The heavy breathing starts AFTER WR falls. He's seen her fall and has a panic attack as he knows her chances are zero. thats how I read it. Quite likely so will some jury members.

It is amazing how some posters are focused on the legalities of Tostee's infractions in the eyes of the law... And jurors... Yet are immune to the tragedy of the heinous death of a young woman ...

Funny ... I can't see any lawyer recommending that anyone flee the scene of an accident. I can see them recommending that a person keeps their mouth shut until their lawyer arrives, but flee the scene and hide? No. <modsnip>

After reading portions of the BBF, you really do get a better understanding of narcism and psychopathy at work. I had no idea that there were so many knuckleheads out there. Cartoon characters come to mind like popeye !!! I can understand Tostee having over 150 women, who in their right mind would want to stay longer than a few hours. Wonder if he has ever had a meaningful long term relationship?

I have only been on WS for 2 years and thoroughly enjoy reading each and every posts on this forum and others - truly amazing people. On that note have a SAFE and wonderful Christmas.

Early Xmas present - choice of keys to a new car or NELL's cross examination with Tostee. I know what I'm going for. That would bring joy to the world.

THP do you think Tostee taking the stand, having an IQ of 150 and a grip of the law??

Sounds even more like the night was planned out,' in case date falls off balcony, ring lawyers immediately and flee the scene'.

Prosecutors agreed to supply a mobile phone analysis report, the preliminary autopsy report, approximately 50 witness statements and photographs taken at the crime scene and during the autopsy.

Have you looked at the height of the cement ledge? If WR was sitting on it, her legs would not be long enough to extend beyong the bottom limit of the ledge.

As to her being suspended by GT, that's absurd. Show me one photo where he is developed? He is not a bodybuilder by any stretch of the imagination. He is actually kind of thin and he wouldnt have the strength to do what you claim.

Ms Ellis claims she saw WRs feet dangling but I cannot see how she would see WR's feet dangling unless she stuck her head outside the line of the building, or WR was trying to scale down and was hanging on the top ledge with her hands.

These are all scenarios that are going to be examined in court.
Oh, I believe Tostee would have been quite capable of dangling Warriena over the railing of the balcony and in my opinion that is precisely what he did do. "He is actually kind of thin" you say?. I think not. He's no lightweight. See attached photos.

This article was in today's Sydney Morning Herald.

2014 in review: The crimes that shocked Queensland

August

New Zealand tourist Warriena Wright fell 14 storeys to her death from Gable Tostee's apartment balcony on August 8. The pair had met hours earlier via dating app Tinder, but the night turned violent. Tostee refused to speak to police but posted a statement denying any wrongdoing on a bodybuilding forum. Tostee was charged with murder despite not being on the balcony at the time of Ms Wright's death. A trial is likely in 2016.

lol those pics show what? An average dude. Look at some more of his photos on Google, you'll see he aint buff by any stretch of the imagination. All the brahs on BBF scoffed at the suggestions in the media reports that he was a body builder. Not one person there agreed he was developed.

And this link - hes started to lose some body fat and tone up a little in the shirtless pic, but no way would he be much over 90 kg.

Also look at the video on that page. Look at his ordinary arm and thin legs. Yep 90 kg, <modsnip> H'es just tall. Carpet laying doesnt make you strong either.

'Creepy' murder suspect remanded

Sammy Soden, 18, met Tostee about three months ago. She told the Weekend Herald he was highly "sexual" in his Tinder messages. And when he met her at Club Liv, he was drunk and pawed her, she said.
She and two girlfriends went back to his apartment, where she, too, said he was "creepy".

"I walked through the door and he lifted me up, threw me over his shoulder and threw me on the couch," she said. "He was incredibly confident."

IMO he was involved in a chain of illegal incidences, he is and was an accident waiting to happen. He's in the care of his parents at the age of 30 so our streets might be a bit safer until 12th January.

It's Christmas Eve and I'm sure we all will love our families tomorrow but there is a mother and sister across the ditch who won't have Warriena beside them. I'd imagine they will visit her grave, cry, leave some flowers and go home without her.

Imagine if this happened to your sister, you would want to protect her memory from people calling her distasteful names. Brothers and fathers are usually protective of their females.

This case is running along similar lines of the Gittany case. Both women fell from a high rise and both deaths had some kind of recording just prior. Most importantly both have witnesses of the victims screaming for their lives.

Gittany is away for a long time in a Sydney prison and I'm sincerely hoping Tostee will be Authur Gorrie for a similar length of time.

Justice will be done. I haven't backed a wrong horse yet.

I looked up that Queensland citizen's arrest thing that was being talked about before.

In Queensland, persons enforcing a citizen’s arrest must observe the following:

After making a citizen’s arrest, you must deliver the person and any property belonging to the person to a police officer or proper authority without any delay;
You must only use reasonable force;
You must not subject the person arrested to embarrassment, indignity, or humiliation; and
You should be certain that a crime has been committed, and that the person you are arresting is the correct person.
If you are unsure about any of the above 4 points, you should refrain from making an arrest.

http://www.bosscherlawyers.com/citizens-arrest-queensland/

BUT ... most importantly .... "A person can be charged with manslaughter over a citizen's arrest where a person dies, just like it's possible for a police officer to be charged with manslaughter."

http://www.brisbanetimes.com.au/queensland/the-ins-and-outs-of-a-citizens-arrest-20131108-2x74e.html

So, I guess they really have to be careful what they are using force for, and if they are using the right type of remedy. I don't imagine that locking someone on a balcony after you have assaulted them and frightened the wits out of them (no,no, no, no, no, no, no, no, just let me go home) would be the right type of remedy.
