. DID THEY NOT READ MR. BIRCH'S DEPO where he stated that he smelled that smell once before from a car where a man had committed suicided in and the body was found days later?

This is why experts create reports JB. You know when there is a taped body outline on the pavement? That doesn't stay there for years and years. Pictures are taken and reports created about how the person died, etc. Can you imagine every car accident made to stay in it's place until after the trial? There would be chaos all over the world. No Jose. We make reports about what is found, pictures, test results etc. There was a report made about the trash, pictures created about contents. Why in the world would they keep the trash contents around forever?

You know, I read what you said, and my immediate reaction was, I so wish the SA could retort by saying Casey intentionally destroyed Caylee and that's why a smell exists in her trunk!

I just don't get Baez's thinking. He doesn't bother to read any case material, and just makes up something that sounds good and hopes it sticks. I mean, if this was in court, all the SA would have to do is go hold up the depositions and such that show that Baez didn't read them. Like the fact that there were food CONTAINERS, not food, in the garbage bag, for one! This is going to be the fastest shot down motion in history, I bet. Did he even bother to ask the SA's person who took the trash out what was in the bag? Or even LOOK at what was in the bag? Apparently not because if he had, THIS MOTION WOULDN'T HAVE BEEN WRITTEN!

I really feel for the SA, who has to go do the research FOR Baez to rebut him on every stupid motion he does. Yeah, I bet this is going in the SA's Motion Hall of Shame for sure!

The crazy thing is there is no need to put "intentionally". The motion would be the same if they simply alleged that evidence was stored impropery. I think he's trying to play a game because of the tampering allegations and sanctions. I believe that people who do things in a sneaky, mean, underhanded manner attribute those same intentions to other people. They assume other people do things the way they themselves do.
