Class C Felony in Alabama:

(3) For a Class C felony, not more than 10 years or less than 1 year and 1 day and must be in accordance with subsection (b) of Section 15-18-8 unless sentencing is pursuant to Section 13A-5-9.

So she'll serve at least 1 year, possibly 10. And for what? She could be lying on a beach right now, benefits intact, enjoying a leisurely life. Instead she has lost everything and is on the run with a dangerous criminal, wanted by the USMS, FBI, ATF, and the Secret Service. All for a man? And a violently criminal man at that. Egads.

Alabama Code Title 13A. Criminal Code § 13A-5-6 | FindLaw

Joyce Mitchell, whose case some of you might remember, got 5 years.

My guess is they remained in contact after he was sent back to the prison in Oct 2020, plotting this escape that entire time. They need to look at his communication/visitor records at William E. Donaldson Correctional Facility going back to his arrival there in Apr 2019. I would not be surprised to see her on his visitor or call list. jmo

They may have met in 2020 but it would be very surprising if she were on his visitor list. She would have been putting her job in jeopardy by being on a visitor or a call list. If they did correspond then she probably used a different name and a PO Box.

I'm suspicious of this whole investigation. Lots of people dream of cashing out retirement, selling their home and chilling out on the beach. Often, family responsibilities stop people from actually doing that but VW was single and free to roam if that's what she wanted to do. If someone else "paved the way" for the escape, VW could be the scapegoat. It does look like she was complicit but I'm not convinced we know the whole story. MOO

They don't have many options. Carjacking and or taking over someone's RV and or camper would be options if it were me. He is huge, and hard to hide that. I would put all campgrounds on high alert as the weather is good and he has attacked and killed before. Someone could be missing and carjacked already and we don't know. It would be easy to enter a campground at night and kill owners and take their ride and belongings.
Good post it is what I was thinking. They had a 6 hour advantage before being reported missing I think they camped out somewhere or an abandoned cabin.

Here's my question: If Friday was to be her last day, given that she was a long-time, much-respected CO in a position of some authority- why was there no retirement celebration planned? Even if not a party per se- something marking the occasion? I find that really odd. Not relevant perhaps, but odd just the same.

Wow. If a prison tailor got 5 years I imagine the Assistant Director is going to get a lot more. It's one thing if a tailor or laundry worker assists in a jail break but an entirely different matter when the warden does it. And all Mitchell did was smuggle them tools. She wasn't even involved in the actual breaking out part or helping them afterwards. VW is in some serious trouble if convicted of this. jmo

I was thinking of the lack of visitors and possibly some staff working from home because of COVID. Some cases were delayed, maybe there were less prisoners than normal there. ETA: So, the jail may have been unusual empty in 2020 and she had more of an opportunity to get to know him.

If he had previously tried to escape that may have earned him a segregated cell, and more opportunities for her to visit him.

Two questions:

MONEY
Would not attending an exit interview really hold up her retirement money from being released? My opinion is no. Accessing that money could be an issue but what if she used an online bank?

BEACH
What beach had she mentioned retiring to? Any plans in place or at least looking at property? Of course, I realize that would be too obvious a place to hide but I am curious.

I hope these two are found before anyone else gets hurt. Thanks to anyone who has info or feedback re: my questions.

I was thinking something similar. Maybe she used the alleged health issues, that they now think are fake, to retire with little notice. She may have announced her retirement the day before they fled when she turned in the papers for all we know.

Also, I guess we don’t really know if they had planned to have a retirement party or if they even already had one, right?

There is no law or rule that forbids LE from visiting or calling friends or relatives in prison. They are free to visit just as civilians are. If she was visiting him at Donaldson she should have disclosed that once he showed up at Lauderdale though.

There might have been a way to collect on retirement even if she missed a personnel meeting if she had not become the focus of a federal crime. Now, it wouldn’t matter if she had online accounts or not. Police would subpoena all that account info and be watching. And as some have posted, her criminal actions will prohibit her from collecting it — at least once she’s found guilty. My opinion.:)

I worked for a Federal Agency that occasionally required interviews of inmates. A female co-worker of mine had the job at a local prison. She was middle aged, overweight and nobody’s idea of attractive. Still, virtually every inmate she felt with flirted with her, told her she was beautiful and basically tried to get her to fall in love with them. She assumed it was in hopes that she would do stuff for them, put money in their commissary account, perhaps smuggle in drugs or cell phones or even help them escape. She also told me that she really enjoyed it and, although some were “real convincing”, she wasn’t tempted. She thought it might be a bad idea to have women do that job. If she were having trouble in her marriage or was other unfulfilled in her life, she could see how easy it would be to be seduced into doing something “real stupid”.

We don’t know the whole story in this case, but it has all the earmarks of Vicky White doing something “really stupid”. The fact that this happened on the very last day before her retirement makes me wonder if it was all planned out so that even if things went south and she ended up doing prison time for aiding an escape, she will be able to keep her pension.

Unless he's in a wheelchair...
OHHH good point. What a great way to avoid detection and she could be using her ex-husband documents for him.

Does anyone know if the radios COs use are the same as LE on duty would use? For example, could the jail use one channel for jail communication, but change the channel to listen to on duty dispatches and calls? And if so, would a CO's radio be able to access secure/scrambled channels? Are they trackable?

There is no retirement money at this point. She submitted a retirement request on Thursday but it's still sitting at the jail. It's not even in the system yet. It's in the press conference somewhere. jmo

Personally I think they are hiding out somewhere remote. At this point. If someone is killed while they are on the run her retirement days may just be 3 hots and a cot. If she lives thru this that is.

All my life I've been taught that when you are an adult, your signature is the most valuable thing you own. Nothing is legal without it. When I put my retirement papers in, I still had to go from office to office to sign different documents in person. Perhaps she was able to sign online, but if she didn't follow through with signing her documents IMO she would not receive her pension. And as of now, where would the checks be delivered? Her bank activity will be traced and she certainly can't have an address to which it would be mailed.

Here's my question: If Friday was to be her last day, given that she was a long-time, much-respected CO in a position of some authority- why was there no retirement celebration planned? Even if not a party per se- something marking the occasion? I find that really odd. Not relevant perhaps, but odd just the same.

I had been wondering that, too. No party after a lifetime working there? That's how her last day should have been spent, in a merry company with her colleagues, instead of breaking bad. ( bad joke--- maybe she's related to Walter White).

Yes. What convinces me that it was very voluntary is she wasn’t married. No kids, right? She had her mom. She’s sort of an average lady. 56 years old. I think she was lonely. A guy showed her attention. She fell for it. It’s strange to me how that happens to a professional with that many years experience.

But desperation can drive a person to do things they wouldn’t normally do.

Possible, but then again, I'm 68, single, no kids, and don't have either of my parents. No way would I fall for a convicted killer, help him escape throwing away a pension I worked 25 years to get.

I think so, too. Hiding and not moving around at the moment. They may well have immediately gone to ground within a few miles of the jail. Chances are high that whatever getaway vehicle VW secured (rental, used car from a lot, borrowed, stolen) is going to be ferreted out during the investigation. You wouldn't want to continue moving around in it for more than a couple of hours.

VW had to assume she'd be missed by about noon-time when she didn't return from the doctor and hadn't reported in. It's only because of the incompetence of the jail that she wasn't missed until 3:30. So to her, she only had about a 2 hour head start, max. And my guess is CW and VW are holed up somewhere within about an hour's distance from the jail. jmo

ETA: Assuming they don't have additional conspirators. If one or more other people are involved it would open additional avenues.
