After this is mitigation .. they deliberate on that too, then there's penalty which involves another deliberation ..

to get to DP they prove the crime meets aggravating factors, then they prove that there are no mitigators, then they prove that she is an oxygen thief .. at the last stage they can choose between LWOP or DP.
I believe the cruelty finding is what MAKES it DP. I don't think they can find DP unless they find it was especially cruel in THIS phase.

If the jury returns with the "go ahead", will mitigation phase begin immediately?

  • #2,203
I don't think he can- per rules of the courtroom- but I could be mistaken.

I think you are right....so heartbreaking to watch...
I picture Travis's spirit enveloping them all in a warm hug...reassuring them...giving them strength, even as they cry.....

Has he called her anything but ma'am during this whole trial?

Sent from my SGH-T989 using Tapatalk 2
Yes, he called her by her full name many times. That ended with Guilty.

I may be the only one thinking this but I think JA is truly upset today and not because of remorse, guilt or sympathy but because hearing the details of what she did EVEN she can tell it's very , very , very BAD and she's got no way out of it any more. All her lies and trickery did not work and now shes' cooked and she knows it. Time to pay the piper and she ain't likin' it !

The look on JW's face when Juan said, "Let's just sit for two minutes" priceless!

that 2 minutes of silence.....so heartbreaking

((((hugs)))))

Wow. Just as the barbaric gruesome stabbing of Travis was overkill, so too IMO is this portion of the trial. She has been found guilty of Murder one. I don't see that this serves any purpose. She is never again going to see the light of day. While I understand that there are crimes that cut us to the bone (in this case literally), I cannot see that having her die for this does any good. I am against the death penalty.

For everyone involved, this case has been an un-ending nightmare.
Be the verdict Death, or another alternative,
she has been deemed unworthy of mingling with humanity.
I can live with that.

Ah, how'd you break your duck???? Oh, and how was the duck keeping you from posting?

Sorry breaking my duck, probably a British thing. Means I am not on 0 anymore, I think actually it's a cricket thing, might be wrong. If you are out for a duck in cricket it means you are out without scoring any runs. So umm I'm rambling but I meant now I've 'scored' my first post :)

I have to leave at 2:15 (pdt) for a dentist appt. It's a short appt, will be back by 3:30. Wondering what my odds are to be here for the verdict. Wish I had a smart phone but, alas, only have a dumb phone.
I am usually not for the death penalty, but in this case I am solidly for it. This person needs to be somewhere else, not on this earth.

Darn job! Just saw the first couple of mins (before Horn testified).

Was lunch announced or are they just deliberating? I want to try to catch it when they come back.
TIA
They are deliberating. And they need to eat lunch, too. So probably at least an hour.

Over eating again...stress??

There will only be one more deliberation after the mitigation phase: life or death.

Well yes, this is the first gate to DP.

HLN replaying the 2 minutes of silence that was the time JA took to murder Travis.
"and now he had his throat slit ..."
I missed it live earlier ... VERY POWERFUL

This is not the sentencing phase. The jury is deciding whether of not it was "cruel", an aggravating factor.

Regarding the rest of your post: You are entitled to your opinion. I hope she gets DEATH!

  • #2,218
This phase is NOT sentencing. THIS phase is to determine if the aggravating factor was met. IF the jury says "yes" and it's unanimous, THEN the next phase will begin (the mitigating phase) in which JA's lawyers throw spaghetti against the wall and find people to plead for JA's life. It is only after that phase that the jury will deliberate the sentence: whether JA gets LWOP or the DP.

Thanks to everyone that answered my question about the court proceedings!

You are welcome... It was the least I could do for you!

I want her to get the death penalty but not be killed.
I just want her on death row so she can't socialize with her peeps.

Ya know what I mean?
