I wouldn't know what to make of this eye witnesses account if I was on the Jury. I think I'd have to ignore her testimony as it's too confusing, it's like she's not really sure what see saw that night. The other eye witness who testified to seeing Warriena's feet secured on the concrete ledge doesn't sound unsure of himself, his testimony was pretty straight forward, in my opinion.

I cannot for the life of me, find any evidence presented in the trial in regards to "a SINGLE hand print" (belonging to Warriena) on the balcony rail. Can someone please direct me to wherever it is? TIA

Sgt O'Shea confirmed fingerprints belonging to Warriena were found on the balcony, including a palm print on the railing. #tostee

What is a chokehold?


A chokehold, choke, stranglehold or, in Judo, shime-waza :constriction technique)[1] is a general term for a grappling hold that critically reduces or prevents either air (choking)[2] or blood (strangling) from passing through the neck of an opponent. The restriction may be of one or both and depends on the hold used and the reaction of the victim. The lack of blood or air often leads to unconsciousness or even death if the hold is maintained. In Judo terminology, "blood chokes" are referred to as "strangleholds" or "strangles" while "air chokes" are called "chokeholds" or "chokes".[1] In forensics the terms "strangle" and "stranglehold" designate any type of neck compression,[3] while in law-enforcement they are referred to as "neck holds".

We must have gone to the same school! Seriously, we did that too!

Crazy kids. Thankfully, my teenaged and young adult years were before the age of Tinder too. Our idea of a good time was to go out and see a live band, and dance and drink until the small hours; usually in couples or groups of girls and guys, then have breakfast, pour ourselves into a cab to go home and sleep it off for a few hours until we hit the beach to surf the next day *sighs*

Maybe they can forgive some impulses on youth ie: bad judgement by locking her out? Except too bad he is no young kid. His brain is fully formed and should have been working. Just my guess...

I realize this might not be welcomed but I hear a pattern, the no was repeated so many times, almost too many, it is like that is all she repeats but no other words come out....until she says just let me go home. She also did this with Manchester, it was repeated multiple times.

And at the same time, GT is breathing heavily at the very end which would correspond with him tossing her over IF he did. WHY don't we have video to go along with the audio?

It did not sound like choking in video, I imagine if you take the breathing episodes and compared to to her voicing no, they would be at about the same cadence.

It is hard to say what anyone would do in that circumstance, I feel as though most people would say more than no.
Hope the jury is not as conflicted as I am right now.

One question, not directed at you but to WSers on this thread at large, barcode. Since when does the word 'No!' repeated 32 times mean 'Yes.'? Whatever he was doing to Warriena, however he was restraining her, and wherever he was taking her; she did not consent. No means no.

Also, I wonder if GT ever worked as a 'bouncer'?

My reading of today's #Tostee tweets has me flabbergasted over the serial misdirections in the closing arguments by the Defence.

I do not believe that GT literally threw her off the balcony. I believe that she climbed over the rail and fell. So I do not believe JT should be considered guility for 1st or 2nd degree murder. If GT intended to throw WW off the balcony, why would he make an audio record of it? And if he threw her down due to a burst of rage, why would he keep the audio recording? Such a recording could easily be deleted before police got a hold of it.

But I do believe that WW was afraid for her life. And I believe GT was attempting to make her stay even after she made it clear that she wanted to go. GT kept trying to make her stay. He served her drinks. He took her cellphone. He wouldn’t allow her to take her things.


And I can see a drunk and frustrated WW trying to regain control by retaliating physically. I think JT was desperately trying to make her stay overnight. A less controlling person would have helped her pack her things and allowed her to return to her hotel, or where ever she was staying. But instead, JT got enraged at her violent reaction, and he became scary. I believe him when he said, “Last thing that I remember was that I tried holding her down and she ran out on to my balcony.”

Why would she run away like that? I think she was scared for her life. Even if GT was not intending to harm her physically (which would be hard to believe). He still failed to be aware that he was causing her emotional harm by not letting her return back to her own dwelling. So a very drunk, irrational, scared WW, being locked in the balcony, entertained the only option left. Thinking that GT was going to harm her, she desperately attempted to escape for her life by climbing down using the balcony. I believe GT made some very poor choices that led to the loss of a young woman’s life.



  1. He allows a strange woman that he’s just met to stay at his home.
  2. He risks STDs by having s*xual relations with someone he does not know.
  3. He makes numerous attempts to keep her at his place even after she becomes increasingly belligerent and violent.
  4. He keeps serving her alcohol even after admitting that she’s had too much to drink already.


When someone drives drunk and kills someone with his/her vehicle, that person is guilty of manslaughter. I think it would be reasonable to insist that GT be found guilty of a similar manslaughter charge.

I agree, Bohemian, No means No. Absolutely. The same applies to when someone asks you to stop throwing stones at them or stop beating them. Stop means Stop. The excessive drinking played a big part in the goings on in that apartment that night. Neither of them were willing to listen, period.

I have no idea if GT was ever employed as a "bouncer". Would be interesting to know though.

No means NO just something I noticed about her speech that seemed odd repeating so many times without adding anything further, even if she said it 100 times, no does not turn into a yes.

I have always thought that Tostee would have been behind her when he choked her with his arm so if they were on the balcony, all Tostee had to do was lift her up from behind.

Totally agree with you on this Estelle, as stated in one of my previous posts....He lifted her up from behind, causing her feet to face outwards, with her back against the balcony....One neighbour recalled her twisting & turning while hanging onto the balcony railing...I feel W then slipped & fell to her death...MOO.
