Two questions in killer pilot’s appeal​

A judge set to determine killer pilot Greg Lynn’s appeal has raised the prospect that prosecutors could seek to retry him over a camper’s death.

Justice Priest asked, if a retrial was ordered, whether the prosecution would “try to prefer a charge of manslaughter for Mr Hill”.

The second question raised was whether the prosecution would urge manslaughter as an alternative verdict for Ms Clay’s death in any possible retrial, given the original trial was run as an “all or nothing” case.

I thought you meant “leave without pay”, but I assume you mean Life without parole as a sentence. It’s not really done in Australia except under rare circumstances.

To me this is a bit of a strange question from the judge, regarding manslaughter.

It really changes the dynamics of the trial and in my opinion undermines the jury's decision of finding Lynn guilty of murder.

I'd be almost certain the only reason he wasn't found guilty of the murder of Russell was due to the restrictions the judge placed on them and they were due to the prosecution's eronious trial.

Suggesting that perhaps it was an "all or nothing" trial, has little relevance and is a strange thing to say, in my opinion.
