I believe it's because Lee is not on the witness list. (But I could be mistaken.)

Because HE is not testifying in this case. Baez was trying to sneak in some hairs that Dr. Lee found in the trunk but he would need Dr. Lee to testify pesonally. JB can't do it for him because the SA has a right to cross-exam.

Well, he can't testify to everything the state may have done or the defense or who else was involved. He can only testify to what he knows. JB is trying to get in some reasonable doubt through the back door.

BTW, Bill Schaeffer thinks this is the best JB has ever done at cross thus far. he thinks he made some inroads.

But if the witness was present at the time Dr. Henry Lee did the inspection on behalf of the defense then this could be testified to surely? Also, do you mean the following questions were going to provide reasonable doubt?

no worries... he said he did it after he wrote his report (and also was trying to say something about protocol but JB cut him off)

for example as a nurse any notes I keep on patients I shred every now and then... but I don't shred the medical chart..

he is just trying to plant seeds of doubt..

No, still hearsay. If Henry Lee himself cannot testify, nothing can be noted.

I think the question that prompted the sidebar was something about whether Dr. Lee tested or examined the evidence.

This witness really cannot answer to things other people did. Calls for hearsay. JB is trying to sow the seeds of reasonable doubt by putting a "big" name out there and letting the question hang. he wants the jury to think Dr. Lee came up with something different.

It's a sloppy trick. All he has to do is put Dr. Lee on the stand.

GB's report is dated Jan, 2009 because that is when his supervisor reviewed it. Rpt is 46 (or 48 pages) and doesn't get dated until supervisor signs it. He says he wrote it earlier.

He also tried to explain about his notes - there is evidently some policy at the OCSO about notes (but he didn't get any farther)....

OMG...Can JB remember where he is..? so inappropriate at times, the witness threw away his notes because they were trash..nothing to due with your trash theory
