Exactly what is level of ‘unacceptable’ does it take to keep accused killers behind bars while they await trial?

It’s alleged Crawford killed Frances then put her body under a ride-on mower before telling police she died in an accident.

Justice Frances Williams just released him on bail because his level of risk is ‘acceptable’.

What is even more shocking, is that the grandfather of Frances’ Crawford’s children put up $250,000 for her alleged murderer’s bail.

Yes. You read that right.

The father of Robert Crawford, put up $250,000 bail for his alleged murderous son, who tonight, is sleeping in their formerly shared home in the Upper Lockyer Valley, Queensland.

Yes, you read that right too.

An alleged murderer, domestic violent perpetrator and manipulator is now sleeping in the family home where the alleged murder of Frances Crawford took place, leaving behind 3 grieving children.

The Supreme Court judge in her infinite wisdom found for the defendant granting him bail, having spent time behind bars since October last year waiting for court proceedings to take place.

To say the family are angry is an understatement. They are asking where is the justice, to allow an alleged murderer of their mother, sister and daughter out of jail.

The news today that their alleged, murderous father is now out on bail, returning to the family home where there mother was allegedly strangled to death, shockingly made possible by their grandfather, has gutted the children.

The children of Frances are pleading for the public to help them by supporting their with ongoing support for mental healthcare, and other costs to help them reestablish their young lives.

The Honourable Justice Frances Williams​

The Honourable Justice Williams is a graduate of The University of Queensland—Bachelor of Arts (1990) and Bachelor of Laws (Honours I) (1994) and was awarded a University Medal (1994). Her Honour was awarded Sir Robert Menzies Memorial Scholarship in Law (1996) and is a graduate of the University of Cambridge—Master of Law (Hons) (1997), receiving the Sir Clive Parry Prize in International Law.

In 1992 and 1993, her Honour served as Associate to the late Justice Richard Cooper of the Federal Court of Australia.

In 1994 Justice Williams completed a period as an articled clerk at Clayton Utz and was admitted as a solicitor of the Supreme Court of Queensland in December 1994.

Following completion of her studies at the University of Cambridge, her Honour served for a period as the Associate to Justice Susan Kiefel of the Federal Court of Australia (now Chief Justice of the High Court of Australia).

Justice Williams was a solicitor in Queensland for over 25 years prior to her appointment to the Supreme Court. This included time as a solicitor at Clayton Utz, a solicitor and senior associate at Mallesons Stephen Jaques (the predecessor to King & Wood Mallesons) and as a senior associate, special counsel and then partner at Corrs Chambers Westgarth.

During her time as a solicitor, Justice Williams served on a number of committees including the Queensland Law Society Litigation Rules Committee and the Law Council BLS Competition and Consumer Committee (Brisbane Deputy Chair). Her Honour also previously served as a Member of the Board of the Chartered Institute of Arbitrators.

Justice Williams was appointed a judge of the Supreme Court of Queensland on 17 February 2020.

A man who allegedly strangled his wife in a “murderous rage” has been granted bail.
Airforce pilot Robert Crawford is contesting a charge of murder relating to the death of his wife Frances Crawford.

The mother of three was found lifeless on her Lockyer Valley property on July 30 last year next to a ride-on lawnmower at the bottom of a retaining wall.

The Crown alleges Crawford killed his wife and tried to make it look like an accident.

During an application for bail earlier this month Crown prosecutor Chris Cook claimed Crawford had “manipulated the scene after killing his wife and painted himself as the victim”.

“He paints himself as waking up in the middle of the night, rolling over and she’s not there and goes looking for her, but what we see on this document is he’s using his phone a lot throughout the evening … and his bed is made, so the inference is he hadn’t been sleeping,” Mr Cook said.

But high-profile criminal barrister Saul Holt KC said Crawford frantically looked around the property for his wife before finding her under the 260kg lawnmower and calling emergency services around 3.30am.
Mr Holt said it was credible that Frances went to move the lawnmower herself and fatally fell in a terrible accident.

Mr Holt said the prosecution case was “very weak” and expert analysis was “flawed”, and argued Crawford should be granted bail.

“It’s at the very least a highly contestable prosecution case. Mr Crawford is and will be highly motivated to defend it rather than run away from it,” he said.

On Friday Justice Frances Williams granted bail to Crawford, who has no criminal history and is also charged with interfering with a corpse.

“The applicant will contest the charges …. a lengthy period of custody may be inevitable if not granted bail,” Justice Williams said.

“There are parts of the Crown’s evidence which are contestable.”

She said a central issue at trial will be whether the Crown can exclude accident beyond reasonable doubt where there is the appearance of an accident.

Crawford was in a show cause situation meaning he had to demonstrate why his detention was not justified.
The Crown opposed bail on the basis he posed an unacceptable risk of interfering with witnesses and others, committing further offences and failing to appear.

The primary risk identified was risk of falling to appear.

Justice Williams said it was uncontentious that where a strong case of murder existed, and given the mandatory life sentence a conviction would carry, there is an incentive not to appear but that risk diminished if the Crown case was not strong

The defence say the 47 year old has ties to the jurisdiction being close to parents, brother and extended family.
The court heard he was suspended from RAAF last year but he was seeking to have it lifted.

Currently he does not have access to RAAF air bases and his security clearance had expired.

Crawford has been in custody since October.

Proposed bail conditions included $250,000 surety from father, curfew, daily reporting at Toowoomba police station, not applying for passport including diplomatic passport, not leave Qld or Australia, not enter within 500m of international terminal, not enter airfield given he is a pilot, not contact with any witness or potential witness including children.

The Crown point to him being a pilot being a risk, but this alone cannot exclude bail, she said.

Had previously made application for diplomatic passport for work before this incident.

Justice Williams found the proposed conditions reduced any risk of release to an acceptable level.

Can’t blame the parents…

Someone in this world has to love us unconditionally.

Plus, in my observation, people who get into prison young and later can pull their lives together, usually have supportive families. So in general, maybe the parents who do not turning their backs on kids, even criminal ones, contribute to the society’s safety.

I don't know, I honestly can't imagine supporting any son of mine who murdered his wife. I'd still have love for them, but I wouldn't bail them out. You would have to suffer your due consequences of your actions. If I thought it was a stitch up, of course I would. Or self-defence, or whatever. But if my Lothario son killed his wife in cold blood? Nah son, you're on your own. But then falling apples and trees etc. I would take it as a personal failing if any son of mine ever did that.

Unfortunately, poor Robert just did not know when to 'kill his darlings' as fiction writers are always being urged to do. He seemed to be in love with his own vacuous imagination, he overloaded the story... What he didn't do, and he didn't do it because it was way beneath his paygrade was , he forgot to do the dishes.. !! there is no romance when he doesn't do the dishes.

I cannot get over him being bailed out. It just defies all known parameters, particularly as QLD currently is dead set against crime , a great promise by the political party in power at this time... must be only for kids, or first nation folks, not white squadron leaders on a certain salary.

Now that he's out on bail to roam freely for the most part, he's probably feeling pretty good as a male who killed his wife in Australia. Rohan Dennis didn't suffer many ill effects from killing his wife that I can see. I'm sure the murdering pilot is feeling pretty good about his chances to go free now too. Imo.
