Judge Mullins ordered affidavits that include doctor’s report and an audio recording be placed in an envelope and not opened except by order of a court or judge.

Mr Power drew the court’s attention to an alternative definition of murder that deals with an unlawful act with a likelihood of death, rather than a *deliberate intention to kill.

“In this case, the dangerous act was shoving the victim out onto a 14-storey balcony and locking her out there,” he said.

He likened it to depriving someone of their liberty by locking them in a box, leading them to suffocate.

Judge Mullins said Tostee “seems to have quarantined himself” from his involvement with Ms Wright in the five and a half hours before her death.

She said his defence of the charges did not explain his apparent lack of expressing regret and noted that he did not phone emergency services after she fell.

Instead he phoned his lawyer, then his father.

“Applicant is upset about what people are saying about him on social media,” she said, adding that Tostee was incredibly focused on himself.

Ok guys re-opening the thread after discussions with WS owner, other Admin and a huge clean-up.

What would be the point of calling 000 if emergency vehicles were already there by the time he went downstairs?

A decent gesture would be to tell the emergency workers her name and she was from NZ so they could inform her family. That might have been a helpful thing to do.
But alas the world has changed to 'why should I give a damn'.

Grrrr I'm being nice. :D

Had a sad thought - 8/8/14 Warriena fell to her death, 2 years after that post was made.

It's just a crying shame. Around the same time GT was writing about bringing a drunk bish (his words from Jimmy Russel's link) home and posting secret video of her online for his brahs, Warriena was writing to Parliament appealing for stiffer penalties for animal cruelty offenders. The juxtaposition is stunning.

A Gold Coast woman who is the 'crucial witness' for the prosecution of Gable Tostee has given a graphic account of Warriena Wright's final moments before she plunged to her death in Surfers Paradise on August 8.

'Her legs were there first ... it wasn't a lowering or a gentle, cautious ... she wasn't hanging on, she wasn't facing that way ... she wasn't facing that way to hold on.'

The police then repositioned the female officer re-enacting Ms Wright's fall, so that her 'feet were pointing away from the building, her back was towards the building ... and she was a little bit lower'.

Ms Ellis agreed that the female officer was in the right position and said Ms Wright had been 'flush against the building'.

'I couldn't see her upper body at all and she was out like that and um her legs had reached that point. I couldn't see her upper body and that's why I turned and said "I don't know what she's doing" because I was trying to work out is she trying to lower herself that way?'

The statement says the witness &#8220;observed two legs wearing dark clothing&#8221;.

BBM It must have been devastating for him to find out that people were talking about him in a degrading fashion. As if he was just an object and not a human being!

To suddenly discover that people you didn't even know were discussing you as if you were just entertainment for them? Calling you derogatory names? Posting pictures of you online that you didn't know about?

Yes, I can imagine it would be very upsetting.

I just can't see it possible that she was hanging on with her feet pointing outward.
Looking at the height of the railing to this copper I'm thinking drunk girl scaling that railing would be an Olympic feat. IMHOO

Take a look at the fingerprint dust on the metal railing in this pic.

You can see the width of the ledge on the outer part of an Avalon balcony in this r/e pic. I'm trying to figure out how Rrie could possibly have been facing with her feet outwards, and twisting, and hanging on to something.

It would be darn hard to even try to manoeuvre yourself to sit on that ledge, which Rrie obviously didn't as only the soles of her feet were seen from below, no part of her legs.

Amee I've been wondering about this as well. Either someone was holding her as she was dangling from the balcony or it's faulty witness testimony. It wouldn't be possible for her to hold onto the balcony if her feet were pointing away from the building. IMO.

The witness seems quite specific and remembers a lot details, so she sounds pretty credible to me.

I wonder whether they are actually on the balcony below which Rrie hit on the way down - according to the witness testimony. The way the guy is looking up and also based on the video footage of where they were taking samples and measurements...I wonder whether Rrie was held over the edge by Tostee to the right side of the balcony?

Yes I agree with you SouthAussie, I am also not sure how it is possible for her to have been facing outwards without someone holding you over the edge.

I think any fingerprints will tell a lot of the story. Rrie's hands would have to have been in a terribly contorted position for her to have been hanging on to that railing at all. And the witness said she wasn't lowering herself, she was just hanging and dangling, with her back flush against the building - which means the edge of that ledge would have been digging terribly into her back, if she was somehow hanging onto the railing in a contorted manner .... when she was 'psycho drunk'.

I'm of the opinion that GT was dangling Rrie over the edge of the balcony at some point. This would explain the below quote where Ms Ellis says "and she wasn't gripping either, she wasn't on a ledge, so um her feet were dangling." I'm also wondering if he may have sat Rrie on that precarious railing edge, after the dangling, then rushed inside.?

Exactly. And her back against the building helps paint the picture.

If someone were trying to climb off a balcony you're not going to do it in the most difficult way possible, contorting your body in impossible and inhuman positions.
