‘You can’t have a worse crime than this’: Legally what happens next in Kamille McKinney’s murder case?
[...]

While Carr and his team work to make their case, Stallworth and Brown are being held without bond.

At least one defense attorney thinks it’s possible they are being kept out of the general population. “A three-year-old, you can’t have a worse crime than this,” said Attorney Roger Appell.

[...]

While he’s not directly involved in this case, Appell has handled several other capital murder defenses in the past. He thinks a plea bargain is unlikely.

"This one is going to be very, very difficult to settle because of the high visibility of this. And we’re talking about a three-year-old child. This case absolutely makes no sense,” said Appell.

Public sentiment certainly doesn’t appear to be in favor of a deal. By Monday afternoon, an online petition calling for “no plea deal” and the “maximum punishment,” had already been signed thousands of times.

If they don’t make a plea (for LWOP), the family will have to go through a very traumatizing trial. What does the family hope will happen? Has “the public” asked them before they made this petition? As much as these 2 deserve the death penalty, my thoughts are for the family. They deserve to grieve in peace. I hope that whatever happens, Cupcake’s family are protected....somehow. MOO

Well, naive or not, someone has to work we willdefend these people to ensure there is a fair trial so that justice can been served.

It doesn't necessarily mean that defense lawyers are inhumane.

Without them there would be no justice.

Imo[/QUOTe
Watch the defense state that the perpetrators won't get a fair trial in Birmingham due to the publicity of the search and funeral of "Cupcake".
I don't think they can it a fair trail in the state..

I’m in NJ and cupcake barely made the news here. They did report when her body was found but it was about 30 seconds and they moved on quickly.

Dulce isn’t even in the news here and I’m 30 minutes from where she was kidnapped.

I follow Kelsi German (Libby's sister) and she tweeted the other day that she was shocked to find out that there were people in Indiana that knew nothing about the murders of Abby and Libby.

I was surprised as well. You would think that the murder of two young girls who where BFF's would be front page news all across Indiana. How could anyone not know? The details are also incredible. Video and voice of the killer. Unreal, but they don't.

It's always surprising to me as well what catches the attention of people and what doesn't. Who knows.
Do some people live under a rock. I live in Georgia and I herd about this case.It was all over the nightly news

I'm with you. It may not be a popular opinion anywhere but it's how I feel. Putting Cupcake's family through a trial will be going through it all over again. Detail by detail.

Well, we don't know yet if there is going to be a trial but there are lots of high profile cases that are tried and there are things they can do to ensure that it is fair. They can file for a change of venue, they can seal documents and they can issue gag orders.
The case has been highly publicized up to this point but that doesn't mean it will continue or that LE will give the public all the information about the case.
It will probably be a long time until the trial, and we don't know what evidence they have or the details of the crime.

Imo

I think the decision will have to be made by the family. My neighbor, who's son was murdered does not want a plea deal. I feel in KM case it would save her family a lot of extra grief

All I am hoping for is prison justice. I know that sounds ruff, but in this city justice is few and far between. I hope they can it a conviction, let the people in prison do the rest. People in prison maybe bad people, bit they do not put up with child murders.

Do they have judge-only trials in the US? Sometimes we have them here - every once in a while. No jury, just the judge hearing all the evidence and making the final determination.

Plenty enough defense lawyers here ask for a judge-only trial for their client - because a judge will make a decision according to the letter of the law, and with less emotion. Very few people are granted a judge-only trial though.

Everybody thinks their client won't get a 'fair trial' in a highly publicized crime.

If the defendent request a judge only trail, they can get it. Most in this city don't. <modsnip: If you can't discuss it, don't mention it.> Very few convictions for the amount of murders here,

Female Sex Offenders

- Most studies show that at least 90% of child sexual abuse is committed by men.

- Who are the 10% female sex offenders? Based on Dr. Anna C. Salter, forensic psychologist, there are 3 categories.

1. The “incest abuser” who molests her own children from a very early age, starting before the child reaches age 6 and sometimes continue until the child reaches his or her teens. These women are immature, isolated, and without adult partners, and have psychotic personality defects in which they do not view themselves as separate from their children. Salter terms this as “fusion” and is a psychological distortion in which mother cannot detach their children as separate entities after birth. Thus, the molestation is “masturbatory” rather than “molestation”, as the child is a physical extension of the mother, more like an arm or a leg, rather than a sentient and separate human being.

2. The “teacher/lover” – Female teacher targeting student.

3. The “psychologically battered” abusers are submissive and timid; they still seek dominant male partners to control every aspect of their lives. These women may be so submissive that if combined with a dominant pedophile partner, they will acquiesce to participating in or allowing the sexual abuse of their children by the male partner. The form of female sex offender may even molest her children for the pleasure and benefit of her dominant male partners, even doing so when the male partner is not physically present.

Hmm... not sure if anything here fits D...

Resource: Lynch, V. & Duval, J. Forensic Nursing Science – Second Edition.

Good morning all! Took a much needed break from little Cupcake's thread.

Now to comment on this link, and give only my personally held opinions.

To me it shows far more excuses are made for female sex predators than men who sexually prey on innocent underage victims. Which isn't surprising because mental health professionals have long given female murderers a plethora of excuses when they cold bloodily murder their own children or any other victim for that matter.

It also shows sex predators, no matter their gender simply can't be put in statistical box.

Imo, from researching for decades now about both offenders their motives for doing so are similiar instead of different.

We really have no clue how many pedophile offenders are women.

Often their targeted prey are young males which are the least likely gender to ever report being sexually assaulted by female predators. Through the years I've read cases where the boy victims were sexually molested or raped by their own mothers starting at a very tender age of 5 or 6. There are several blog sites now started by adult men who were sexually traumatized victims by their mom or another trusted female family member. I hope more sites will be done now to give other male victims a chance to have a voice to express what happened to all of them.

Imo, the reason why they remain silent when dealing with the trauma themselves is because society overall has sent a strong message to all abused boys they are to feel lucky, when they are raped by a female pedophile.

Sexually abused boy victims are 10 times more likely in trying to commit suicide than abused females. Why? Imo, it's obvious. Instead of feeling lucky like they are told to feel they are just as deeply traumatized as females.

Also females who suffer sexual abuse by either gender have support groups, even close female friends. However the abused boys have no one who wants to even listen, much less understand, including close guy friends who've never been raped.

Imo, it is one of the reasons we are losing over 25K adult males every single year in our country.

I know how traumatizing it is to hold all of the dark secrets inside of a sexual abuser telling no one. I didn't tell a soul until I was 38 years old, what had happened to me. It started at the age 2 for being physically abused, and the sex abuse started when I was 5 until I turned 16. Thank God my baby brother was born after mebeing the only child before then in my house of horrors, and isolation.

I knew then I had a true purpose in life rather than being only there to be abused, physically, emotionally, and sexually. I knew then I was there to be the protector of my brother, and my parents had another beautiful son 10 months after my other precious brother was born.

Imo, more sexually abused boys will die by suicide, when they are young or when they become adult men from the sexual trauma, because they felt society never cared about their own pain, and suffering because they happened to be male victims.

I think I heard next court date is the november 4th, is this correct? I hope this goes smoothly. In so many cases with children it turns into a mess.

Yes, they are both due to appear in court at 9 a.m. on the 4th and DB's kidnapping trial - her own children - is also scheduled for November. MOO
