A judge set to determine killer pilot Greg Lynn’s appeal has raised the prospect that prosecutors could seek to retry him over a camper’s death.

Justice Priest asked, if a retrial was ordered, whether the prosecution would “try to prefer a charge of manslaughter for Mr Hill”.

The second question raised was whether the prosecution would urge manslaughter as an alternative verdict for Ms Clay’s death in any possible retrial, given the original trial was run as an “all or nothing” case.

Can I vote for LWOP? The public would be safer, particularly campers. I wonder how many people in Victoria might have given up camping since Carol and Russell's disappearance and deaths.

I thought you meant “leave without pay”, but I assume you mean Life without parole as a sentence. It’s not really done in Australia except under rare circumstances.

To me this is a bit of a strange question from the judge, regarding manslaughter.

It really changes the dynamics of the trial and in my opinion undermines the jury's decision of finding Lynn guilty of murder.

I'd be almost certain the only reason he wasn't found guilty of the murder of Russell was due to the restrictions the judge placed on them and they were due to the prosecution's eronious trial.

Suggesting that perhaps it was an "all or nothing" trial, has little relevance and is a strange thing to say, in my opinion.

Lawyers for Greg Lynn have argued the 32-year prison sentence he was handed for the murder of Carol Clay, arguing it was "manifestly excessive" and could see the 59-year-old die in prison.

The former Jetstar pilot is challenging the conviction and sentence he received during his high-profile 2024 trial.

What's next?​

Legal teams have been asked to provide further written details to the court later this week.

Thank you for sharing the basic factual information and the links for those who can read them. I was not a juror but find Lynn’s narrative of defending himself to be unbelievable. I hope he does not get a redo on the charges for which he was convicted. MOO.

Sheesh, it's not as if he gave Carol and Russell the chance to live the rest of their lives.

Poor diddums Mr Lynn might "die in prison" 🎻

I have to say that it's a surprise to see sentences over 30 years, because for many years many murder sentences were something in the range of 24 years, with very rare exceptions.
