Australia: Kathleen Folbigg Inquest April 29, 2019 *PARDONED*

  • #101

After being convicted in 2003 of killing her four children and spending two decades in prison, Kathleen Folbigg was pardoned in June. Now, those convictions could be overturned.

An appeals court will be asked to consider overturning Kathleen Folbigg's convictions for killing her four children after an inquiry found there was reasonable doubt of her guilt.

In his final report released on Wednesday, inquiry commissioner Tom Bathurst found there was an "identifiable cause" for three of the deaths and Folbigg’s relationship with her children did not support the case that she killed them.

Thanks drsleuth, I wasn't able to watch, had to get ready for a lunch function which I had thought was for next week.
I see it's not available to watch.

Glad to see The Guardian covering it.

She's had to start her life again, probably with nothing.
Hopefully she might get some compensation.
Though nothing will get those 20 years back.

During those 20 years if she wasn't in prison, the cause of her babies deaths may have been looked into.
She was robbed of the chance to possibly have children that survived.

I wonder if her ex-husband will apologise. I suppose he can't be blamed for believing she was guilty, as that's what all the "experts" said, but still.

I hope her children’s ashes are now returned to Kathleen.

I wonder what he considers to be special treatment?
Is he narky because the state was proven to be wrong?

I can't recall a case where police have apologised for presenting an innocent person to court where that person has been found guilty.
Perhaps Chris Minns is just following suit and doesn't want to go out on a limb.
$10 million in compensation would help Kathleen get over the fact Minns won't meet with her.
I just hope her team of lawyers don't take out a dirty great big slice of that payment.
Ex gratia is the name of the payment Kathleen is fully entitled to receive and gratis is the word for the legal representation that should be done on her behalf.
She could just about go cap in hand to the government and ask for compensation herself and forget about her legal team, just as she could have gone into court representing herself and be found guilty of 4 murders all those years ago, such was the lack of help she got from her legal team back then. IMO

NSW Premier accused of ‘victim-blaming’ Kathleen Folbigg over meeting rejection

NSW Premier Chris Minns has been accused of “victim blaming” over comments he made about a wrongfully convicted woman on Monday.
Wouldn't you think NSW AG Michael Daley would want to bring this to a close and not have it lingering on in his too hard basket. Just get it done!

NSW attorney-general approves $2 million compensation payment to Kathleen Folbigg after release from prison

“Kathleen Folbigg's solicitor says a $2 million payout from the NSW government is "profoundly unfair and unjust" after spending 20 years in prison.

The state attorney-general granted a compensation payment to Ms Folbigg, who was exonerated of killing her four children after spending two decades in jail for their deaths.

Ms Folbigg was convicted in 2003 of killing her four children between 1989 and 1999.

Following a seven-week trial, a jury found Ms Folbigg guilty of the murders of Patrick, Sarah and Laura, and the manslaughter of Caleb.

In 2023 Ms Folbigg's convictions were quashed and in 2024 she applied for a compensation payment.”

These days $2 million dollars isn't what it once was.
It is better than nothing I suppose.

But for 20 years of her life wrongfully stolen I can see where her lawyer is coming from after thinking about if for only a short while.
