Attorney for one of the teenagers says his client disputes the official story. He says his client was willing to tell his side of the story but authorities were not interested.

"Donald D. “Wayne” Doerr Jr., who represents Daniel Parnell, said his client described a sequence of events that radically contradicts the version offered by law enforcement authorities when they announced Thursday that they would not file charges against any of the 3 men who had come from a neighboring camp on Gravine Island to investigate noises in the wee hours of April 15."

And is it a felony for a felon to possess (or shoot) a firearm? So despite any "shoot first" law, they seem to have a contradicting law in this case.


But because the TEENAGERS are root of all evil, they will ignore the law for the shooters and put it into action for the vandals (because it seems they did not take property)

Hmmmmm. Yep. Burglary (I mean vandalism) is a much bigger issue than a felon shooting off a gun in the middle of the night.

R.I.P. Summer!

I was so hoping you would pull through, but you're in a better place now. Hope that you and Trayvon become good friends and watch out for all our littlest angels. Although there are some differences (she may have been commiting a crime) you both died in much the same way (overzealous men with guns) and I pray that you also get a proper investigation into your death. No matter what, even if you had taken part in criminal activity, it was nothing to die over and I am sad it ended this way.

My prayers are with Summer's family and friends.

Yep, just as I thought...

If this DA tries to go for Felony Murder charges, this half-a**ed 'investigation' is going bite her in the butt. Heck, even the burglary charges might be a long shot if she can't get them to plea out (and it looks like they are way too PO'd to do that).

Once again I hope that the family is able to go over the local heads on this, because the whole thing smells like the all too typical case of LE making an assumption at the start and tailoring their investigation to suit it (much like what happens so often with missing teens who are declared runaways for no good reason).

Hundreds gathered to say goodbye to Summer Moody. On April 15th- Moody was shot in the head on Gravine Island- the 17-year old Baldwin County High School graduate died 10 days later after her parents made the tough decision to take her off life support.

Moody's pastor told News 5 the eulogy was simple, yet beautiful, a celebration of her life.

Moody was laid to rest next to her grandfather at a cemetery in Ward, Alabama, near Meridian, Mississippi.

The teens that were with Moody the night she was shot will be in court Thursday. Scott Byrd, Daniel Parnell and Dylan Tyree are charged with burglary. A grand jury could charge the teens with Moody's death.

BAY MINETTE, Alabama -- An investigator testifying this afternoon in a preliminary hearing in the Summer Moody case said one of the teenagers with Moody said she was an active participant in the burglaries.

Earlier in the day, an investigator testified that Larry Dean Duncan Jr. said he fired a shot from above hip level in the general area where Summer Moody was likely hiding. Moody was struck in the head by a bullet on the night of the alleged burglary and later died from the injury.

During this afternoon's testimony, the investigator testifying said it was his belief that it was highly probably that Duncan fired the shot that hit Moody. The investigator said Duncan told officers he shot in the air.

Dixon said that incident yielded an additional first degree burglary charge for Tyree and Byrd and they face another 20 counts of burglary III. Dixon said officers served a search warrant on Tyree's home two weeks before the shooting on Gravine Island. Officers serving the warrant recovered several items stolen in recent burglaries, she said, and one officer told Tyree, "you've got to quit this or someone's going to get killed." Officials said Parnell, who remains in the Baldwin County Jail, could also face additional charges as the burglary investigation continues.

MOBILE, Ala. (WALA) - Authorities arrested Scott Byrd and Dillon Tyree while they were in court for a preliminary hearing Thursday. Officials said it was in connection to a burglary ring. Twenty warrants were served on each teen for burglary charges.

Baldwin County DA Hallie Dixon said Tyree and Byrd were part of a ring that burglarized residences throughout Baldwin County.

The twenty warrants also included assault charges.

Tyree and Byrd were arrested in the courthouse for their connection to the burglary ring.

Dixon said Daniel Parnell was not involved with the burglary ring and will not face the additional charges.

Judge Jody Bishop will consider a reduced bond for Parnell.


After DA Dixon announced the 20 additional warrants that were issued for Byrd and Tyree, they were handcuffed and taken away.

Dixon said afterwards, "(Tyree and Byrd) participated in armed burglaries and violent assaults in the past, and it’s just a horrible tragic conclusion."

Family members for the defendants were not willing to speak to reporters.

The case has now been bound over to a grand jury.

Wow. Just wow. There are still a lot of questions I have. One, was summer actively participating in burglaries just that evening or on multiple occasions? Two, what does actively participating mean? Three, the coroner said the gunshot was to the side of the head at a down ward angle. Was she far enough away that the bullet was coming down from above the bush line or was she close enough that his shot was at angled below level and it hit her as going down? Four, I only know 'deals' with witnesses from tv but is it suspect that the only one who couldn't make bail is the one who described what happened and is now getting a possible lessor sentence?
I feel horrible for summer's family. If she was participating, if she wasn't participating and was just used to get a lessor sentence, it must hurt her parents deeply.

Tonight on the news (channel 5 www.WKRG.com ) the Baldwin Co. D.A. said for the first time that yes, Summer Moody was involved with the burglaries that night. It wasn't made clear if she had been involved with ones in the town of Loxley with her boyfriend. D.A. also stated that there would be no charges against the man who fired the shot that killed Summer.

Okay, so if they caught these idiot boys red-handed two weeks earlier - why weren't they in jail awaiting trial? How many times do people have to die before LE & DAs stop dropping the ball on the so-called 'petty crimes'?

That said, making sure to make the arrests right when the DA knew there would be maximum media presence...seems like a (seemingly successful) diversion from certain key (and for the DA, inconvenient) facts that have now come to light regarding the shooting itself...burglary ring or not, Summer was murdered, IMO.

Poor Summer - regardless of whether she was actively involved that night, it seems to me she got caught between two sets of criminals, and payed the ultimate price for it.

Why does one shoot a firearm horizontally into woods that you know to be occupied? With the intention of that bullet hitting someone, IMO. Can't think of any other reason.

And if Summer really was an 'active participant' that had run to her hiding spot after initial contact (as per some of the testimony), then it seems increasingly likely that the shooter knew she was there and aimed deliberately (which seems more likely than hitting her in the manner described by the Coroner through freak, random chance).

Something smells rotten. In these types of incidents, if there are contradictions between statements & evidence, the DA is supposed to leave it up to a jury to decide whether a shooting was justified or murder. The swift decision to stand firm on no charges, coupled with the lack of charges for the felons using firearms & their history with drugs, leads me to wonder if one (or more) of these guys has acted as an informant for LE & is now being protected. Wouldn't be the first time that's happened.
