Chief Justice Tim Carmody brings an end to proceedings.
The Court of Appeal's judgement is reserved, meaning it won't be known for some time.

"... In response to the Crown's submission that Brett Peter Cowan's sentence be increased, Barrister Angus Edwards, for Cowan, cites the Max Sica and Scott Maygar murder convictions"... both men killed more than three people, Mr Edwards says, so their non-parole periods were extended by more than five years... Cowan was convicted of killing just the one person, Daniel Morcombe...

"... Tony Moynihan, QC, is now turning to Brett Peter Cowan's sentence, saying it must be made more severe... the evil and monstrous nature of the killing needs to be deterred, be denounced and, as (Daniel's) family indicated, (the sentence) does not in any way facilitate the administration of justice"...

"A two-day appeal into whether Brett Peter Cowan was fairly convicted ended yesterday with the Crown calling for a tougher sentence for the serial sex offender"...“The Attorney-General contends that the increase of only five years is manifestly inadequate in the sense that it’s plainly unreasonable,” Director of Public Prosecutions Tony Moynihan said. “He intentionally killed a child to avoid detection. He abducted a child waiting for public transport … that attacks at the heart of our way of life.
 
... Cowan was convicted of killing just the one person, Daniel Morcombe... The word "just" seems so offensive in that statement. I hope they go ahead and slam him with a few extra years for good measure at the end of this appeal. The cheek of this monster, trying to weasel out of his deserved punishment.
 
Top silk Peter Davis, QC, told the Court of Appeal the 45-year-old’s conviction for the murder of the Sunshine Coast boy should be overturned. He said Cowan’s confession to undercover police posing as members of a crime gang should have been ruled as inadmissable evidence at the trial because it was “unfair”...

You'd have to wonder how criminal lawyers can be so far removed or poles apart from reality.

It would be a hard job finding anyone in Oz who thinks the evidence at trial was "unfair". I think Tony Moynihan, in just a few words, spoke for every one in Oz......

the crime was monstrous and evil and "attacks at the heart" of society

Supreme Court to decide if ‘high-risk’ pedophile rapist should be released from jail

A SADISTIC and psychopathic pedophile rapist named as a suspect in the Daniel Morcombe murder could be released next year.

As part of an annual review to decide if he is likely to commit another serious sex offence if released from jail, psychiatrists have declared Douglas Jackway is a “high risk”.

Jackway told his psychiatrist that Cowan was serving time at Wacol and that Cowan “has ‘death stamped on him’ and is likely to be murdered in prison at some stage”.

“He did not appear to be implying it would be at his hands but that a prisoner in (Wacol) would kill him,” prison officers reported in March.

Jackway told his psychiatrist he went up to the window of Cowan’s cell at Wolston and said: “Remember this face, don’t ever forget it”.

"Bruce Morcombe said an inquest was a “game-breaker” in his son’s case and he believes the extra powers available – such as compelling suspects to answer questions in a courtroom setting – could have a similar, positive impact on other cold cases.

In WA, shadow attorney general John Quigley recently called on the State Coroner to probe the unsolved Claremont serial killings. Mr Quigley said an inquest also offered the best hope for a breakthrough in the Corryn Rayney investigation.

Mr Morcombe, who with wife Denise established the Daniel Morcombe Foundation aimed at keeping children safe from predators, told The Sunday Times it made sense in such difficult cases to use the additional powers available to the Coroner. Last year, he suggested it was time for the WA Coroner to probe the unsolved 1997 murder of 11-year-old Gerard Ross who, like Daniel, was snatched off the streets in broad daylight."

Hopefully there will be news about Daniel's convicted killers appeal soon and a decision about releasing evil Jackaway.
 
Thanks for the info Gregjrichards. I couldn't reply earlier as I had experienced some posting difficulties. However, the Morcombes are to be admired for all that they do in the service of protecting children. They have an ability to articulate well, and to pitch it where it needs to be heard - which contributes to the understanding of those in power positions. They have contributed much to advance our thinking and action strategies around child protection.

Child killer Brett Peter Cowan, who murdered Daniel Morcombe, remains in solitary confinement months after his conviction.

He doesn’t have contact with other prisoners. The only people he speaks to are his lawyer and prison staff.

Jackway, considered one of the worst prisoners in the jail, has for months been in the restricted amenities unit where prisoners are taken for being abusive and aggressive towards inmates and staff.

“He is the worst one to deal with,” one source said.

“He’s argumentative. You wouldn’t trust him anywhere. He’s the worst of the worst.”

A SADISTIC rapist described as one of the worst inmates in Queensland has lost his bid for freedom.

Douglas Jackway, 38, is serving an indefinite sentence at Wacol prison south of Brisbane after he was convicted of abducting and raping a nine year old boy and of raping a young girl.

He is best known for being named as a person of interest in the Daniel Morcombe murder.

Giving evidence today, Jackway told the Supreme Court he could control his temper and stay off drugs and alcohol and he was ready to live in the community.

Two psychiatrists told the court they had serious concerns that he could again rape a young child if he went off the rails.

The psychiatrists say he is a psychopath with a short fuse.

He has threatened to kill prison guards and to bash and strangle inmates, and to smash his cell window.

“I’ll knock a screw (prison guard) to get out of here ‘cause then I’ll go straight to the MSU (maximum security unit)”, he told prison guards on November 18.

Jackway also tried to make excuses for his unruly behaviour and for why he was kept in a special unit for disobedient prisoners, saying his temper will improve when out of jail.

Jackway said life in jail was tough.

“I’ve had my jaw broken, I had my nose broken, I’ve been bashed to do with all the media (coverage of the accusations he killed Daniel Morecombe),” Jackway said.

She set a 20-year non-parole period, five years above what was then mandatory for murder, but made it clear parole authorities should think twice before releasing him as she labelled him a convincing liar."

I don't think we realise the horrific injuries a pedophile inflicts on a child

THE DARWIN ATTACK:

On September 28, 1993, a six-year-old boy staggered into the BP Palms service station naked and with horrific injuries. He’d been molested and left to die by Brett Cowan

His face was cut and swollen. His blackened eyes bulged out of his head. Blood ran from his nose. And those marks. Like blood blisters. All over his face. The doctors would later agree he’d been suffocated, his torso crushed until the blood vessels broke in his eyes.

There were more cuts on the back of his head, on his torso, arms and legs. They were shocked he could walk with the horrific injuries he had below his waist. He’d lost so much blood.

There were other injuries that couldn’t be seen under the petrol station’s fluorescent lights. His lung had been punctured. He was having trouble breathing. He should have been dead.
