Talking about all this Southern food, made me think about how much I miss fried-green tomatoes.

OK, so far this morning we have seen one potential wit questioned at length. He very much polarized the board in terms of everyone's impressions of him. When voir dire was over and he was sent out of the room, CJBP gave a loooooong speech about the process, how long it was taking, whether they would be finished in time, they are paying for hotel rooms in Orlando since Tuesday... JB said in open court that when the jury was picked it would be "time to get to work" (but we all know he doesn't want jury selection to ever ever end).
Then they took a 30-minute "5 minute break." Then they came back and went into sidebar immediately. Then they went back into open court and the SA used a peremptory to remove the PJ from the morning. CJBP pulled strings and got the courtroom in Pinellas through Saturday. He said we WILL start on Monday in Orlando, IF we have a jury.
And WSers worldwide screamed aloud in despair.
That's about it, I think.
I am still confused about all these strikes. Last night on JVM, this was discussed.
VELEZ-MITCHELL: It`s a separate set of strikes for the alternates?
CASAREZ: Yes. They are getting additional strikes for the alternate; one strike for each alternate.

The additional peremptory challenge may be used only against the alternate juror and the other peremptory challenges allowed by law shall not be used against the alternate juror".
So I guess if we are looking for 5 alternates that means 10 more strikes. Do we only have 15 PJ's left? If so, this is not looking too good. JMO
That's about it. That's why we are talking grits here on this thread! Seriously, there was a motion by JB (argued by Ms. Frye) about delaying the trial. Something to do with they didn't like how the jury was being picked and strikes having to be used. Somebody will have to fill in on that because I MISSED THE WHOLE THING....:banghead:
I am wondering if this scenario could happen. At some point today or tomorrow, we get 12 people sworn as jurors. Then at some point between now and Saturday, we get as many alternates as possible. Then those are sworn.
Does HHJP have any way, option or authority to toss them all together and make a juror salad, then randomly select who can be a main juror, and who can be an alternate? This would satisfy the defense's 'concern', and would also mean another chance for the worrisome juror to be an alternate.
Wouldn't that be lovely?

You didn't miss much this morning...Defense set forth a motion regarding jury selection and the unfairness of it all...(whine)---Judge Perry basicaly told them to cool their jets and find case law...then we went on to a potential juror only to have him excused....then mostly "5" minute breaks to discuss this or that---they are in a court of law and I can't figure out what clock they are going with...their five minutes is lots longer than mine!
Oh yeah....jb said he was willing to continue working then wanted and extended lunch.....could go on forever....:banghead:
Fry up a ham steak in butter in a heavy skillet. When it's nicely browned, take it out, and use hot coffee to deglaze the pan. Make sure to scrape up all the browned bits on the bottom. Pretty darned good!

Thank you for the updates but because I missed this morning. When you say start over in another county do you mean the entire jury selection? I may die if you say yes.the truth is we dont know wtf is going on either....but I will give it a go...
defense sent poor miss fryer up to try to argue that doing the jury this way is unfair, and hizzonner smacked that down, basically saying for one thing they've known he would seat this way ages ago, why not probs til now?
then they get to the last PJ so far, the only one today whom the state peremptorially (is this a proper word?) struck, who was apparantly amazingly dressed, and absent yesterday due to no gas in the car.....
then they went to in camera, then to in sidebar, and just before that HHJP said they wouldnt have court after tomorrow (as in actual facility) and did also say they might start over again in another county!!!!![]()
then they come back and go to a major long lunch break, just before which HHJP said they have the courtroom til saturday.... that they WILL begin opening statements 9am on monday...in orlando.....so long as they have seated a jury.
sorry it's all over the place, now you see why I usually dont recap, my memory does not work linearly :biglaugh:
I'm from the south and I HATE grits! Unless it is at 3:00 a.m. at a Waffle House. Oh, you northern people don't have Waffle Houses, do you? That's the usually the only place open at 3:00 a.m. when you are trying to ... get something on your stomach after a night of partying!

Pay particular attention to this NEXT juror because he/she may determine whether we seat a jury today!
THe prosecution has plenty of "playing room" in determining whether a juror would be pro prosecution (with 4 strikes available)..
BUT....if this juror even leaves the SLIGHTEST impression that they may NOT be pro Casey or pro defense, Baez has a HUGE decision to make (or is it Casey's?)....
Strike or pass and let jury be sworn in? But what if there is a chance the SECOND juror after the break turns out to be VERY pro prosecution?

I believe there will be a prompt new objection/motion from the defense, after they question the remaining 15 potential jurors .... and the defense will say they were forced to use their other 9 peremptory challenges BEFORE the Judge reversed himself and let them question the remaining 15, and they would have used those 9 strikes differently.
And then that would open the door for the State to also argue that they would have used their strikes differently .....
The Defense is not going to be satisfied to use only one more strike after questioning the remaining 15 .... IMO
