I think the way HHBP went into a lengthy explanation as to why he was allowing the testimony and video/picture in is the means by which to have on record the reasoning behind his decision to allow it, so if/when this case is appealed, this item is not a basis for appeal. It's a mitigation measure.

I bet the DT has LKB and Kobilinsky saying tonight everywhere they can that this was a terrible mistake by the judge to let this in, will create basis for the conviction to be thrown out, etc., etc, blah, blah, blah, but it doesn't matter what they say, it will be up to the JURY, not "public opinion", who all of the talking heads speak to, whether pro-DT and pro-Pros.. MOO, IMO, etc.
