it is too tiresome to be going over the same evidence with the same people adding and subtracting from it to progress the Mission about Women Beating Men Up, .. Gabe has been made into the lightning rod for all that befalls men who simply fail in controlling women, as indeed, apparently, they must be, lest they accidently expose the weakness of men in just about every gosh darned situation.

Too too tiresome, and the fact is, it is up to the jury.. it isn't a matter of what Gabe said, or what his counsel said, it is what the jury will hear on that tape, and see on the CCTV and read in the transcript of that phone recording....

And the jury will hear that audio many many times.. they will pull it apart, sentence by sentence, they will note that it began around 1am, and when it finished, and where is finished. They will watch the CCTV. (and marvel ) ... they will hear Warriena's screams of terror in their sleep.

hearing her screams of terror before she goes over the balcony.. This will be the crucial discussion the jury will have, because she is , in fact, screaming in terror, not as she goes over, not as she is falling, but before , long before she goes over, and the jury will ask why.. Why is she screaming at this point?..

However, in November, 2014, Justice Debra Mullins told the court a psychiatrist diagnosed Tostee with ]social anxiety disorder, obsessive compulsive disorder and alcohol use disorder.The psychiatrist said Tostee was not suffering from an autism spectrum disorder. "How Mr Tostee has behaved - for example recording as a matter of routine all his encounters - [suggests] that you're dealing with someone that perhaps doesn't behave the way that you would treat as the norm," Justice Mullins said.

A few members of my family suffer from lifelong OCD and social anxiety disorders. It is debilitating but not one of them has ever behaved as Tostee did.

Based on photos already released on MSM, I'm saying this:

Regardless of the outcome of this trial, if I found out that my son was treating women in the way Tostee repeatedly has, I sure as hell would not be ambling beside him in support on the way to court - I'd be kicking his a$% to the ends of the earth.

Thankfully, my son has values that respect women. I'm proud of that.

How hard would a pebble have to be thrown to break skin and draw blood? A round edged pebble
How long would it take after impact for the blood to surface?
I'm thinking back to when my daughter fell on a brick, hit the sharp corner of it, needed 2 stitches
She fell, cried, ran inside, and then it started to bleed
There was no visible blood on the brick

Sooo, was the pebble implanted on him?? Held in place? Where is the injury on his body?

Or could it be that maybe one day he had a paper cut as he tidied his display items, thus transferring blood that way? Seems so much likely to me if there was actually blood on any of them that they came from a prior injury

I have rocks in my house, my autistic kids love to fidget with them
That's their purpose, so it never bothers me when other people fidget with them, pebbles are great for that.
Lots of people love holding them, playing with them, stacking them, tossing them at times.
It's not unusual at all, pebbles are fun

It would have 'gone against' the 'bone' an the average person's 'body' as well. What would anyone's reaction be if an invitee one had just met began to trash their Home?
I'm guessing you have not cleaned up after one of your childrens 15/16/17/18/19/20/21st birthday parties with 70 party goers. Tostee would have had to been committed. It's tragic that we are even discussing him being hurt by little rocks. How heavy were his gym weights one of those pepples would have bounced off that trim taught exterior. Pity one of them didn't him in one if his incisors.

Well, Cash has the (probably futile) job of spinning it his way. My view is that he failed miserably. There was nothing unreasonable about neutralising a threat and also de-escalating the situation.

He is again spinning. The Jury will see right through that. At all times, the instigator of violence was W. At all, times, the person trying to stop it was Tostee.


He said Tostee had very quickly dealt with the danger posed and restrained Ms Wright.

True, and yet the instigator of violent and bizarre conduct was still there. The threat was still there, and removed it to the balcony. Simple.


The court heard he continued holding her down, told her to leave and she agreed before he forced her onto the balcony — without her phone.

Clearly journalistic shorthand, and presents an inaccurate picture. It is the evidence which counts, and that evidence invites a multitude of obvious questions, (this Thread and the preceding Threads are confirmation of that) the answers to which the Crown has not provided.

So, when Tostee called his father after Warriena died, he said "I never forced her over my balcony. I’d never do anything like that." And that is EXACTLY what he did, in his own words. There it is right there. Straight from the horse's mouth.

How many times does person have to scream "I WANT TO GO HOME" before their captor releases them?

Tostee assaulted Warriena, terrorised her and held her captive in his apartment and that is what the jury will concentrate on - the last six minutes of Tostee's tape where the assault, the terrorising and the deprivation of liberty took place. End of story!

Yet the Crown did not push that point. As for the 34 (or whatever the number) 'Nos' - she did not want to be taken to the balcony. Well, she was, and she was left there by Tostee who immediately disengaged and returned to the Unit. "End of" his involvement.

Her 'unruly' (which is a gross minimisation of what was actually happening) behaviour included a serious and unlawful assault of Tostee immediately before he removed her (how is unknown) to the balcony and while he did so she was screaming "No....." repetitively. It is not useful to pretend that assault did not happen, nor it it useful to ignore what is common ground....once she was on the balcony, he disengaged.....etc.

Gabe's barrister urged the jury to think of Gabe ' as a son!! a brother! a young uncle!! '.. he went on.. 'think of Gabe as a young man who is innocent and helpful'... ....

the jury is just not going to do that. No one in their right mind is going to think of Gabe Tostee as 'their son' or as 'their brother ' and least of all, as a 'young uncle'.....

Because the jury have Gabe's own words.. straight from the horse's mouth!!.. in fact, they have nothing else, but Gabe's own words as Gabe's defence.. ( it was a defence done on the cheap, not one expert, or character witness or analyst was called up by the defence, obviously there wasn't the budget for it.. and maybe Dad is correct in not sending good money after bad, too.. .

Why do you think she did not want to be 'taken' to the balcony?
Why do you think she was screaming with such terror in her voice?

What do you think that was about? Did he have her tied up for sex? Were they into BSM?

Warriena seems to get mad at him after that.

the jury will probably act out the sequence of events, as much as can be gathered from the tape.. that bit where she says, 'untie me', is as scary as hell, as it seems to have been done in silence, and quickly.
