Do many of you feel that it was odd for the Judge to instruct the jury that they must not consider GT's behaviour or movements after the fact of WW's fall, in their decision ??
Yes because gt seems to get to work with smuggling something long & rigid out the hotel . so what where his intentions at the time , was it a recording device , tripod , weapon , sex toy ? I think all things should be considered with a microscope because its important gt gets a fair trial

Barcode, all respect, but that sound... the repetition, nothing added, one word over and over - that's the sound of somebody in a very primal state of anguish and/or fear.

I have sadly had occasion to hear that sound in my life, and also to make it. It's the sound very small, very frightened, panicked children make. It's the sound I made when I came home to find my partner dead, almost the exact same sound in fact. It's the sound of a horrible trauma happening, and the mind of that person in its most primal instictive state, where words actually make very little sense and the repetition .. I don't know if I would say it's comforting? But it is NOT really a "voluntary" sound like normal speech, you're not thinking, you're purely reacting to something you cannot believe or control.

I hope that helps you gain another perspective on the sounds Warriena was making.

eta: And I wanted to add, she was only making that sound, over and over, while Tostee was audibly manhandling her out onto the balcony - and for the majority of the 70 seconds he was out there with her.

The moment he retreated toward the door, she started screaming "Let me go home". Ie, something happened to let her break free of that primal terror and form proper words, simple as they are. That event was Tostee leaving the balcony. I dunno what that says to anyone else, but I have a pretty clear picture of what that very very likely means.

This particular graph (the 63% one) was showing figures only for trials that were not settled by a plea, or settled in some other way.
But I do get your point, and don't want to appear that I am arguing as I respect your opinions. They are going to pad their figures because they don't want to look inadequate or ineffective at their jobs.

I also don't want to appear as though I'm arguing, however the ODPP are skewing their stats (not unusual for any annual report I guess!).

Of the 188 trial finalisations which resulted in a plea of guilty, 162 were pleas to all counts on the original or an amended indictment on the first day of the trial, prior to the calling of evidence or legal argument.

So the actual 14/15 numbers for indictments that went to trial (and the trial actually commenced) are -

238 convictions, including 26 by the way of a late guilty plea
203 acquittals
47 Nolle Prosequi

So just under 49% clearance for trials that actually commenced.

Yes, me. I think they are going to go with a Manslaughter verdict.

Not confident at all of the jury being able to return a guilty verdict for murder or manslaughter. Hopeful that the verdict will be manslaughter in one way, in another that will mean Warriena's family will have to suffer through an appeal.

I feel confident of a murder verdict, depending on the jury's ability to understand the charges.

I had to listen to the recording again (for the last time I hope). I am so deeply disappointed that there wasn't experts (for both sides) to analyze this recording for the jury. I wanted to speak, if this tape was tampered with, because it struck me if there was some sex play that was BDSM, her repeated shouts of "manchester" sounded like a "safety" word to let your mate know when role playing was too much. I think she was restrained here, hence her request to poo. like pk You ignored manchester, how about I need the bathroom? Anyway jmo for that part. just trying to make sence.

But most importantly, You can here her choking, you can hear the menace in his voice. You can hear that they are on balcony together by the sounds of the wind during her repeated screams. When he repeats: "Let go" it has huge implications to me. firstly he should be yelling "drop it" if she had a metal object. I would argue that " let go" speaks more to her holding onto something, like him, the door frame or the balcony ledge. why assume the defendants version is correct here?

Also. You can hear his increased breathing at the end of their encounter milliseconds after her silence. Like he got a tremendous rush. He did not sound out of breath really, more excited. This tape is beyond chilling and could have been thoroughly picked apart by experts. a grave failure by prosecution IMO. This tragic victim has come back repeatedly to speak (scream) from the grave. Why? Because there is her story to tell here. This is so obvious what it occurring that it makes me quite insane.

Very insightful ninji , I heard that adrenaline fueled puffing from gt at end of struggle too , I suppose he saw her go downward briefly as stated in his admission post . He only had time to grab the most important things before escaping , no time to rearrange evidence like his shoes (circumstantial) from the balcony edge but he did remove a long unknown item of great importance during this horrendous moment for gable .jmo

Very little chance of murder, manslaughter at best.
