Ms McBride’s boyfriend of about eight weeks, Sayle Kenneth Newson, 41, will face an estimated three-month murder trial in Newcastle Supreme Court on May 20, 2019.

The case against him is entirely circumstantial.

There was no blood found in his vehicle, no witnesses, no CCTV, no DNA and police don't know where the alleged murder occurred.

But what police and prosecutors do have is a pattern of alleged suspicious or bizarre behaviour that they say point to Mr Newson being the man responsible for murdering Ms McBride.

There was the cash reward that police say he could never pay. The "argument" and the deleted Facebook account. The photograph that was allegedly edited for the missing person's poster before Ms McBride was even reported missing.

The public displays of grief and torment, the extensive appeals for information and the social media campaign juxtaposed with claims he had moved on to other women almost immediately.

There were the alleged efforts to interject himself into the police investigation and deflect suspicion onto others, which included two of his associates breaking into a rival's house to search for evidence. The attempts to learn the location that police and the SES would search next, before claiming he couldn't stay and help.

The claims of unusual comments, like telling a police officer early on during the missing person's case that "you're looking for a dead body".

And, perhaps most importantly, there was the information he allegedly knew about the crime scene.

Mr Newson's co-accused, James Anthony Cunneen, now 27, had the murder charge against him dropped last year. In its place, prosecutors laid a charge of accessory after the fact to murder.

Mr Cunneen will also face trial alongside Mr Newson.

Accused killer allegedly searched for sex one day after girlfriend's murder, court told

When Carly McBride went missing in the NSW Hunter Valley in 2014 it was her new boyfriend Sayle Kenneth Newson who led an immediate public campaign to find her.

But the day after Ms McBride disappeared, Crown prosecutors allege Mr Newson sought sex with another woman and was regularly consuming the drug ice.


Fake crime scene
Carly McBride became the face of Missing Persons Week until her body was eventually found by two bushwalkers in 2016, two years after her disappearance.

Today the court heard the police released fake imagery of the location of her remains to the media as a tactic to find her killer.

Mr Carr said that Mr Newson was recorded in a telephone conversation describing a part of the real crime scene, at a time when that location was still hidden from the public.

The allegation will form part of a 36,000-page brief of evidence against Mr Newson and Mr Cunneen.

But Mr Carr said there was no forensic evidence and the case would rely on circumstantial and tendency evidence.

"Nowhere in those papers … is what we would call a smoking gun-type situation," he told the jury.

In his opening address to a Supreme Court jury in Newcastle on Monday, crown prosecutor Lee Carr said the phone call was one of the most significant pieces of evidence in the circumstantial case against Newson, a Muay Thai martial arts expert accused of murdering Ms McBride, 31, his girlfriend of eight weeks.

The prosecutor said the couple had argued two days earlier about Ms McBride communicating with other men on Facebook.

Mr Carr said police later found a map at Newson's home where circles had been marked around Scone and Muswellbrook as well as the locations of point-to-point cameras between the two towns.

The location where Ms McBride's remains were found was inside one of the circled areas.

The trial before Justice Mark Ierace continues.

McBride's remains had been found, Newson said she was the first woman he had loved in 14 years and he believed "Carly was given to me".

Newson told police he thought Carly was dead and "God had made this decision".

Mr Carr said Newson later searched the internet on how to delete a Facebook account before Ms McBride's Facebook account was deactivated on September 29.

Police allegations include:
  • Carly had met Newson and Cunneen in 2013 at a drug rehabilitation centre near Wyong and began a relationship with Newson in August 2014, eight weeks before her murder.
  • Mr Newson was on an ice binge at the time of Carly’s murder and had controlling behaviours towards Carly.
  • Two days before her murder the couple had argued about Carly communicating with men on Facebook.
  • On September 30, Mr Newson had driven Carly from her home in Lake Macquarie to visit her daughter in Muswellbrook at her ex partner’s home, dropping her off at 12:30pm.
  • When Ms McBride was walking to McDonald’s to meet Newson, he intercepted her and killed her sometime after 2pm, before dumping her body at Owen’s Gap and made no attempt to conceal the body.
  • Carly’s body was discovered by two local bushwalkers on August 7, 2016 but police delayed announcing her body had been found for four days in an attempt to draw evidence from her killer.
  • An autopsy revealed Carly was killed from blunt force trauma with at least two blows to the skull and one to her back.
  • Mr Newson made a public display of concern in trying to find Carly, but early the next morning after her death had sent a text to a woman to arrange to have sex with her, stating “Do you want to f***?”

Grieving mum stares alleged killer down

Lorraine Williams took a long hard look at Sayle Kenneth Newson as she gave evidence during the third day of Mr Newson's murder trial in Newcastle Supreme Court on Wednesday.

When asked by Crown prosecutor Lee Carr, SC, about the last time she saw her daughter, Ms Williams broke down in tears.

We had a lovely lunch that day and played pool," Ms Williams said. "That was the last time I saw her."

Under questioning from Mr Carr, Ms Williams agreed Mr Newson spoke to her over the phone and said: "Carly has gone. She has gone. She has got no money. I was supposed to pick her up at McDonald's, but she never got there."

Ms McBride's father, Steve McBride, had called to say her boyfriend, Mr Newson, had been in contact and Ms Williams got a number for Mr Newson.

At about 3.30am on October 1, 2014, the day after Mr Newson raised the alarm, Ms Williams said she got a text message from Mr Newson's number saying: "I am tired and I am out of petrol and I need to sleep".

Two hours later, Ms Williams said she texted that number to tell Mr Newson to come to her house, but he never came over.
