What did JB do?

You really have to watch the hearing - Baez kept insisting Yuri admit that ICA lied again and again and should have been considered suspicious and a suspect in her daughter's disappearance. But to watch it roll....unbelievable. We could not believe what we were watching and hearing. We knew what Baez was trying to achieve - the mirandize part, but what a route to take!

The fellow I sat next to commented during Yuri's testimony that Baez was ripping into that untrustworthy detective. "a new cop could estimate the weight and height of John Allen".

Yes, but Yuri was being very tongue in cheek and just being polite. I gather detective John Allen is a bit of a pork chop...

So was the money Cindy's first concern...or what?

ETA: Why would you even bring that up after you find out your granddaughter is missing?

The deputy testified that Cindy told him she was afraid that if the police just left to investigate, that Casey would take off and they wouldn't have any info on Caylee. She told the deputy that she wanted them to arrest her on the fraud charges to keep her from bolting. That's why he acted with the cuffs - then - his supervisor basically THWARTED Cindy's plan by saying "Release her" - that it was about a Missing Child and they would deal with the other stuff at another time.

I'm still thinking JB did a good job showing it was unreasonable to believe that JA and YM didn't believe KC was guilty of something ,by admitting to all of KC's outrageous actions. It was a risk.He went out on a limb ,but with a purpose,and he just might win.:truce:

But imo it does not matter if he thought CA might be guilty of something or not, they still were looking for a missing child, urgently,so her guilt, as a thief or embezzler or anything else, did not matter at that point. As Yuri said, looking for a missing child was his number one concern. So her lying about being employed at Universal took a back seat.
Finally, when it snowballed, and they had all of the lies and the background interviews done, THEN they arrested her.

KC angrily smacking at her attorney is not going to play well for the jury.

Can someone tell me when this happened? Is it during Yuri's testimony? I'd like to see it...maybe it's time to put the cuffs back on.

RR, the deputy who did it was on the force under a year on that night. He stated that CA approached him with a bunch of receipts and statements and said that KC had been stealing her money, that she was afraid that KC would flee if LE did not take her into custody before they located Caylee, and so he cuffed the accused. His superior quickly advised him that their primary mission was the missing child case, nothing else, so he uncuffed her in 4 or 5 minutes.

It was strikingly apparent how nervous he was and how scared that he had done something to foof up this case. LDB was excellent with him.

And didn't CA say when she was on the stand that those things were never discussed once LE actually got there?

Didn't George say he took the battery out of her car so she couldn't run during one of his initial interviews?

I agree,but the law and the judge may not.The Universal statement wasn't about KC being a thief or embezzeler,IMO.It was about her lying about everything,including where she left Caylee ,IF she left Caylee.
By Universal ,LE already knew she wasn't working ,so why have a nanny? Why lie about where you last saw her?
They also knew about the smell in the car.
I absolutely believe they did what they had to do to find Caylee and find no fault with how they did it. I just think it may get tossed out .
What really bothers me is that we'll have to endure some gloating from the defense.:sick:


ETA : Actually ,YM didn't know ICA wasn't working ,only that she wasn't working at Universal ,so I'm correcting myself.
Still,HHJP has to consider if this can be an issue worthy of an appeal. He will most likely err on the side of caution ,IMO.

Actually Yuri might have been thinking, as Cindy likes to say, just because Casey is a liar doesn't mean she is a murderer. At least that's probably what Yuri and the other detectives are thinking at that time - again - finding this missing toddler was paramount to them. They assumed the child's mother would want to help. They were getting conflicting signals/info. The case building began later.

For all they knew, Casey lied because she left Caylee with someone that the parents didn't approve of. Or lied about Universal because she didn't want the parents to know she didn't have a job (which actually WAS the case). To them, at that time, that didn't necessarily mean that she had anything to do with Caylee's disappearance. Hinky smelling, yes. Murdered her baby, not necessarily.

Once they put all these pieces together, and Casey couldn't "confide" in them or refused to give any additional info, her lies became very meaningful. That's when she was Mirandized and arrested.

I see no problem with this, but I'm not an attorney and don't know how the rules of Miranda are interpreted.

I just watched a brief snippet of Cindy's testimony...please tell me she didn't actually call the State Prosecutor by her first name?!!!!!!!!!!!!

Yes, she did.

Uhm, the date right now is July 16th 2008, its about 1320 hours. We're at Universal Studios I'm here with Sgt. Allen um, I'm here with Detective Appie Wells um, also here with Casey Anthony.
Q: And Casey, we talked early this morning and we're working a case looking for your daughter, is that correct?
CA: Yes
Q: Okay. We came to Universal Studios we're sitting in a little conference room. Obviously the door is unlocked. We just closed it so we can have a little privacy and talk to you.
CA: Uh-huh(affirmative)

Q: Like he said you, you seem like a pretty bright person okay. You're here willingly, right?
CA: Oh absolutely.
Q: Your whole reason for talking to us is, is to try to help, right?
CA: Uh-huh(affirmative)
Q: Nobody's forced you to talk to us, right?

Q: You, you want us, you want us to...you're here because you called, you want us to help find your daughter, right?

After all the times I had seen that picture of Casey smiling, in the blue hoodie, it really got to me this time. She knew Caylee was dead, disposed of in garbage bags with duct tape covering her face, but her smile couldn't have been any bigger had she tried.

I really do feel for the jury that gets sequestered for this case.

LE: We need to end it. It's very simple we just need to end it.

LE: At this point we can explain that you're afraid you know, that you were ashamed or maybe something bad that happened. You were afraid that, maybe what's happened. But now we're giving you this opportunity and you continue to lie and you continue to lie. Then what happens at some point it becomes there's no excuse, there's no reason, there's no reasonable, a reasonable person can look at this and go wow, this is a person who really just doesn't care, okay?

LE: ...okay. You tell me you're ...you're...you know, you're a smart person, figure it out okay. Is that you have lied to him about all these things.

LE: We wouldn't be here. So, we know and this is the part we need to get past. We already know that you're not telling us the truth. That you know what happened to Caylee and you know where Caylee is.
CA: No
LE: But here's...here's...here's what we're trying to get by is that there's...you're...you're...you fall under one or two categories. And I'm sure he explained it and I explained it. Is that if this is something that an accident happened and, and no matter how you think people are gonna look at you, they're gonna look at you a lot worse if they show...if you continue to show that you're callous or not caring and that you show complete dispassion and disregard for human life.
CA: Uh-huh

I lost video right after HHJP asked the attorney's to approach the bench.

This happens at the very end of Part 4 at the links I just posted above, right after Det YM is excused.
