Even I can tell she is being choked, through a cochlear implant. It is undeniable.

I don't understand why we Websleuther's are being labelled as male haters. It only takes a bit of a read of the Jodi Arias trial to see that she didn't get treated any different to what GT is now being treated - maybe we have a bit more gross info on him - dunno.It's not about Male and Female - it's about Victim and 'The Accused'.Tostee himself put the Full Recording in the Public Arena a couple of months after Rrie's death. Many of us here have that recording, it was posted on thread but taken down because it wasn't available via MSN (Websleuths TOS).I'm quite willing to put up a link to it if it is authorised by the Mods, then maybe our friend can listen to the complete 3:19:27s of it. When I first heard the full tape, I knew almost nothing about the background of either Tostee and Warriena. I was an impartial listener when that tape first began to roll. After listening to the full three hours of it, the horror dawned on me that Tostee had indeed caused Warriena's death. There was, and still is, absolutely no doubt in my mind that his actions that night caused Warriena's death. He may not have pushed or thrown her over the balcony but he certainly is responsible for her death. I still feel that he may have picked her up and sat her on the balcony with her feet facing out before she tried to manoeuvre herself off the ledge.

I agree that there is no room here for the feminist jibe that's been bandied around. If the victim had been a male in this case, I would feel exactly the same about Tostee's culpability.

That is okay, elde fruit. I don't feel the need to convince anyone. I hear it, the police hear it, MSM hear it, others hear it, the judge and jury have heard it. That is more than good enough for me.
And I have heard it through a profoundly deaf ear with cochlear assistance. Perhaps the last resort would be an interpreter. Or I could mime it.

we are labelled as male haters because we will not adore Gabe.. Adoring Gabe, loving Gabe, believing Gabe, trusting Gabe, admiring Gabe , these are the hall marks of all those who see the elevation of Gabe to sainthood as The Mission..

I don't care about being labelled whatever., Gabe Tostee is a prawn and a poltroon, a charlatan and a phony, But I loathe him because he is a murderer..

It is probably really important to remember that we are not labelled male haters. We are just being called that by persons who cannot find a reasonable defence for Tosser's violence and imprisonment of Warriena (everyone knows that Tosser could have just let Warriena go home). When people have no real defence, they resort to name calling.

I don't believe that is strictly true. It may be a general ruling, but there are definitely exceptions. In particular, if evidence arises that was not available at the time of the trial and would likely have changed the result.


The question of whether to allow the new evidence

In considering whether to allow the new affidavit, Ginnane J referred to rule 77.06.9(3) which gives the court power to receive further evidence on appeal on questions of fact by affidavit. Reference was also made to Clark v Stingel [2007] VSCA 292 in which the Court of Appeal set out the principles upon which the Court will grant leave to introduce fresh evidence upon an appeal. In that case, it was held that it was not in doubt that leave should be given only if:

by the exercise of reasonable diligence such evidence could not have been discovered in time to be used in the original trial;

it is reasonably clear that if the evidence had been available at the trial, and had been adduced, an opposite result would have been produced; and

the evidence proposed to be adduced is reasonably credible.

The forum member referred to being retired, and obviously had difficulty in dealing with something as basic as adding a signature, so I suspect they are not familiar with chat forums and probably not aware there would be other forums out there more suited to their views.

It's always better to give someone the benefit of the doubt.

There are the "Alpha always wins" chatrooms that GT so loves.

I do not require anything. Just filling in the blanks for the purpose of accuracy.
I respect that you have legal knowledge, but I just prefer that the complete picture is shown .... as in, sometimes new evidence is allowed upon appeal.

Oh poss, good minds think alike...I was just looking up a couple of those!! Doing some research on language used. There are a lot of men that subscribe to that 'become an alpha and rule the world' garbage that has sprouted up in recent years across many sites. I recall Tostee reinventing himself and I can picture him spending many a night refining his 'alpha-isms'.

His belief that feminism has made men weak, has found a global audience, with a recent BBC report suggesting he had a million people using his website. Forums on the website also include user submitted guides on where best to sexually assault women in Glasgow and Edinburgh.

I have put a lot of energy into wildlife. You have alphas within species, and then alphas that are predatory species.
I am not unfamiliar with alphaism.

And thank goodness that Roosh V was not allowed into our country! There is enough denigration and violence towards women already. It goes against everything the White Ribbon organisation and many, many well-known and unknown male advocates are trying to get across to their peers.

My biggest hope in this case, is that it is made very clear to everyone that Australia (Qld) will not allow anyone to terrorise anyone else so much that they feel safer climbing over a 14th floor balcony rail than remaining where they are.

And there is a big difference between true alphaism and pseudo alphaism, first is for survival of species, latter for self-gain. I believe some men have butchered the concept of alphaism to excuse sexist predatory behaviour. What I find quite amusing is that women often see straight through these ploys - they use the same language while trying to be a unique individual, use the same strategies that are seen in any nightclub at 2am on a Sunday morning. What makes me sad is that this new age dangerous preaching of 'pseudo-alphaism' is actually targeting those women who are vulnerable and may not see the warning signs.

It is possible, too, that he had his paw tightly clamped over her mouth and nose as he was roughing her up. That would have caused the obvious struggle in her breathing, and added to her evident great fear of him.
It is another form of asphyxiation that can lead to the gurgling sounds as she tried to breathe out of any crevice she could suck air in and out through, as she also struggled to free herself from his clutches.
Yes, I thought of that too. That actually used to happen to me a great deal, and what I found was that I'd have cuts on the inside of my lips from my teeth, and I'd still be able to "scream" from my throat. That's when he'd go for the hands around the throat.

Whatever he was doing I think was exasperated by the fact she was inebriated.
