I may be wrong, but I do not believe the DT is going to float the accidental death, afraid to tell family theory. If this was truly the case, the DT would be grossly negligent in their jobs of representing KC. No attorney, not even Baez, would have their client facing a death penalty murder charge if they knew the death was by accident. They would have advised their client to plead to a lesser charge and there would be no need to be here going through this right now.
And if their client refused their advice to do so, they would have withdrawn from the case. No attorney is going to advise their client to roll the dice on a death penalty charge if the death was by accident.
I am more convinced than ever that this was not an accident, that it was a true homicide by KC, and their only hope is to take it to trial. I truly believe that KC cannot and has not admitted to her DT that she did this and this is why we find ourselves where we are today.
