:banghead:OK, I was listening in on WESH while the side bar was going on and what I heard makes me wonder if this is all a ploy for a mistrial?

Did anyone else hear that CM told the judge yesterday that he wanted the judge to tell the jury that the defense did not have to present any kind of defense/testimony/witness? That they were not going to call on anyone nor were they going to present a defense? That they did not have to say anything at all? Then the reporter said that judge Perry told the defense that he did not believe anything from the defense that they are liars!? That they had told him that they did have a defense and now they are lying...:banghead:

Could this cause a mistrial? Casey looks mighty happy. :no:

I know what I heard and my husband heard it to..anyone else hear this and more?

Not quite in those terms, but the judge also said if they were not going to present a defense he would tell the jury at that time but JB has told the judge repeatedly there would be a defense.

They can't just bait and switch, at least I don't think they can.

totally understand what you mean but I think some of us are just feeling like the state needs to rest their case with some sort of emotional bang. its been noted the jury is not taking notes and we have all waited so long for a conviction i think there is fear of hung jury or aquittal if the state does not bring to their case all of the very valid points of the many WS's and tie this thing together. I think the jury is over "experts" and wants something riviting. i know its wrong but its human nature :0(

The state has been going chronologically, so maybe this testimony is just leading up to their "big bang." I'm giving the state the benefit of the doubt, and waiting until they actually rest.

So why is JB trying to hammer home this point that LA used to own the car? He's not going to figure into their theory, is he? Seems like pure innuendo for the purpose of creating doubt, in a slimy way.

Maybe he killed someone and let them rot in the trunk and no one ever noticed before Casey had been driving the car for, how long?

What is "unpublish"?

LDB takes pic down and then appropriately publishes it to jury. Once it's published jurors can see it on their monitors.

Publish is when they actually show the evidence to the jury and court on the telestrator. (sp) Unpublish: they remove the evidence from the screen.

I read here this AM HHJP gave CM and DT a good dressing down about if they will rest or put on a defense at all. It was at a sidebar if that helps you find it I would look for a link but my computer is very slow today. I think he is beyond fed up with them.
