The locking of the door was the intimidation! This defence bloke is nothing but a cherry-picker full of the manure used to fertilise cherry trees.

:hilarious:

Emphasis on this tweet. In my opinion it was highly negligent of the ODPP to allow the matter to proceed to this point, it was clearly a tactical decision that has backfired spectacularly on them.

It does not matter what he 'likely expected'. You do not lock someone up. You allow them to leave.

PS: Calling the victim dumb is not on. She was drunk.

Surely it cannot be contended that climbing over the balcony of a 14th Floor unit is anything other than a dumb thing to do?

He placed her where she could not continue her attacks on him. As I have said before (and it is being ignored as the largest elephant in the room) he neutralised her and de-escalated the whole out of control situation. He could not reasonably foresee she would be dumb enough to climb over the balcony. He more likely expected that she would lower her rage, and start conducting herself more appropriately after tossing rocks at him and belting him with that telescope.

BBM - evidence with a link please. And while you are at it, if you find one that evidences Tostee's IQ, that would be great too

nonsense.. unadulterated nonsense, .. distilled into nonsense 100 % proof..
and for petes sake, lets give over with the 'rocks' thing.. they were fake pebbles, made of Styrofoam, .. lets have a bit of reality..

(BBM) Really? I have never heard that suggested before. Did you just make that up?

I am not impressed with the prosecution either.
Manslaughter seems a better outcome, due to their poor performance. And maybe that is what they are angling for. They were judicially informed a long time ago that they had a weak murder case.

Then you need to say that ... and not say that the victim was dumb. imo
Many smart people have acted in not-so-smart ways at times, especially when they are drunk.

This young woman practically raised her little sister - as stated by her little sister - held a respectable job, saved money, protected animals and campaigned for them. She was not dumb.

Ah, so Defence concludes its address at just the right time. The Jury will have the weekend with his comments in their heads. Good strategy.
