‘Rust’ Assistant Director Dave Halls Countersues Alec Baldwin

Halls blames the actor and other crewmembers, arguing that their negligence led to the fatal shooting.

Halls countersued Alec Baldwin and other crewmembers, arguing that it was their “active and primary negligence” that caused the incident. The suit comes on the heels of another countersuit filed by Baldwin in November blaming Halls, armorer Hannah Gutierrez-Reed, prop master Sarah Zachry and ammunition supplier Seth Kenney for the shooting that killed cinematographer Halyna Hutchins

Only Baldwin still faces claims of assault, intentional infliction of emotional distress and negligence.

As far as we know (big disclaimer) the live rounds were quarter or half charge, hand loaded training rounds identical to those made by an associate of the supplier of dummy rounds to the film. They were made to train actors on an earlier, unrelated film and leftovers were passed around in the local community of prop weapons suppliers. By a process no one has publicly explained, it appears that some of those training rounds got mixed in with the dummy rounds and nobody caught it.

To my knowledge no one has asserted that any of the live rounds were full charge factory ammunition or has put forth an alternate explanation of who produced them.

Baldwin has maintained that he did not pull the trigger of the gun — once during a primetime interview shortly following the deadly shooting and again on a podcast episode. The actor originally said he had pulled the hammer of the gun back as far as he could and released it, but did not pull the trigger.

The LATimes article contains a major error (there were not "dozens" of live rounds, but five) and the Vanity Fair article does not cover the condition of the firearm, which broke when tested.

Possibly to help the actor fire convincingly on film? Firing a blank does not cause the "kick" of real ammunition. A half-load could be really useful for a person who hasn't handled firearms to demonstrate what happens when you fire a pistol. On set? No guess for that part. (imho A New Way To Spell Stupid -- ANWTSS)

I am an older woman, I used to fire a 9mm pistol with good accuracy but no longer have the muscle mass to control the recoil. Takes too long to return the pistol to firing position on the target and it's just too much physical work to fire standing. Probably should try kneeling or seated but I'm just not interested.

A .22 pistol, still good accuracy standing. I know how far the pistol will move & can get back on the target quickly.

I haven't used the .308 on the range.

Again, not in the movie industry, but taking an actor who has never fired to a range to be introduced to the firearm seems to be a good idea.

Haven't watched it in a while , but iirc the work on Tombstone and on Silverado is good. Sometimes on TV & movies we will laugh, because it's obvious that the actor has no idea how to use the firearm.

Or ride the horse, but that' a different story.

Issuing a "written statement" indicates to me no charges. Prosecutors generally love to be in person when they are charging someone in a high-profile case. IMO. JMO.

This highlights the test the FBI was unable to make because the weapon broke after they fired one round: If you pulled back the hammer of that particular weapon in its specific state of wear and tear and released it without pulling the trigger, would the mechanism of the weapon stop the hammer before it fell all the way down and fired the round? We will probably never know.
