I was very touched that the Morcombes are able to access Victims of Crime money so quickly. It will take a load off the Dickies.

I would think that anyone truly huffing at the Morecombes have not considered the immediate welfare of the girls MOO

Hi DUNNOZO. Could you expand on this please?

The Marcombes pledged to help the girls financially,

& I know how I feel after I get my hair done, I hope Allison felt that way.

I'm a bit lost here. There seems to be some animosity towards the fact that the Morcombe Foundation wants to help the girls? What's wrong with them wanting to help? Or am I misreading some of the earlier posts?

I find it hard to believe when football show started will hold any weight in evidence against him. There are too many excuses he can give. They might want the programming schedule for other reasons too. Please don't let the next 10 threads be on when the footy show started (yawn)

... or about attending our children's school events ... :)

Yes I 100% know what you are referring to. I've wanted to refer to it many times. What are the odds.....

WHAT? :dunno:

The media does not have all the correct facts at times. We have seen discrepancies over the last few days with dates misprinted etc. The police are interested in the 18th to the 21st as being significant to the crime. I can't provide a link, I'm sorry. Workplace confidentiality.

Yeah, I was just trying to figure that out too. Am I misreading it?

What wonderful people, after all they have been through to now focusing on others who are suffering. They deserve our praise and thanks.

Ok.. people were questioning the relevance of police wanting to know the TV schedules for the 18/19th. It is relevant obviously to the case. Some wondered could Allison have been killed earlier.. I don't think that is so because of Hair appt amongst other things. The cross country was on Thurs morn I believe and people were wondering of the relevance of Allison not attending. Other posters were offering their opinion on this. I believe people are entitled to have an opinion, skipping a post if you find it irrelevant sometimes helps. (The other thing was whether the Footy Show comes into relevance with the dates they mentioned.)

very true..and thats sad. I know many mothers would do their best to attend. But there may always be the odd occasion where they can't. So yes Allison may have normally attended, maybe she would have done everything in her power to, for this time maybe she could not. Maybe it was decided GBC would because Allison couldn't. But maybe ther is another reason..although as stated it appears she was seen later that day.

Perhaps they couldn"t bear to together (GBC and ABC)

Before I try and answer for you, bear in mind that most of my knowledge comes from studying law (and I still have 18 months to go!). There is a world of difference between theoretical and practical knowledge so if you take my answers in that light then we should be ok! So here goes:

If someone has given a statement to police or made a stat dec/affidavit then they are given a copy of it upon completion. If they then go into the witness box they will have to rely upon their memory with no copies of statements allowed. Lawyers will rehearse their witnesses to ensure they are ready to testify. There are exceptions to this rule that include police officers, pathologists etc who may refer to notes made at the time.

In cross examination lawyers will test the evidence given by a witness. The jury will make a determnation if they believe the evidence or not. Certainly the barristers that have provided instruction to us mere undergraduates advise not to rely on courtroom tricks as judges and jurors take a dim view.

I've got access to some great journal articles that might give clarity to a few of the current issues but they are password protected so the link won't work. I'll try and work out how to provide access to them for future reference.

If a witness is truthful, it will not be difficult to rely on memory in the witness box, nor to withstand cross examination. It is only where the witness's evidence may be less than truthful or embellished that the witness may have problems. The truth will always prevail, and it is usually evident to a judge and jury members when a credible witness gives evidence.

Yes, Judge Judy always says: "If you tell the truth, you don't have to have a good memory". Very true!

I thought the offer from the Morcombes was sincere and understanding. they seem like gentle, caring people.

I was quite critical, in the early days, of the trust set up to help the girls and still think it was the wrong time to do it. But now I think they will need all financial help they can get, not just for school fees, but for so much more.

No one knows how long they will have there grandparents with them, they face a very uncertain future. No material goods can bring back there Mum or there Dad and life will never be as it was on the the 18th April. But if they can have one less worry, money to seek professional help and to enjoy life a little, I am happy to give what I can.

Yeah, and the Qld Homicide support group will surely be involved. Real people who have experienced homicide within their own family. Self-help support groups are great. Someone who knows similar feelings.

Unfolding Truth...you may have seen this already??..I posted in previous thread this morning...

June 15, 2012 - 3:00AM

Last night, Brisbane's three major commercial television networks reported being contacted by investigators for the schedule of their programming between April 18 and 19.

It is understood the programming information will form part of the brief of evidence against Mr Baden-Clay. He has allegedly told police he last saw his wife watching The Footy Show on Channel Nine.

http://www.brisbanetimes.com.au/que...t-in-prison-20120614-20cq6.html#ixzz1xqeDIAwk

Considering that it appears the scheduling has only been requested from the commercial channels, it is possible that there was a certain commercial of interest. Channels 2 and SBS don't have commercials to my knowledge, other than show promotions.

Thanks Hawkins-I really appreciate how you are able to relay complex legal issues to those of us that aren't 'experts'.
Absolutely NEWBIE, he has a wonderful way with words which explains fluidly to the average man/woman. This may be a 'gift' tempered by years of practice of explanations for the average man/woman. There is a compassion there which is truly appreciated.
