When are proceedings sub judice?
The general principle is that proceedings are sub judice when the proceedings have commenced but have not yet been completed[7].

In criminal proceedings, the sub judice period begins at the time of arrest or charge, whichever occurs first[8]. However it is also possible that on occasion, the period may begin earlier, for instance when a summons or arrest for warrant has been issued[9] or when extradition proceedings have commenced. The sub judice period ends in criminal proceedings when either the charges are withdrawn, or the accused has been acquitted or sentenced, and the time for lodging an appeal has passed, or all possible appeals have been heard and determined[10].

Thanks froggy. I guess that’s why the video I posted recently, irt BS’ clarification of his whereabouts before, on and after the day William disappeared, was deleted. Ah well, we all live and learn.

I wish I had more legal knowledge irt criminal trials. The law can sometimes be very confusing.

IANAL but I would imagine that subjudice would only apply to the case before the courts, the alleged sexual abuse, not his POI status as far as Williams case is concerned

Thanks sleep. I appreciate the clarification. As I said, the law can often be confusing.

Plus with his trial being a judge-only trial, the boundaries will be more flexible, as a judge is less likely to be influenced by anything published about Spedding during the sub judice period.
Which is probably why he has been allowed a judge-only trial, in the first place ... so much previous high exposure MSM giving specific details of the charges at hand.

He may not get a judge-only trial for the Victorian charges. Not much detail known/published about those charges.
I think those Victorian charges are why we are hearing nothing at all about his upcoming trial, too.
Probably will hear little/nothing about this trial afterwards either, until the Victorian charges have been adjudicated. :sigh:

a) material was published;
b) the publication of that material happened while the proceedings were sub judice; and
c) the publication has the tendency to interfere with the administration of justice in the proceedings that are before the judge.

What does that that mean irt our discussions whilst the matter is before the NSW Courts? Would they be subject to the ‘sub judice rule’ or not?

I wouldn't be talking about the details of the charges he is facing, at this point in time. But he is not the only POI in William's case, so I don't see any problem with that.

IKWYM My eldest was about 9 months when Daniel Morcombe went missing. It stuck with me from the 1st day I heard he was missing. Bless all those who care for WT and need comfort.

Our opinions may differ on who did this crime. But there is no one that can cause so much pain to so many - the families, the investigators, the community - and get away with an easy life. Karma will get them, if it isn't doing so already.
