It doesn't matter which day. It could even be Tuesday. Who cares? I don't. If Tostee does take the stand he's only going to dribble lies, lies and more lies in my opinion.

I've had more injuries taking the hydrangeas out of the vase.. what is this garbage Gabe is trying to pull ?.. he MUST have known he would be photographed and examined , surely? can he be that dumb?>.... he hasn't even had enough brains to punch himself about ..

I don't understand why his Dad didn't question this ... Dad, she beat me.. ... where, son? show Dad.. .. there is NOTHING there!1.. his whole story has hit the skids, and it's all downhill from here.

Indeed, but the concept is the same. It is about what might be reasonably expected for a person to say coming out of an event like alleged rape. Lack of recent complaint in a rape accusation has quite some relevance. So, here we have Tostee, at the first available opportunity, declaring his innocence as would be quite natural for, and expected of, someone who was innocent.

His first available opportunity? He wandered around for an hour before he even spoke to his father. What he should have done, what any innocent person would have done is to ring 000 and tell the police what happened.

He wasn't beaten. .. by Warriena, or anyone else. His self defence story has just gone up in smoke, not once, not twice, but three times with the pictures, the DNA evidence today, ( not questioned by the defence in any particular ) and the pictures of his medical examination. His Dad has just blown at least a 1/2 Million dollars down the drain.. Gabe just bought himself a one way ticket to Arthur Gorrie. ...

I agree too, but I'm pretty sure the 'very willing participant' part stopped at some point in the evening. This doesn't discount Warriena's behaviour i.e. if she engaged in any aggressive behaviour or assault against Tostee. But I do believe Tostee did engage in behaviour at some point in the evening that Warriena most certainly was NOT a very willing participant (and I'm not talking sexual).

And since rape has been brought up by you previously, I would like to also emphasise that a text exchange prior to meeting has NO relevance to consent/willingness. In fact, rape quite often occurs after two people are very much willing participants...until of course one is not.

You would think so Makara but he rang his solicitor. He put on his pants and did up his belt. Screwed or unscrewed something metal. Then, surprise the woman who had fallen from his balcony phone was in his pants pocket. He only discovering that while he was speaking to his father to inform him he might have a bit of a situation.

8:50pm - Tostee buys a six pack of beer from BWS.

8.53pm - they get into lift at his block of units. Last time Ms Wright is seen alive.

Tostee starts recording audio on his mobile phone at 1.05am

2.14am - Tostee: "You have to leave." Ms Wright: "It's all good." Tostee: "You're f***ing insane."

2.15am - Tostee: "You're lucky I haven't chucked you off my balcony you 🤬🤬🤬🤬🤬🤬🤬 little pschyo *****."

2.17am - Tostee: "I'm gonna let you go, I'm gonna walk you out of this apartment just the way you are. You're not going to collect any belongings, you're just going to walk out. I'm gonna slam the door on you. If you try to pull anything I'll knock you out, I'll knock you the f*** out."

Heavy breathing then crashing sound

2.20am - Tostee: "You just don't understand. Let go! You think if you hit me I'll just fall down like in the movies?"

Ms Wright: (screaming) "No, no, no, no, no. Just let me go home."

Tostee: "I would but you have been a bad girl."

Ms Wright: (screaming) "I want to go home, I want to go home."

Distant scream followed by loud heavy breathing

2.22am - Tostee: "****" (call goes to voicemail) "Where the f*** are my keys?"

2.23am - Gets out of lift on ground floor, paces around, goes back in.

2.25am - Gets out of lift in basement, leaves building via car park.

3.07am - Tostee continues walking around Gold Coast entertainment precinct.

3.11am - Orders and eats pizza from Cavill Ave shop.

Tostee calls father

Tostee: "Hello dad, might have a bit of a situation ... I locked her out on the balcony and I think she might have jumped. I've been walking around and there's million cops around my building ... I swear to God I didn't push her. I just chucked her out on the balcony because she was beating me up ... why does s*** happen to me, I didn't do anything wrong."

3.44am - Tostee picked up by father Gray Tostee in car.

Tostee: "Oh my God I hope she's not dead


Good Grief. All of this happened and they only had a 6pack of beer which was bought at 8pm.

Wth was they arguing about. It seems like he could have stated more of why he was mad during that recording. Idk

I am interested to know if Gabe will produce character witnesses.. the people who get on the witness stand and say they've known you forever, and you are a pillar of the community, you've worked for Red Cross , a Scout leader, and all this stuff. I don't see any mention of any such of a thing on the witness list, .... . a bit unusual in a murder trial...

There haven't been any Prosecution witnesses called to suggest any pattern behaviour, and the one witness left is, I guess, in the area of pathology.

So I wouldn't expect the Defence to call any witnesses not relevant to the night's events.

IF GT were found guilty as charged or of some lesser offence, then I guess there could be submissions made, and evidence called, to be taken into account in his sentencing.

and in the legal sense of culpability, that's a very long time.. .. .. his defence chap knows this, and this is going to be a huge huge hurdle to dismantle.. I don't see how it can be done, really. ..

He didn't want her out on the balcony with her own phone. Because she could have called someone, like the police or something.. or the fire brigade, .... anyone. As someone stuck on a balcony is likely to do. So he made sure that she didn't find it, you can hear her crying and begging for it to be returned to her..

with respect, it is usual, for the defence, and particularly in a murder trial to call witnesses on behalf of the accused to testify to the good character of the accused, before , naturally , the jury goes out to meditate on a verdict. And there appears to be none for Gabe as far as I can tell from the witness list.

His recording shows he threatened to throw her off the balcony. And she just wanted to leave. But he kept threatening her. Then she goes over the balcony.

So are some thinking he's innocent of murder?

Addressing those who commented on GT's choice of words to his father... about not pushing her. I don't think you can hang anything special on that as there is little information on the family interaction or dynamics. All we know is that GT had had some trouble with the police on previous occasions, one a rather serious traffic incident. I am only guessing, that he rang his parents when he was in strife like that.
I can also only guess, that the parents of an adult child could manifest all sorts of emotions both at the time and later, when they were called on to come to the rescue in other ways.
There are many young men who, at GT's age, have climbed a few rungs on the ladder that I expect their parents hoped for... maybe started a family of their own, taking responsibility.
So this may be a repeat of a long history of misguided actions, thoughtlessness, peer pressure, general trouble.... and in anticipation perhaps of a question... like... what did you do (this time)?.... he had to say that first.... I didn't push her (it wasn't my fault... this time)
