This is the latest I can find on the story:

http://www.alabamas13.com/story/230...pastor-held-after-questioning-in-wifes-murder
From the article:

It goes on further state that he will have to be released before or when his 48 hours are up. The news source (channel 13) will have updates as soon as information is confirmed.

We should hear something soon.

Does anyone here recall the technical time he walked in for interview?

of course... Now that I think about it...

LE may have not started the "48 Hour Clock" until the end of the interview...

and I don't think that time was announced... Was it...

I don't think it was ever reported what time he went in on Wednesday or what time the hold began. I do remember that the news was not published until Thursday morning that he had been being held since Wednesday so I assume it might have been the end of the day on Wednesday that they began the hold. We may not hear anything until tomorrow morning or later this evening. Every so often I'm checking local news sites.

Kahne, I honestly cannot tell you how much my heart is going out to you right now in thinking about just what a very real impact that this is already having on you, especially in regards to your children.. I know you shared with us about Richard having lead your son to the Lord and the amount of care, respect, and honor your son has for this man is very much on my mind and heart in thinking of how we, as adults cope with the possibilities that now may lie ahead..but even greater is my thinking about how children are faced with coping and dealing with the knowledge of someone that they had such respect and admiration for, that played such a significant role in their young lives..kahne, I truly believe that no matter what difficult truths may be lying ahead in regards to this horrific tragedy, I truly believe that you have the strength within yourself(through the Lord) that will allow you(and therefor your children) to handle, cope, and deal with whatever lies ahead..its definitely a time that you all should not be hesitant to lean on each other(members of the church and community) and draw upon each others strengths and comforts in taking whatever comes just one day at a time..

My words fail to adequately describe how my heart is going out to you and your community during such a time of uncertainty.. Just know there are so many who care, including us, here at Websleuths that are here for you as well..Again my continued prayers for you all:hug:

:heartbeat:
Jessica

Once again, I want to thank you SmoothOperator for your kind words. Reading your post seemed to take away some of the pain that has surrounded me for the last 2 weeks, I actually put it out of my mind long enough to go play putt putt with my family. Even though this is "supposed" to be our vacation....I haven't really wanted to even leave our condo, but after reading your post.... It made me see that spending my time worrying and not spending time with my family, is pretty much saying that God doesn't know what he's doing and that he doesn't know how all of this will end. He has everything under control. Doubting God is the LAST thing I need to do in times like these...Thanks again

Elley Mae,

If I now understand your posts 321 & 336, your question is whether a church owning homes and receiving rental income from them is required to pay Unrelated Business Income Tax on that income.

I’ll borrow a phrase we so often hear from the attorneys: It depends
(and I won't hazard anything further).

At p. 17 of the linked IRS publication:
“Whether an income-producing activity is an unrelated
trade or business activity depends on all the facts
and circumstances
. For more information, see IRS
Publication 598, Tax on Unrelated Business Income of
Exempt Organizations
BBM

If this is not your question, maybe we should move to The Jury Room where this discussion won’t derail the thread about Ms Shahan. :seeya:

Just watched the local news ABC 33/40 and they reported that the HPD will have to make a decision between 5 and 6 pm today as to whether they will continue to hold Shahan or release him this evening.

They said the DA will have to be involved in the decision if the HPD wants to keep him in jail past the 48 hour window which ends today.

That's pretty much all that was reported at 5:00.

Just wanted to add that the newscast was live from the Homewood Police Station so this particular station seems to be staying on top of the story. They also have a 6:00 newscast. Will watch that as well. If anyone who's not local wants to watch at 6, the site is abc3340.com

I hope this does not turn out to be a Matt/Kari Baker thing. I hope Karen Shahan has some advocates for her, if need be.

If he's still a person of interest, he'll be kept under surveillance and could be called in again for questioning.

Something was iffy with his story, in LE's eyes, or he would not have been held for 48 hours in the first place.

Not saying he did this, but to both label him a person of interest, then hold him for two days - something didn't add up.

Since Mr. Shahan is in jail does that mean he was arrested? Is the waiting period for the prosecutor to make a charge decision? I cannot understand this.

From: Find Law

Note: The required time in which a prosecutor must make a charge decision varies from jurisdiction to jurisdiction. While many state laws require the decision to be made within 72 hours, other states, such as California, require that the decision be made within 48 hours after you are taken into custody.

http://criminal.findlaw.com/criminal-procedure/chronology-the-arrest-process.html

I think technically yes, he was arrested..refer to quote below..
The 48 hour rule for city police departments nationwide states that a probable cause determination must be made within two days of a warrantless "arrest". http://www.abc3340.com/story/230975...-hours-of-questioning-related-to-wifes-murder

I suspect that they believe that they know what happened and were hoping to be able to get more evidence before they had to release him. He talked to them, they had his story and they probably didn't want him to share that story with media or anyone else before they got a chance to see if it fits with other evidence or statements.

They didn't clear him, so they must be still confirming things or working on getting more evidence to either clear him or charge him. Sometimes they have enough to arrest and charge someone but choose to wait, maybe to see if the suspect does something incriminating or just for more evidence to strengthen their case.

Well does a warrantless arrest open him up for sleuthing?

A warrant or not shouldn't make a difference. To have an arrest you just need probable cause. If the person is right there, the cop arrests him. Most arrests don't have warrants. The warrant comes in when the suspect is not in custody and someone has to go pick him up or BOLO.

My understanding is that you can discuss everything that has been released so far as fact. There are any number of reasons why LE decided to hold him. It's possible they had a lead concerning the husband and it just hit a dead end so they had to release him. Or the DA decided it just was not enough.

I will check on this.

Homewood pastor released from city jail without being charged; no one ruled out as suspect, authorities said.

"HOMEWOOD, Alabama - The Rev. Richard Shahan, an associate pastor at First Baptist Church of Birmingham, was released from jail this evening without being charged with any crime, Homewood police said."

"Shahan, 53, was held for "investigative purposes" at the Homewood jail since Wednesday in connection with his wife's slaying. He has not been charged with any crime in connection with his wife's death."

"Atkinson said no one has been ruled out as a suspect, and the investigation is continuing."

NEVERMIND - I now see I.B.Nora's post above that they released him with no charges. Hmmm.................

Did they charge him? I'm not seeing that yet? But his 72 hours is up, right? That's about 3 days so he should have either been released or charged. What has happened?

Okay he wasn't charged and he was held for "investigative purposes." LE is telling us, per the article, that he is not cleared as a suspect even though he was away visiting one of his children.

So... all sleuthing needs to remain very closely related to what we know from MSM. We are not going to open the door wide on him until I check with Management and get some feedback from other Admin.

Stick to MSM and LE reports. That info is sleuthable and discussable but make sure it is all linked up, okay?

Thanks!

Salem
