That's correct, but it was still a huge screw up by the DT, because now the jury will want to hear about evidence that Caylee drowned. HHJP has even ASKED the DT a few times throughout this trial where their evidence is that Caylee drowned.

yes and that is why I say they will have to put some kind of case on to prove their point, but if they don't it will work against them when the jury goes back to decide her fate.

I was just watching an episode of Nancy Grace on YouTube where JB is talking about this great lead they have on where Caylee is, and that they expect to find her alive, etc.

I wish he had said when ICA told him Caylee "drowned" and all that.

From an online article stating "Can Lawyers Lie?":

"But what about when the lawyer isn’t under oath? The American Bar Association’s Model Rules of Professional Conduct states that a lawyer “shall not knowingly make a false statement of material fact.” In other words, lawyers aren’t supposed to lie--and they can be disciplined or even disbarred for doing so. But notice, the key word here is “knowingly.” A lawyer cannot “knowingly” lie."

So was JB lying when he said that they were looking for "Zanny", or was he lying when he made his opening statements? I know opening statements aren't evidence or fact, but the whole thing still makes me want to scream. At some point he was lying, IMO.

This is a very interesting article that talks about JB and his press conference with his client...and lying.

I just lost it when I heard her little voice and watched her tighten her pony tail as she read. Her grandma and grandpa, her uncle Lee, they didn't even get to say goodbye no wonder it was so hard for them to accept she really was gone.

Caylee was stolen away from them but there is no Zanny. Her mother destroyed her own family. No family is perfect but no family deserves what this spiteful little brat is putting them through. Caylee must have been so scared and felt so alone

That part (her fixing her pony) always sticks out to me too. She was a little lady. So sweet. Justice is coming Caylee. You will be able to RIP.

snip from your link: ((thank you! that is a great read!))

Opening statements. The prosecution and then the defense make opening statements to the judge or jury. These statements provide an outline of the case that each side expects to prove. Because neither side wants to look foolish to the jury, the attorneys are careful to promise only what they think they can deliver. In some cases, the defense attorney reserves opening argument until the beginning of the defense case.
:rocker:

 :laughcry: OMG! One side clearly didn't read this part!

So really, the DT is screwed either way. :)

How does the defense justify what Baez said in OS to all of the cases and arguments just made by CM? I get the impression even CM knows that malarkey in Baez's OS story is not to be believed.

CM cleared this up when the judge asked him what evidence is there that there was an accident - CM said there isn't any and that it was just a theory that the state has a burden to disprove.

So basically it is something they worked on as a theory and are not peddling it around as a fact - but the jury will never know that.

:twocents: Well here goes...I think Casey did love Caylee but as a little sister. Cindy and George really raised and provided for Caylee. And when Cindy and George could not be available to babysit Caylee and it interfered in Casey's plans that's when she really resented Caylee... Caylee cramped her style. It was like your parents forcing you to watch your sibling when you really didn't want to..................................

Yes, I agree. Everytime I see the video of ICA playing with Caylee on her knees and feet, it looks more like a sister playing with her younger sibling.

ETA IMO ICA never appeared maternal, ever!!

So, HHBP is back there reading "more of the same" in order to mollify the defense?

Here is the video of CM saying she will get life. This was before he joined the team.

YouTube - ‪Cheney Mason....really?‬‏

"..establishes they have no credibility whatsoever."- Cheney Mason

After reading that sidebar discussion between CM and HJBP this is rich coming from CM discussing the defense team :floorlaugh:

"I will take it I cannot trust one thing your side says anymore. Thank you."- Honorable Judge Belvin Perry

Isn't it ironic that CM himself says that all the interviews, and going on Natl. TV, by the Anthonys, eliminates all credibility. Pot calling the kettle black?

He also included the lawyer in that comment. :floorlaugh:

THANK YOU!!!! I nearly pee'd my pants.

This inability to accurately portray a mother who gives a (edited) has left her an akwardly frazzled mess of a tiny trollop in a booster seat at the defense table. In grownup clothes.

Great description. Thank you.

Bon, I agree somewhat. I think Casey loved Caylee like a new pair of shoes - she liked to wear them and show them off now and then, but they soon lost their appeal and wound up in a pile under the bed. People are objects to ICA.

I hope we can watch the DT present its case without our heads exploding. Is there anyone who can use MS Access or any other kind of database to keep track of which lie was spun to where and by whom?

I had a hard time following CM give his completely contradictory statements left and right while arguing his motion for acquittal today.

15 June: no proof of cause of death...place of death...time of death...manner of death
Opening statements: Caylee died on June 16th in the swimming pool. It was an accident.

HUH?

*** EXPLODING HEAD ***

Maybe it's the DT's strategy to try to confuse us all into oblivion.

I don't think the court will rule for an aquittal but I am very interested to see what the defense has to say because:

COD can not be proven or identified. I have to go look at their witness list but do they have a professional that can argue Dr.G's conclusion of MOD? Just curious.

(A few other details too are a little precarious as well in my mind, depending on how the defense manages them)

I don't think that she will walk, it's not that. But she might very well not get a murder conviction. JMHO. I've been thinking this for a week, I tried to distance myself and detach myself from the details that I've got memorized after 3 years and look at it as if I've never seen this before (difficult to do) but I really need to see what the defense is going to say before I can confidently say oh yes she's going to get murder and the DP or LWOP.

All JMHO

Good points......I have to wonder if by chance she gets off, when the jury gets to go home and they possibly see everything we have seen for 3 years they are really gonna be upset.IMO

anyone got the video from nursing home?

  • #318
Since we're all following along - and I fully believe JBP is too - as soon as CM said there were only 2 pieces of duct tape attached to Caylee's skull and one "9-10 ft away", his whole argument on the 'evidence' is null and void. There were 3 pieces attached to Caylee and one further away....this man doesnt even know the evidence in the case against his client, can't trust a word he says arguing against it.

Seriously have to wonder who's in charge of drawing this man a map to get out his front door every morning.

That's correct. In fact, often the language attorneys use in opening starts out, "We expect the evidence that you are about to hear to show that ... ."

It was very clear ICA did not want to be a mother...... :(
