I am sorry to disagree about the court's "bias". What happened was perfectly correct. And had nothing to do, in my opinion, with the judge favoring any lawyer, side or race. It was a legal challenge made by the DT (CM) asking JA to justify that his striking of this potential juror was not based on her race. JA, IMO, had not asked enough questions to come up with a reason that would have passed muster with an appellate court. So the judge did what was correct and disallowed the strike of this juror by the state. It had nothing to do with bias. even by the state. There were great reasons why the state didn't want her, none of which were her race. But because, as the court put on the record, she was in a protected class (AA), you have to do a little more to completely avoid the appearance that her race was the issue. Same thing if someone strikes a woman because they want an all male jury for a particular case. You have to be able to show that you had another reason to strike her, not her gender.
This judge was correct. my opinion only.
After they choose 20, aren't 8 of them drawn at random for alternates? Lawyer, anyone? That is what I believe to be true.
This to me sounds like BC has let some cats out of the bag. Maybe the Anthonys have known all along the bus was coming.
Why would age be a mitigating factor in this case???? FGS ICA was 22, not 8...
Me TOO! Im glad it wasn't just me!!
To the Judge: No, i cannot consider how old the defendant was at the time of the crime.
I listened to her carefully. She seems a bit dotty to me. Sweet but lacking in intelligence and possibly some life experience. her interests are limited to westerns and computer games. No friends. But most important, she was unable to understand some basic questions. My problem with this is that when people cannot understand something, they will discard it altogether and go off instinct.: "Well, i saw the pictures of this young lady holding her baby. They looked so sweet together! Oh, she couldn't have killed her on purpose! I saw her smile at me in the courtroom and she looks so nice. Also, I really liked CM, he was so nice to me! And that young JB was too!"
She will likely respond to the smarminess of JB and the folksiness of CM better than to the professionalism of the state. JB already had her eating out of his hand. Nice old ladies who are not bright or quick tend to respond to sweetness, not facts. I think of even my mom, who is ridiculously smart, but who had agreed to some major purchases based on what she feels about the salesman. I then come in and can see he is schmoozing her. She then gets mad when I try to stop it because she doesn't like her instinct challenged. And my mom is whip smart! So what happens with a lady like this who is not?
Just remember all the people on websleuths who had a hard time believing a nice looking young mom could have hurt her baby. They were steadfast for a long time and had their own innocence thread. Many people now still are convinced it was only an accident and these are smart people who have seen all the evidence.
We have pondered this case for almost three years. This lady will have to rush through in two months and I don't think she will comprehend a fifth of it. Very worried where I was supremely confident before.
Anyone else think that CM is needing to handle a pressing matter cough cough Rosalie???
