ooo. Yuri reading from a report and Yuri admits that this interrogation WAS custodial and non-Mirandized.

Wow KC laughed about the situation after being arrested? I had no idea - that is sick. THanks for that info Baez.

  • #743
isnt her hand cramping right now?? is she writing her life story??

I think she is writing everything Baez says. :floorlaugh:

  • #744
why no miranda after arrest? That part has me confused

  • #745
10 minute stretch break - I need to go to the poweder room myself!

  • #746
10 minute break.....

  • #747
Would someone just tell me now if KC could conceivably get off because LE did not mirandize her?

She won't, and this isn't about Casey "getting off".

This Hearing is strictly about her statements being used in trial, or not.

Don't forget that her Written Statement includes almost everything she said at Universal, so there is absolutely NO loss to throwing out all of her Universal statements - IF that happens.

JB hasn't asked Yuri Melich about his phone call to George yet??

  • #749
break! come back and 5 till the hour! (And I did manage to get out of my jammies and into some clothes - not that that is going to fool hubby in about an hour.....)

  • #750
Isn't there a few instances where it's not required to read someone their Miranda Rights? Or am I wrong?

Thank you. :)

  • #751
WTF is Casey writing War and Peace II ?

  • #752
Am I the only one that sees this as a problem for the State? JB is making some good points for the defense. Thees cops thought she had done something, but did not read her her rights. After learning ICA was lying and misleading them ,they still did not read her her rights. His point is ,after knowing all this garbage MY CLIENT stated they MUST have considered her a suspect and should have read her her rights.
If he can convince JP, this will all be thrown out and the defense wins a big round.
They don't have to.

If LE decides I'm a liar, they can arrest me without Mirandizing me, unless they want to question me further after the arrest.

10 minute break. Does anyone think this is going to get tossed? I'm concerned that YM used the word "interrogation" - in which case, ICA should probably have been mirandized in the conference room. Yes, she was free to leave, but I also interpret that it was a formal line of questioning. It could go either way at this point.

MOO

I don't think the State ever even really needed this to come in at trial. I think Yuri was more than happy to sit there and make JB squirm. I love it.

  • #755
Side note - I have not done any work today - and I have deadlines people deadlines - but I can't stop watching this.

They don't need her statements to Yuri on July 15th the state will have to get the what happened from somewhere - will KC take the stand and lie under oath?

I am irritated at Lyons - the Baez investigator laughing and shaking his head at Melich's testimony.

Apparently he believes that ALL investigators are as shady and unethical as he is.

Baez is using "word gymnastics" again.

He specifically asked if YURI Mirandized Casey after her arrest, and Yuri said no.

Someone did, however, but Baez isn't going to tell you that.

Are they on "potty break" ?

Agree, and agree!

Ain't Yuri somethin'? :floorlaugh:
