Andrea Lyon turned and pointed across the courtroom at Ryan's 76-year-old wife, Lura Lynn Ryan, sitting on a spectators' bench holding an oxygen canister that helps her breathe. Lyon said Ryan's wife may have just months to live. Has AL recently obtained an MD?

"There is a place for human consideration," Lyon told the judge. "That's why a judge sits there and not a computer. a computer......like the ones purchased with KC defense funds????? Or were those different computers????

As Lyon spoke, others around Ryan's wife could be seen crying.


And..... this isn't even a death penalty case.
Note to the Anthony's....perhaps Andrea believes that toting an oxygen tank into court may help KC's case??? Perhaps......drop the gum and grab a tank of O2.

I dunno. Didn't work very well for Jackie Peterson.
 
Because I am a masochist, I will actually write this out loud:

AL's style in the courtroom is phenominal compared to the attorneys KC finds herself left with now. I listed to an old hearing yesterday and got to thinking about how learned AL seems, her professorial style, her ability to fold just about anything into precedent and legal applicability.
The guys KC has now are whiners and grandstanders. AL definately has the more mid-western, less southern showboat gentleman style as compared to CM, and obviously to make any comparisons between her and JB is dopey.
Don't know a lot yet about AnnF's style as far as arguing motions of substance or actually coaching the rest of the team towards some sort of strategy-For example (and LKB knew how to do this, she just didn't): AL brings a motion to strike the death penalty due to [prosecutorial] discrimination. AnnF and CM, where are these motions anymore? Tried and true, or outside the box, or progressive tactical maneuvers...CM doesn't even appear to know much about the case beyond TES, Ms. F doesn't seem to want to deal with the sentencing until it's actually here-No attempt by her to remove the DP as a possibility now, even through motions that many of us here would scoff at-Dontcha have to try them?

KC will miss AL more than she knows.

Now I must go vomit, because though I can admire her as an adversary, I stand completely against the foundation Ms. Lyon bases just about everything upon. I must refer you to my older posts in this thread if you want any further vitriol to cleanse your pallet. I'll let my "nice" comments above set my mood for today :)

The thing is, she always seemed to be making wild, desperate attempts. She folded things into precedent but they fell flat. She was trying to get Judge Strickland to overturn the death penalty in FL for heaven's sake. Sounds like something out of a Grisham novel. I don't admire that (not only because it is wildly inappropriate) because it came across as silly.

Then that confused wet towel of a "witness" she brought in to try to convince people that prosecutors are set on killing promiscuous women...I mean that was just absurd. I think her style would work if there were an activist judge looking for a way/argument to change law or precedent...but what was the end result of all of her outside the box thinking? Nothing. She took off when the money ran out and she was done promoting her book.

I do agree she speaks intelligently - but when I think of AL speaking to the judge I see a personal agenda - compare that to the taste of Jeff Ashton describing the probable duct taping of Caylee - they aren't even in the same league. Ashton is phenomenal and exudes common sense and passion. AL comes across as gimmicky, arrogant and condescending imo.

It is beyond the scope of this article to discuss the ethics of interaction with the media,5 but one thing is for certain—if the press is interested you must have a strategy for dealing with them. “No comment” is fine. Too often lawyers are seduced by the prospect of being on the news and speakabout their client’s case without thinking about it.

Certainly none of us would consider speaking to the jury before we were ready, before we investigated the facts, brain stormed the case with people we trust and developed a theory of the case.

A second thing we noticed right away was the length of the police reports. There were over sixty pages of them, a sure sign that this case didn’t “break” easily and that there were likely problemsin the case, at least from the prosecution perspective.


And then my personal favorite.........

you have to be sure to write down when you either saw the witness, or tried to, and who was
with you. This may become important later when you need to call a prover (the person you brought
with you to hear what the witness had to say -- just in case) if a witness changes their story, or if you
are accused of “intimidating” witnesses by showing up to interview them


is that when you do have a big case with hundreds
of witnesses you cannot anticipate every single witness who could be called, especially if the
prosecution is putting on fluff.
Kind of like JB whining that the State listed so many people as category A witnesses.

So....this evening I listened to a lecture that AL gave at the Kentucky Public Defender College. This speech was given at a conference back in 2008. Some interesting highlights worth noting..... AL says...and I quote....." My one and only negotiation tool is........****** you, let's pick a jury".

Additionally, she goes into great detail about voir dire and describes part of her strategy.....She knows that each potential juror will be asked what they think mitigation means. Then she obtains transcripts taken during voir dire....when questioning a juror she appeals to them on a personal level from info in their answers given during initial voir dire. She uses the transcripts to find a common ground. She gave an example of a woman she was questioning. She noted that the woman was wearing "sensible shoes", lived in a "racist neighborhood" (in her words...you know the kind where you have to fill out a questionairre to prove how racist you are before you can move in. haha) had a husband who was employed by so and so. BUT, she noted that when the woman got up, she had on a purple slip and she figured this woman must be a nut so she agreed to have her on the jury. According to AL, that woman caused a hung jury and her client got off.

AL also went into explicit detail about how to talk up the "bad photos" that the pros will present. Her advice is to make them seem far worse than they really are so that the jury will be disappointed that they were not as bad as they anticipated. She advises beginning this set up in voir dire and in opening.

Like them or not, Andrea and Linda KB are a huge, major loss to this team. Mrs. Finnell, through no fault of her own, has a lot to catch up on. Did we ever learn why Andrea's long time collegue Mrs. Barrett is effectively pushed aside, or if indeed that is the case? Did they name a new mitigation specialist? If yes, has she worked on Cheney's prior cases? My guess is YES!
 
Does she have any articles about boosting book sales by attaching ones' self to a high profile case? Or how to lie about expenses? (20k for computers and research?)

He's actually on a board for a charity?? I wouldn't stand for that for one second if I were involved with that charity. Unbelievable.
