Mr Tedeschi told the court he tried to “dissuade” Jubelin from leaving the force last year “because I thought it was such a terrible loss and I still think that... his loss to the force is a loss to the state of NSW”.

Mr Hogan asked Mr Tedeschi if the Magistrate’s findings change his opinions of Jubelin, he responded “I form my opinions based on my own experience and I still maintain my views about Mr Jubelin and him being a man of integrity”.

Under cross examination, Mr Tedeschi is pressed on whether the magistrate's findings and judgment remarks chancg his view of Jubelin: "As a professional lawyer I'm obliged to accept His Honour's judgment, but as a human being I'm entitled to my own views about people."

Mr Tedeschi has been excused and Jubelin’s defence barrister Margaret Cunneen is now making her submissions to the Magistrate. She told the court the illegal recordings were not made for “any personal profit or advantage”.

Cunneen told the court Jubelin “was going through a difficult time in his personal life at the time these offences took place... that may be some explanation for why he cut corners”. She is referring to a divorce.

Cunneen is arguing for no conviction to be recorded, telling the court “he is still a man of an age where he requires employment... he would be extremely burdened by a conviction”. Adding that his “life up to this point entitles him to a degree of leniency”.
