I specifically remember one of the local commentators discussing how in Florida felony murder is linked to Capital murder and the jury will receive specific direction on how to decide between both. He specifically said this jury will get to choose between both. He explained that in DP cases the judge will probably spend some time discussing the nuances of premeditation as it relates to capital murder. Felony murder would not have been a seperate charge as it falls under the umbrella of first degree murder.

If you click the homicide section it says the following:

7.2 MURDER—FIRST DEGREE
§ 782.04(1)(a), Fla. Stat.

When there will be instructions on both premeditated and felony murder, the following explanatory paragraph should be read to the jury.
There are two ways in which a person may be convicted of first degree murder. One is known as premeditated murder and the other is known as felony murder.
 
I am so glad we have spell check here because I am discovering that I can not spell most big legal words and a lot of common ones too.

I would like to know from experience from those who follow as close as I do.
Does anyone know of television coverage national not local that is going to have all the days events with as LITTLE commercial interuptions as possible. I watch HLN and I cringe at the commercials due to missing a moment of words spoken is missing way too much. In session is a little better on commercials.. but the HLN is filled with commercials every 5 minutes.

I heard fox news is covering tomorrow.. I wonder how many commercial breaks will be taken.

I think whatever national cover the closing arguments get, there will be too much commerical interruptions. I tried watching FOX during an HLN/IS break and they seemed to have a lot interruption, so I don't think that will change.

The jury,,, how late at night can they go into delibarations? Can they return a verdict at anytime of the day or night?




I know that they say 20 minutes we will have notice.. however since this is such a national media case I think that the jury may give decision and the Judge will give a few hours notice. I hope so.

I just keep the stream up on my laptop, and when they go to commercial , I watch the live stream ,switch back when the are in commercial.If In Session and HLN both carry it, sometimes, they go to commercial together sometimes they dont so I switch back and forth. HTH

We also reject the related claim that the trial court erred in instructing the jury that it could find premeditated murder, felony murder, or both, when the indictment only charged first-degree murder and cited the first-degree murder statute, but did not specify any specific theory. However, we have never held that the State (or a grand jury), must designate in the indictment or information the specific theory charged, so long as the defendant is put on notice that he is charged with first-degree murder under the relevant statute. Indeed, we have held that even where the State expressly charges premeditation it may nevertheless proceed under an alternative felony murder theory. O'Callaghan v. State, 429 So.2d 691, 695 (Fla.1983); see also Knight v. State, 338 So.2d 201, 204 (Fla.1976).
 
I didn't know there was spell check on here. Where is it and how do you use it?

every time I mistype a word it shows with a red underline and when I right click on it I get to choose the word I was trying to spell. I do not think it was something I ever had to turn on.

Maybe my spelling was just so bad that it turned itself on and if I had spelled every thing right it would have never shown itself

Probably depends on what browser you use,..I use firefox,and it does...which..may just prove Casey did the searches lol

GA never talked about his morning with Caylee
feeding her breakfast...helping her potty...etc
yet he said he usually did that.
Are we to believe he had no interaction with Caylee till he saw them leave?

Why have his stories changed? about seeing her leave with ICA at 1:50 or whatever??

Was Caylee already dead and ICA was just waiting for him to leave to decide what to do with Caylee?

and ICAs initial story had her dropping Caylee off at ZTNs at 9am (she must have had to be at work early...lol).

This later changed to 'between 9 and 1' - yeah I know, a bit obscure, but it had to fit with GAs statement.


I think I recall a blank block of time during the 15th/16th cell and computer logs. Unsure if it was long enough for the crime to take place, but overwhelming a small child would need a very small window of time.

lol well I am a VERY dyslexic typer! I never do that when writing... but I'm a lefty so maybe my brain is twisted! - I mess up when giving direactions too ALWAYS say right when I mean Left... to me I wiite with my right(correct) hand and it gets me EVERY stinkin time!
 
Well, I believe the sexually allegations come from KC. I agree there is no evidence of sexual molestation, though. The Kronk connection I believe is a speculation on JB's part. The drowning theory is the main defense theory though.

I agree, he could imply problems with Kronk, and he could make up a drowning theory. But to say those specific sexual abuse allegations, those would need Casey's word as a source. [ And we all know how much that is worth.]
 
I am of the oppinion that Cindy only came up with the "chlorophyll" searches to cover up for her daughters chloroform searches. That when Cindy was brainstorming with Jose on how they could explain the searches Cindy came up with the whole Bamboo/Chorophyll story. I firmly believe that no chlorophyll searches were deleted and then overwritten. Not that I like to use NG as a point of reference but she stated lastnight that in 4 yrs the only searches that were deleted were the incriminating ones that ICA did.

IIRC, Cindy testified about her computer searches right after her attorney made the public statement about the As believing their daughter is not innocent, but that they did not want her to face the ultimate penalty.

I believe Cindy perjured herself to try to give the jurors reasonable doubt about premeditation. I think that was her intention - because she knows her daughter is guilty and wants justice for Caylee, but does not want Casey to die.

No, it's not right, but I have NO IDEA what I would do in Cindy's shoes.

I know I know...I was just picking on Mark.I actually have enjoyed listening to him lol But today, he scared the crud outta me !
 
Things must have changed since my dad was in practice. I know that he had to be very careful not to flat out lie before the court while accusing innocent people of vile crimes. That was not allowed. He was able to insinuate or imply, but he could not say flat out, ' My client's father was the real killer, she saw him do it herself.' And that is pretty much what Baez did. imoo

You're dad is/was honorable to the profession. I've known many good defense attorneys, who I/we would all want on our side should we need one. However, in this case, there was a whole lot of lacking from the defense.
 
Remember just a few weeks ago when we were all waiting for the opening statements because we were in for an aha moment and JB was going to have it all explained in the first 4 minutes?

.....and now we are all waiting to hear how he talks his way out of the hole he dug that day....

I just had to listen to Concerned Papa's" Caylee's team" on Youtube,once again. I hope everyone in the courtroom,except for the defense wears purple for Caylee,and I hope the hawk shows up.
