How sad. I feel so sorry for her poor mother who thought she was spending the night with a girlfriend that night. I truly feel that the men who fired the shots should be charged, they alone decided to become judge, jury, and executioner for property theft, of property that was not even their own.. I am a gun proponent and I believe in protecting your LIFE, these men were not in fear for their lives, they heard this break-in from another camp, came over to investigate, chased the teens into the woods and fired on them... When we as a society believe it is okay to kill someone that we think is committing a crime, then things need to change. People in this very forum that are commenting that they think this is okay leave me SMH in saddness and fear for our future.

Yes, people need to realize that it's not ok to chase down and shoot even ACTUAL burglars.

However, there may be details of this story that we haven't heard that mitigate the shooting. IDK

MOBILE, Alabama -- Social media reports indicate that Summer Moody, the teen injured in the Gravine Island shooting, died late Wednesday. She was 17.

Obviously this was expected, but I must admit I had a small hope that we might have another Josie Ratley type miracle recovery. RIP Summer.

We spent her last hours with her talking to her, singing and listening to hymns, contemporary Christian songs and old childhood songs like Skidamarink a dink a dink. I am so proud of my little sister, Brooke, for talking Summer through her last few minutes. Thank you for all the thoughts, prayers, food, drinks, support, etc that everyone has given. Just now reading about this story and I am speechless. Nobody did the right thing here, from 3 boys who were committing burglary to the man (or was in MEN) who fired shots! Now a young girl is dead and her family, friends and loved ones are all left to grieve. So tragic all the way around. I usually am all for people protecting their property, but it seems these kids were well off the property and running away when the shot that fatally wounded Summer was fired. I do feel the boys should be charged for robbery, but I also feel the man who fired the shots should also face charges.

Okay, now I'm just hopping mad. When you use a firearm while someone is running away, and you are not LE, you are committing a crime, period. There are no laws allowing for taking potshots at someone's back as they flee!

I'm a huge gun-rights advocate, and that includes the responsible use of said firearms. This is the type of abuse of self-defense laws that leads to unhealthy restrictions of gun rights.

As far as I see it, this is a 'tragic accident' like a drunk driver killing someone is a 'tragic accident'. A potentially lethal tool was abused in a thoughtless, reckless manner, someone died because of it...and that IMO is murder.

In one of the earlier articles the lawyer for one of the shooters mentioned that his client feels threatened. Good. That's infinitely better than what Summer's loved ones are going through right now.

I dearly hope that the family is able to go over this Sheriff & DA's heads, or can at least strip these 'men' of everything they own in civil court.

Sorry about the rant, I'm just steaming right now.

So the boys will then be charged with illegal possession of a weapon (as they should) and the shooters will be investigated due to past felonies and the likelihood they were unable to carry guns under conditions of said felonies?

I really don't think they meant to "kill" that girl. I think they meant to shoot. Making it NOT an accidental shooting.

Has there been confirmation how many "warning shots" were fired? I read that 2 men fired their rifles, but I want to know how many times each shot.

Why isn't it considered reckless conduct? Since when its just fine and dandy to shoot your gun in the dark where you can not see if anyone is in the area? I just don't get it. What do the gun safety experts say? Don't point your gun or shoot it unless you can see your target.

"It's possible charges against Byrd, Parnell and Tyree could be upgraded now that Summer has died. But Byrd's attorney, Clark Stankoski, says he doesn't think the felony murder statue applies. Under that statue, suspects can be charged with murder when someone dies during the commission of a felony."

There are an awfully large number of 'it is believed' statements from that presser. Sounds to me like their 'reconstruction' was based primarily off of statements from the three men.

I have yet to see any indication from anyone in LE or the lawyers that the two yahoo friends (who I believe should have the book thrown at them) fired any shots of their own or threatened the men - just that they were seen to be armed. That makes the firing of multiple warning shots in any direction questionable at best, IMO. It would have been a different matter if this had taken place indoors, and the men had already been there, but in this case, the men initiated contact, and initiated gunplay (and from all statements were likely the only participants in it). They are culpable in this, IMO.

Such sad news to read about.

This is the first I've been able to get on the computer today and to read that Summer had died was sad enough. I guess I'm not too shocked but I had hope for a miraculous recovery. Rest in peace, Summer and prays for your family and friends.

To make matters worse, now I'm reading all of this spin on the "warning"/"accidental" shots. No charges filed against the shooters? I don't understand why not. I will NEVER understand why not.

To me, no ones life is worth any of my earthly possessions, only my loved ones that can't be replaced. I would only shoot to protect them. These shooters weren't even trying to protect their OWN possessions, but the possessions of a neighbor.

A 17 year old girl is gone forever and a family left to grieve.

"The bottom line no matter what we say as to what happened a 17 year old girl lost her life and because of that is warrants a thorough investigation," said Sheriff Huey Mack Jr.

Investigators say Moody was kneeling behind a palmetto bush when she was shot. It's believed the fishermen fired two warning shots in her direction not knowing she was there.

The sheriff says a bullet was recovered as part of Moody's autopsy Thursday. The bullet will be compared to weapons used by the fishermen and to a .22 caliber rifle belonging to one of two of the teenage boys who were with Moody. The Sheriff says a .32 caliber handgun belonging to one of the boys has not been recoverd despite a search of the area which included divers searching Thursday.

Okay, so Felony Murder charges are to be leveled against anyone involved in a felony that results in a death...so, isn't a felon possessing/firing a firearm a felony? Or are we just supposed to ignore that particular 800 pound gorilla? Just like we're supposed to ignore the definition of a 'warning shot', or the explicitly defined limitations on allowable actions under 'stand your ground' laws?:banghead:
