Access To FBI Lab Tests May Be Denied

They are not going to be able to deny the defense request forever. A defendant is entitled to view those results. I'm not sure if it will take a federal judge or not, but FBI labs do testing in state cases all the time. I've never heard of them being able to deny the defense just because the judge doesn't have federal jurisdiction.

That's what I'm thinking... Can Baez seek higher up to file new motions since Strickland doesn't have authority over Federal?

ETA: Keeping these straight... Baez will get the results, this is just talking about allowing Baez into the federal labs to oversee the testing.. I think.
 
Wow. This is really interesting.Goes to show, we should never put too much faith in the federal gov't.

That report is 11 yrs. old...........I'm sure things have changed since then. Besides, the testing to my knowledge has been done in other labs so not everything hinges on what the FBI said. All the reports from all the labs should support each other and I believe they do.

If I understand correctly, what was denied was for JB to be present during testing.

Did anyone else get that from reading the request?

Of course the defense will be getting the results when they are available.

I believe you are correct. He should have in his possession already - the results of the tests that have been done.

That was a decade ago! I would hope any problems were corrected by now! The advancement in technolgy, science etc. has improved since 1997!

Exactly.....and besides Orange County LE have not put all their eggs in one basket. There were other labs that also did testing. My guess, all the results came out the same.

GOOD..I didn't see that part I only saw the date at the top. Knowing them they will still try and use this article.

If I am not mistaken, the judge denied Baez request to "observe" and to preserve the testing during the motions hearing. This article sounds much more like he might have trouble getting to see the reports. In fact, the article doesn't make much sense at all now that I think about it. As I said I think Baez was denied his request to observe so I don't know why this article is saying the motion that was granted will not do him any good as the FBI might not let him into their labs.
 
The FBI won't likely allow Casey's defense team into its labs.

Baez is entitled to discovery... AFTER testing is complete.. is that correct?

Baez was granted the motion to look upon testing as it is taking place but not to interfere during testing, etc...

Looks to me like this is saying that he can't do that in the federal labs, Strickland has no jurisdiction on those.

Thursday Judge Stan Strickland denied one of the motions filed by Jose Baez last week.

Among the remaining motions, Baez wanted a judge to stop the state from any additional testing of forensic evidence. He feared that the evidence could be damaged or even ruined preventing his own experts from testing.

In the ruling, Strickland said basically that he would deny that part of Baez' motion because he saw no "authority or logic for stopping the state from doing additional analysis or testing."

However, the judge did grant Baez the second, less pivotal half, of his motion where he also asked the court to preserve all evidence and give him advance notice so his experts could be there for testing. Judge Strickland said Baez will get his advance notice and he and his experts can be there, but only to watch, not to interfere or do any testing at that time. The judge also stated that the state would take every effort to preserve a large amount of any evidence so the defense could do its own tests.

The judge's ruling is pivotal because Randy Means, Spokesperson with the State Attorney's Office, said the state did not present all forensic evidence to the grand jury. There is clearly more and will probably be additional tests.

This helps answer some questions. One thing I know about federal charges is when a perp gets convicted on federal charges, they get no bond and get no time out for good behavior. If they're sentenced to 30 years, they serve 30 years. Period.

Just makes me appreciate the work of the OCSO even more. They have done a fantastic job on this case. Leaving nothing to chance is key here for a conviction.

This may be why much of the testing was done at the Body Farm. There was mention of Caylee and in the article they stated that evidence is sent to more than one Lab to make sure the findings are correct.It is a very interesting read, just search Body Farm.I found the article on (UGH) maggots,blowflies etc. to be very informative.I spent a whole evening reading! I'll bet they're testing, double testing and even triple testing to prove their case.

It's going to be a much stronger case if more than one lab yields the same results. This will also stick a cork in JB's pie hole.

I don't think the FBI testing will be the one which puts the needle in her arm. I believe it will be all the results from the U.T. Body Farm. That is an anthropology lab also and if there were skull fragments like were first reported or even maggots, they will turn and burn any defense they put out. They have never been proved wrong in a case, and they do such extensive testing most times the defense just defers to their results and attacks other things.

They can tell what drugs were in Caylee's body from the maggots they found. They can get the full DNA (mother and father) from one hair which has a minute piece of scalp attached.

Folks, I believe the FBI labs are the least of KC's worries.
