I thought GL lodged an appeal last year. Does anyone know what the latest is?

AI Overview

The timeframe for deciding a criminal appeal can vary, but it generally takes at least six months, and often more than a year, from the initial filing of the appeal to the final judgment. The specific duration depends on the complexity of the case, the court's workload, and other factors. Legal Aid NSW

It might be the same in Victoria, I don't know.

That media pressure certainly worked and Lynn got his paint brush out and painted his car a different colour and may have said a few things that were recorded by police..
I've always thought police used a similar tactic with the media when finding Samantha Murphy's phone in a dam to put pressure on perhaps a second person involved in her disappearance, but there's no obvious signs of that working if it did happen.

Appeal date set for high country killer Greg Lynn

High country killer Greg Lynn will have to wait another three months before he will get his appeal showdown.

Victoria’s Court of Appeal has listed the former airline pilot’s appeal against his conviction and sentence for October 31.
“Substantial miscarriage of justice eh?” Try telling that to Carol and Russell’s grieving families. This appeal is nothing short of an utter disgrace.

I took it to mean that the upcoming court date is to decide if an appeal will be granted or not.

In short:

Former pilot Greg Lynn will find out whether he will be able to appeal his murder conviction later this year.

Lynn was last year found guilty of the 2020 murder of camper Carol Clay and sentenced to 32 years' jail.

What's next?

The leave for appeal will be heard on October 31.

Thats how it works!! he is entitled to request an appeal hearing, not that he has been granted that event.. To have it granted, Greggy will have to show new evidence or some substantial error of the judge,..... rather unlikely circumstances, all things considered.

That's how I read it also.

'''According to court documents released by the Supreme Court of Victoria, Lynn's lawyers have appealed based on four grounds, including the argument "a substantial miscarriage of justice" happened due to the jury's decision making.''''

This one is a very large red herring.... he is actually accusing 12 jurors of individually and collectively conspiring to reach an erroneous conclusion. It's not that it has not been tried on before, it is quite unoriginal in it's concept, lots of convicted persons claim this particular aspect of their conviction , but it is difficult to think of any that have been successful. What the other three grounds are will be probably as unoriginal as this one is... However, he really only needs one ground to succeed ( and be definitively objectionable to the conviction )... for the appeal to be granted .

This Age article says that there are five grounds for appeal. Four are related to the conviction and one is related to the sentence.

One of the grounds is against the evidence of ballistics expert Paul Griffiths (VicPol). He was the one who brought the murder weapon into court and showed the jury its operation.

It doesn't talk about the rest of the grounds, other than to say that Lynn's lawyer said (last year) that he was going to appeal against the prosecution’s closing address, which included statements never put to Lynn. (Who knows if that is in the actual leave for appeal.)

The media organisations are also petitioning against a 2023 suppression order preventing publication of details about Lynn’s past.

I got the impression that Greg Lynn didn't think what he did deserved a lengthy prison sentence.

I got the impression he thought it didn't deserve an arrest.

Yes you're right.
Another example of a man escaping from a lions den who goes back for his hat. It will be interesting if that suppression order is lifted on the press, re Lynn's previous escapades, for want of a better word...

'''Lynn’s lawyers will argue the 32-year sentence - and 24-year non-parole period - were manifestly excessive.

In a letter read to the court at sentencing, Lynn said: “Your Honour I am disappointed and perplexed by the jury’s verdict as I have not killed anyone and will be appealing”.

“Due to current community sentiment I understand my apology will likely be rejected by most. I don’t ask for forgiveness I’m simply sorry for what I have done.”

Lynn apologised for his “selfish and callous” efforts to burn Ms Clay’s and Mr Hill’s remains, saying he had reasons at the time.

Documents filed by his lawyers show criticism of the Crown Prosecutor will be a central argument. Lynn’s lawyers will argue prosecutor Daniel Porceddu breached fairness rules by not putting key statements to Lynn while he was in the witness box. ( This particular argument has amost nil chance of success )

''
The last two grounds of appeal against Lynn’s conviction relate to how the jury reached its verdict, arguing they travelled down an “impermissible pathway” in their deliberations and that the verdict is “unsafe and satisfactory”.

Lynn will further argue his 32-year sentence — seven years above the standard sentence of 25 — is “manifestly excessive”.

Not to me, it isn't.
