It would appear that JB may have forgotten the tattoo. "A beautiful life".
What can he say about it? :waitasec:

A - She liked the sexual abuse? Thus, "A beautiful life"? :waitasec:

B - This theory is baloney and I forgot about the tattoo? :waitasec:

I really don't see how he can expect this to fly.

Speaking of the tattoo - Am I alone in thinking it was NOT a tribute to Caylee but rather signified Casey starting a new "beautiful life" without her? She felt like she had a fresh start, remember her diary saying "this is the happiest I've been in a long time". I just don't think it was for Caylee at all.
 
Ugh. I hate saying this, but if I were on the jury, the rules explanation would fall flat to me. He knew the smell of human decomp, yet didn't call the police because of procedure...? He didn't even have to call 911 – he could have called the police station and said, 'I have a car here that smells like human decomp. I can't see anything, but I can smell it. The trunk is locked. You might want to send someone out to have a look.'

My brother n law is a paraplegic, he had the most awful bed sore..It was located on his hip and grew from the size of a quarter to larger than a softball in a little under a month. The smell was something unique to me, it was awful, we had to repaint his room, take up the carpet and replace it, buy him a new bed and everything. I even threw away a basket of laundry because we couldn't get the smell out of the clothing.
If human decomposition smells anything like what I was smelling, it is certainly something that is not forgotten and easily noticed.
While visiting a nursing home to see my grandmother before she passed away last month, I recognized that smell in the room next door..I asked the nurse if someone had a bed sore and she said yes that the woman next door has been bed ridden for almost 2 years and had a severe one on her foot.

rotting/ dead flesh and also the smell of burned flesh...very nasty. I am used to really bad smells as a nurse, kinda grose but it doesn't bother me much. OTOH, when my husband sits down to eat a bowl of beefaroni I almost puke. LOL
 
The state isn't finished questioning Birch so they may ask the direct question why he did not call police.

That she got it to remind herself to proceed as if all was happy and good?

Albeit it's in a rather inconvenient place to do that.
 
I wanted to tel you guys that the thing about the cars being sealed and not really smelling bodys ,

I know for a fact it is false, I smelt a body from a car after 4 days from a half a block away ,in VA in July.

It was a guy who killed himslf in his car with the windows up and he sat there for 4 days until the lady at the gas station who at first thought it was trash firgured out something was dead and called. She never even saw the car.

I hope I can make it through this without losing my breakfast. Ugh!

I have been lucky enough to have had the opportunity to smell decomp on 2 occasions. The first was when my aunt's father in law was killed (not going into detail, but it was messy). He was supposed to be going on a weekend trip and never made it, but no one was expecting to hear from him for a couple days, so he was not found right away. After the police were finished with the scene several days later, the family had to go in and clean up. By the time we were allowed in, the body (most of it) was gone. The smell was terrible, but not nearly as strong as it was when a neighbor died in his home. Not the house next door, but the one on the other side. He had no local family and stayed in his house all the time. Didn't associate with anyone really. The paper boy noticed that he had not been bringing in his papers and I think 6 or 8 had piled up. When he went to the door to look into the window he couldn't see in because there were so many flies on the window. When the fire department came and broke down his door, within minutes I threw up in the front yard from the smell.

Just from my observations, the smell remains, but the body actually being in the car would make the smell significantly stronger.
 
Did he ever say why he didn't call the cops that there was a smell or did the A's get there the same day before he could?
 
Following rules and procedures costalpilot - wait for Simon to reel off the company rules... Those towing and storage companies work hand in hand with the police.

I don't think the tow yard personnell would tamper with the car, they have procedures to follow..
They notified LE with the Tag # and obtained the registered owners info...LE would have known at that time if the car was reported stolen..which it wasn't.
 
I have the heat on! unbelievable!

Our high temp yesterday was 46. The dog hid in the bed all day. You're darnn tootin I had our heat on. According to the experts it was the coldest in 50 years. Ghastly!

It's still coolish at 54 today, but sunny and bright, warming up for the weekend. I'm *waving* my arms -pushing it your way...
 
I can already hear Baez with his snarky tone asking, "And are you in the habit, Mr. Birch, of smelling decomposition and not calling the police?" Ugh! Baez really annoys me with his cluelessness - hope he also asks Birch if he knows how Caylee Marie was killed or if ICA tortured her. That would make my day!

This would be the reason I would never need to be called as a witness..

My question to Baez would be

"And Mr. Baez, are you in the habit of knowing a child has drowned, yet allowing the state to continue putting deputies out to find her, costing the county thousands of dollars and putting the health of civilians at risk in the summer heat?"
Mr. Baez..as far as calling the police, I tell ya what...whatever your client would answer to that question, I will allow you to assume it would also be my answer.:crazy:
 
What are they talking about on IS right now? Who did JP excuse and what made him so mad? Did that happen today and I missed it?

No, that was during jury selection. One of the pt's pointed out the other pt's were discussing the case - a big no-no!
 
I am thinking a car windows have a seal on them and so does the trunk. The backseat in the car has no seal so the smell from the trunk decomp would waft into the inside of the car, making it smell too.

Yep, like I posted in the trial thread, I also believe that when the witness placed his hand on the glass or side of the car, an air seal was slightly broken, thus allowing whatever body stench that was in there to eminate.
 
Did anyone else see ICA interacting with the jury this morning?? When HHJP was telling the jury about getting to watch the hockey game. HHJP asked, "does anyone want to watch hockey, tonite"? ICA got a big grin and started nodding, yes! Eyes big! Even mouthed that she wants to watch, too. Something was asked about basketball and she wrinkled her nose and shook her head, no. She was looking right at the jury. Was one of them interacting back with her?? That worries me.
 
Just finished lunch with my daughter Kaylee. 5 yrs old now, 2 when Caylee went missing. That I guess is what caught my attention back in 08 when this all started. So I get on the couch with the laptop and throw on the DVR from this morrning (watching lady from Amscot now).

My daughter has been around all week as I watch this case. She is not watching with me she is playing and watching her shows in the play room. She has caught little things here and there. I don't sensor much from her and I don't lie to her either so we discussed the other day. It sounded like this...

Back in the summer when you were 2 this little girl caylee went missing. Before Christmas she was found and not alive anymore. The police think her mommy may have done something wrong and she may be in alot of trouble. There was questioning back and forth on details and such where I tried to sugarcoat some thing and tell her as much as I could with out scraing her.

So today we are eating lunch...
Her: Daddy is that her mommy?
Me: Yes that is.
Her: Why is she in trouble again?
Me: Because the ploice think that she did something wrong when Kaylee was found.
Her: She was dead? They think she did it? (puzzled look on her face)
Me: Yes they do.
Her: Wow! The police are so wrong! It had to be a stranger or a bad person. Her Mommy would never do like that to her. Jeeeees!

I've choked myself up now :crazy:.
The innocence of the lil ones. AMAZING!
 
is decomp similar to wounds? from a previous job I do know wounds, never human decomp though. only curious. the wounds were pretty freaking bad and IMO unmistakable.

I have no idea personally..

But I have been told decomp is 100 times worse.

Honestly, I don't want to imagine anything worse than a wound smell.
 
Wow just caught up. IMO JB will try to cruify Simon. Should be interesting.

And then what? They would have opened the trunk of the car and... no body. Evidence that we have now may have been compromised. The car wasn't reported stolen. There was no missing child report. What were the police going to do?

He said the smell was coming from inside the car... he looked inside the car and didn't see anything. He dismissed it. I know the defense is going to bring it up, but Simon seems confident and I am sure he will explain to a jury why he didn't call police.

Here's the problem, IMO, Mr Birch didn't have to tamper with the car. He just had to make a phone call to the police alerting them to the smell of human decomp coming from the car.

He didn't. If I were on the jury, his explanation would have to be pretty darn good and have nothing to do with just following procedure/rules.

But maybe that's just me.
