IANAL, but since BD invited LE into her home (after giving LE a false statement about SA being there) then I don't think it can be considered an illegal search & seizure.

It's an interesting aspect to ponder. I wish we had an attorney on these threads.

I think it is the same thing as if you are driving, pulled over for speeding and you have drugs or alcohol on the seat of your car in plain sight. Once she consented to a search if there was something in plain sight sitting on a table I think it is fair game.

It could possibly also been on her person. Which again is fair game once she is placed in custody for the other charges.

Yes, but for SA....that's what (or who) the warrant was for...just SA and not her house or anything in it. That's what I'm wondering....since it was SA only....can they legally charge her for drugs found there?

If anything was in plain sight they can arrest you for it.

And there was a previous report that said LE SMELLED illegal drugs and that was enough cause for them to enter the home. Billie and SA were probably smoking a joint at some point and then the cops arrived. imo
So once they smell drugs they can enter your home, warrant or no warrant.

Do you have a link to that? I dont belive I noticed they said that. Interesting.

One joint and LE smelled it outside? Do we even know if they smoke weed? I didnt see her charged with weed then or ever. It would be weird for them not to charge her for that as well as the other charges. Maybe they ate the roach and the baggie to hide that evidence but still you think they would have something. A bag, A seed.. a bowl..residue a grinder. It isnt like weed is effortless. JMO.

Lime light.....lawyers love it. Of course you may be right, she may be THAT stoopid. But if she's lying about this, she's coming unwound faster than I thought and I knew she was rattled.

LTNS friends! Have been checking periodically on this case both here and MSM.

Why would you file a no-trespassing order one day, and then meet the person the order is intended for the very next day? Sounds like some loose ends, and stories need to be agreed upon, and fast. :maddening:

When is BD scheduled to appear in Court? Is it possible the charges; hindering apprehension, possession of a dangerous drug and lying to police were dropped?
LE did not find what they were looking for when they searched SA and I'm not sure if muscle relaxants are a dangerous drug.

I believe a "dangerous" drug is any controlled drug (ie one you need a prescription for) that is not otherwised listed as a narcotic.

You are not supposed to have, use or provide them without a prescription.

I think they charged her because she was in possession of a prescription bottle with someone else's name on it, and the pills didn't match the label.

Those are common practices among people who use illegal prescription drugs.

Muscle Relaxers are considered "dangerous" because by law they aren't supposed to be resold on the street. They can intoxicate someone or possibly cause a life-threatenting condition, which is why they are by prescription in the first place.

Of course BD downplayed the importance of the drug charge:

Dunn was not at a loss for words when it came to her three charges, especially the drug possession charge.

"It was completely a lie. They [officers] found a prescription bottle with my name torn off of it."

My guess would be around 30 days from the date the charges were filed, which means to me around April 29. Her lawyer could probably file a continuance but it would be up to the judge to grant the continuance.
