and most coincidental of all, I think.. he records all this.... he knows its recorded.. she doesn't. Who was this recording for?.. him?.. some weird dynamic with his own father on this matter?... ( women in his apartment) .. was the nature of the end of the evening expected by Gabe , or was that just coincidence? .

I think he is as guilty as it gets. pre-meditated murder.

Have a look at the size of the 'rocks' in the pics I posted up thread. Also have a look at the size of the telescope on the glass coffee table. The rocks look more like stones to me and the telescope in small and so would be it's metal holder that Warriena was supposed to have used to try and kill Tostee, according to Tostee.

He was fully aware everything being said was being recorded. He was playing to the tape, making Warriena's actions sound worse then they actually were. He was goading her into retaliation, goading her into violence. He was getting off on this whole sordid mess.

2.18am: First choking sounds.

2.18.30am: Still laboured breathing sounds. Breathing slows. Male: “Let it go.”

2.19.30am: Sound of something dropping (metallic)

2.20am: Sound consistent with door unlocking. Female: “No.” Possible sound of glass door being hit.

2.20.30am: Male: “Who the (expletive) do you think you are? Hey?” Female: “No, no, no.”

Male: “You tried to kill me huh?” Male: “Well, why did you try and hit me with that. Huh? Shut your filthy mouth.”

I'm interested in others thoughts. After reading the transcript did it sound like Warriena was/did defecate on his carpet which sent him into an OCD tail spin ? As for the salt rocks they were merely scattered around their original container, it certainly did not look like the were thrown from a distance to inflict pain. I do think the recording was for his own satisfaction perhaps amongst many. More than happy to be proven wrong however I don't see it as pre-meditated...... when the situation moves from his control to her bodily function control..... he looses it.

Whatever the outcome of this trial, I hope Warriena's family sues the everloving crap out of Tostee.

I hope so, too. No matter the outcome of the criminal case, Warriena's family can certainly take this matter further.
The burden of proof is different in a civil court case, Tosser's level of responsibility for Warriena's death can be determined, and Warriena's family's legal representative can take a percentage of any financial outcome to satisfy the legal fees.

Time and time again he intimates that Warriena was hurting him with his "Ow, ow"...etc. Constantly referring to her as being violent is the main theme of the recording. He continually tries to get that across for the end listener of this tape. He even told his daddy that Warriena was beating him up.

Warriena, in her drunken state playfully threw some stones at him, tried to hit him with a small telescope stand and the poor fat diddums couldn't defend himself. WTF! I wonder how many times he rehearsed this before he actually had the guts to put it into play, right down to dragging her out onto the balcony and placing her on the ledge. Sick f***!

Just for reference....there hasn't been an Audio recording presented to any court in Australia, from the Magistrates Court, to the County Court, to the Supreme Court, and including the Family Court, that hasn't been accompanied by the corresponding Transcript, since 1982, when the High Court made it mandatory.

Trying to get mileage out of an audio recording being paired with a transcript of the recording is taking redundancy to it's outer limit. It has always been the position of every court in AU that the audio is the evidence, the transcript is the aide-memoir. Nothing new here, as most folks would be aware.

Similarly, a recent case rejected a profoundly deaf juror because an interpreter would muddy their perception. They are very particular about deviation from the true source, and interpretation of same.

The fact that he kept banging on about Warriena's so-called violence makes me think that he had a plan in mind that night. The tape was his 'get out of jail free' pass, or so he thought. She hurt me, she beat me up, ow, ow, ow. He'd probably taken off his big girl blouse and practiced his role many times in front of a mirror.
