Ok, so that might explain things with that picture....

But good catch on when the laynard was found in relation to the key...

I went and looked at all the pictures again, and I see where you think a cell phone could be, but I just can't see it clear enough. I looked at a photo taken from the back of the RAV4 and it didn't look like anything was in that cubby hole again!!!! and I didn't see the lid to the console.

I wonder why Zellner didn't insist on taking new swabs from the RAV4, it's still held in Calumet County?

Actually she did. Here is a list of items (I hope I didn't miss any) Feel free to help me fill in the blanks on where the items are held. I will update with new information. Let me know if I have missed any.

RSBM

She asked for those in her motion, but she settled for these:

Item A6 bloodstain cutting from RAV4 Driver seat Exhibit # 333
Item A8 swab of ignition area RAV4 Exhibit #336
Item A9 bloodstain culling from passenger seat Exhibit #331
Item A10 swab of bloodstain from CD case Exhibit# 332
Item A12 swab of bloodstain rear passenger’s door Exhibit # 334
Item A7 blood flakes on floor by center console Exhibit # 335
Item ID swab from hood latch.1 Exhibit # 205
Item C Toyota Rav 4 Key Exhibit #211
Blood Vial 1996 sample of Defendant’s blood Exhibit #478

All of the evidence listed above was held at Manitowoc County, as per the receipt for exhibits

According to this Chain of Custody log, the vial is/was being held at CASO

As for why evidence was in different places, it could have just been a space thing? The vial, it may have been because it needed to be stored properly and maybe Manitowoc didn't have the means to do that?

Notice that Zellner calls the "flakes" of blood "scrapings"? I did notice that the other day, that's when I went and looked in the transcripts, but no indication that I could find that anyone scraped them from anywhere.

Thanks for the neatly presented information, BCA and Missy. So the new untested items that KZ requested were not approved? The interior hood release, bar that moves the seat forward and prop bar that holds up the hood?

Hi IDK :seeya:

I'm not sure...I do recall that Manitowoc had possession of some items and Calumet others. I believe it was in the press conference that she said she could start on the items in Calumet's possession right away..or am I remembering that incorrectly??

I think you are correct!

hmmm I don't think she has tested anything that was in the motion. If she could test them without waiting for an order, why put it in the motion? All of the blood evidence that she is being allowed to test was part of the order from 2007, where it was ordered that they would be allowed to test at a later date. Other than that, the hood latch swab and the key are the only things that the State agreed too from the motion filed in August.

Zellner said that they had already tested things NOT being held IIRC and she said that what they had tested already could get him exonerated. So whatever they tested, was not anything that was being held as evidence IMO I don't have time at the moment to listen to the youtube clip of her outside of the courthouse in August, it's near the beginning of this thread, I will try to listen later.

So, I went back and listened again to the KZ press conference and here is what she said.

"We have completed testing on items that we don’t need to request from Calumet County. That testing is already completed."

Then toward the end, she states "We have these tests combine these tests with the tests that we have already done."

So, it sounds like whatever tests she has already done, doesn't require any crime scene evidence. So Missy is correct!

thanks for listening to it again BCA! Had hubby's work xmas party tonight and I didn't have time, but I had listened to it earlier this week and was pretty sure that she said something like she had tested other items. I still wonder what these other item's are LOL

It also seems that she was okay with what they agreed to allow tests on, so I really wonder what she already knows!

Well, we do know she had already taken a new vial of SA's blood (when she was up there at the prison) for DNA testing. I'm guessing there was something in that blood that didn't correlate with what the state presented. Thus, the statement that the tests were complete and she was "positive" SA was innocent.

IMO, she just wanted to go the extra mile to prove the blood was planted by LE because once he gets out, the huge payday lawsuit will start. I think this is what she was aiming at with the request, when she had all she needed to prove SA's innocence.

It's one thing to be in prison wrongly accused, but having evidence planted takes it to a whole new ballgame. I think she was getting ready to play ball.

But again, just my opinion and speculation.

Well um...this piece of cardboard, in Exhibit 293 I may add. I also might add that if you look very closely at the console between the seats~~IT IS WIDE OPEN!! (reference right below my yellow line between the seats)

So much for pictures of an unaltered crime scene.

I don't see any cardboard in this photograph. It is the cement floor outside the vehicle that is in the yellow square. On first glance it does look like it though.

Well, Good Morning Limaes!

I don't think it is concrete...However, good catch~~I know think it is a piece of cardboard laid out on the floor to either stand on or for anything that might fall out. The door appears to be open. You can see concrete here at the very top of the picture.

BCA ~ I'm pretty sure it's just the concrete floor.

if you go look at the photo's of the RAV4 while it was sitting in the crime lab garage, you can see where it was parked, you can see the line/break in the concrete that would line up with what we are seeing in the above photo if the doors were open.

I don't want to post them all, but they are here:

ETA: I think the angles are playing tricks on your eyes. At the very top, it's actually the wall IMO

I think it's the wall too and you & Limaes were correct on the concrete😉
I can see where it looks like concrete at first and definitely depending on how you are looking at it.

Nope~~I'm sticking to my guns on this one...LOL

Here is the picture of the concrete floor~~there is no wall on the driver's side. Remember the Exhibit I took it from "293" is the view from the PASSENGER side.

While, I'm sticking to my guns~~I do no longer believe it was inside the car, since you've mentioned that the picture was taken in the State Crime Lab. However, I will concede, I don't think it's anything nefarious.

Right?! LOL

one thing that the pictures show.... is just how bad the pictures are that were taken, of evidence, in a murder case. It just blows my mind that they couldn't even take a decent picture, of anything!
