Yes. That chunk of ear is no mere bruise. Would have taken quite a bit of effort to achieve that horrible result. Probably more effort than picking up and offloading a lady over a balcony.

Marg from Oz; I doubt that anyone would likely see any injury like that. (It's not human to even contemplate)

The "going off to a monastery" ruse would have placated this terrible horrendous event.

I note also when I was checking up on his employment history, SG also learned Acting.



Clearly not Acting like a Human...

AS Lisa Harnum posted photos of her gazing adoringly at her new older boyfriend, 16,000km away her childhood friends looked on in horror.
"She started posting pictures from Sydney and we were thinking 'what is she doing, who is this guy'? He looked 50," friend Sarah Faust said.
That guy was Simon Gittany, who last week was found guilty of throwing her to her death from a Sydney high-rise.
The anxiety of her friends from Scarborough, Ontario, soon turned to anguish when the TV news informed them in 2011 of her fatal plunge.

Thank you Marlywings. Clearly his hand is obstructing her nose & mouth.

I am looking at that photo again - and let me know if you see this too - looks as if Gittany has actually grabbed and clenched Lisa's cheek to and has his fingers inside her mouth (looking at the screen Right Hand Side) - that is Lisa's tongue you can see coming out of her mouth. It looks as though he is suffocating her and gagging her.

I also think he told her what he was going to do before he did it,
and I think her suffocated her until she fainted from fear and lack of oxygen.
JMO.

So.... There is something which we are not allowed to know, that was considered in the sentence. The wording of this paragraph indicates it was a submission on Gittany's behalf.

I'm burning with intrigue.


There is one further consideration that I am required to take into account in determining the appropriate sentence. It was supported by material at the proceedings on sentence which was presented in open court but which was the subject of a non-publication order. The material was credible and was not contested by the Crown. Its contents should be accepted. For the reasons set out Mr Strickland's written submissions, which I accept, I regard it to be an important subjective factor in the present case. In my view, the matters addressed in the written submissions constitute special circumstances (within the meaning of s 44 (2) of the Crimes (Sentencing Procedure) Act). I consider it appropriate to reflect the impact of that consideration by departing from the usual ratio between the non-parole period and the balance of term, which will entail structuring the sentence such that the balance of term exceeds one third of the non-parole period.

It might be night duty brain here (on my way home to hot bath then bed) but reading this:

My brain probably isn't working properly at this stage so I hope to wake up to some grand trooper style illumination.

Hand over her mouth video. RL shows a depiction of this in the Sunday Night Video which just misses the aggression and violence involved and is inaccurate as well!

Look again: he violently, aggressively captures her, rage all over his face and demeanour; he places his large, male hand over both her nose and mouth maintaining a tight grip, thus restricting her ability to breathe as he drags her back into the apartment...

Given aggression depicted in his actions and demeanour I believe it likely he was unable to come down from that adrenaline fueled state of rage within the following 60 seconds. I believe it likely he acted out that rage to harm Lisa.

We have been speculating at possibilities of how he has rendered her unconscious within the next 60 seconds, but it is impossible to ignore the fact of his apoplectic rage and level of aggression exerted on Lisa to capture her and drag her back into the apartment captured in that pinhole camera IMHO.

That grip on her is tight, restricting/stopping her from breathing. That in itself is terrifying and has a major disabling effect on the body. This is not an action taken when someone loves and cares for another.

Rl's public suggestion on Sunday Night program: that he follows her and wants to quieten her is a denial of his apoplectic rage captured by the pinhole camera: the anger on his face, the tight grip, violence, aggression and total control exerted over Lisa's breathing and body as he drags her backwards.

All in my opinion only and fair comment on a public program.

BLIND RAGE looking at this incident at Tyabb, this proves people experience a blind uncontrolled rage. Witnesses galore. Did Gittany 'Snap' like this or was it more premeditated?

FIGHT, FLIGHT OR FREEZE so many people, adults children & BIG BURLY FOOTBALLERS. Why didn't they intervene? Obviously there were cricket bats they could have used to stop this. Did they freeze? Was it such an overwhelming experience the brain closes down and desensitises the situation? Did Lisa experience this??

What I'm saying is what Lucy McCullum got it right that people DO have a 'blind rage' and people do 'freeze'. Proof of it last night in numbers.

Yes Fuskier the grip is tight and all Lisa's weight bearing is on her neck. The way she was held I feel we could have been seeing her neck broken in the vid or soon after. :( I've often thought this but couldn't say.

Thanks TGY. I often thought of the possibility that her neck was snapped. As ICU Nurse explained in an earlier post, this would be difficult to detect/distinguish from injuries sustained as a result of her body smashing to the pavement seconds later.

Thanks for the info & link ICU Nurse. Trooper, Madame HDivision and Makara are usually adept at shedding illumination on these matters through sourcing documents and/or knowledge of the area.

Some thoughts:

Maybe it was a combination of his seething rage, Lisa froze, he quickly grabbed her with both hands, suffocated and strangled her at the same time while he was dragging her then picked her up and tossed her over the balcony.

I am also curious as to why his non-parole period is 18 years rather than 20 years and what that secret (which is non-publishable) would be. At one stage, I thought it could be that he might be going to be a father but surely that would not reduce this non-parole period.

I am also curious about how Channel 7 is going to present Rachelle and the show on Sunday night now as it seems unlikely that Shapelle Corby will be able to accept the money or she will be sent back to jail. There is much more interest in this case than Corby's. Most Australians seem to be "over" her so I am sure they will not get the audience that they had hoped to get and are shocked that she was offered about $2m.

I just KNEW they would have had the cameras on her for the verdict (at least it sounds like they might have). Her new theme song - 'we're in the money....'

I did have some sympathy for her, but now knowing that she chose to be away from court for the sentencing says to me she has more care for herself than SG.

Even if my partner's family told me not to attend sentencing, wild horses couldn't keep me away if he was the love of my life. Money certainly kept her away. IMO of course.

12th Feb 2014

Defence barrister Angus Edwards asked Mr Ellis about airway compression leading to death, questioning what might happen in a struggle situation.

His client Brett Cowan told undercover police officers Daniel died when he grabbed him around the neck to stop him escaping.

Mr Ellis said if one's airway was blocked then they could lose consciousness "very quickly".

He said if the person was not expecting it and then fought it, they would lose consciousness even more quickly.

"After the flow of oxygenated blood to the brain reduces or stops, it is usually about four minutes before irreversible damage occurs," he said.

"Once you get irreversible brain damage … (and) the interruption of oxygen supply persists then death will occur in a small number of minutes."

Just a thought..
Giittany may have thought he had already killed her - and maybe that's the reason why he threw her over the balcony. But she was alive, and had possibly fainted.
It would IMO tie in with him once again, not taking responsibility for his actions and try to blame Lisa.

That was my opinion too. I did mention in an earlier post that channel 7 had her with them so that they could video her as she heard the verdict for better effect. She obviously loves money more than him. She being so prominent all the way through and then not attend really has you thinking.

Oh sorry Marg. I forgot your previous post! Totally agree with what you've said.

I have a feeling that this is the start of her edging out of the Gittany's lives, loaded with cash and ready to promote her image off the back of her high profile in the trial. :facepalm:
