Magistrate Ross Hudson sentencing Jubelin now. He says the offending "strikes across the heart, extent, nature and purpose of the Surveillance Devices Act" and the "tentacles in terms of the ramifications of illegal recordings" need to be noted, for example future case dismissed.

He told the court the extensive character references presented “speaks of the character he had enjoyed... for the entirety of his life”.

He told the court “his experience is not doubted, neither his tenacity or his passion” and accepted he is “a person of good character”.

In relation to the defence submission that the media coverage has been additional punishment, Magistrate Hudson told the court “this is a person who has engaged in that media coverage”.

He told the court “this sentence must send a message to the offender, send a message to the Police Force, send a message to the general public”. He told the court he must record a conviction.

Jubelin is CONVICTED of all counts and FINED $2500 for each of the four counts.

Ross Hudson has been part of the judiciary (magistrate) since Nov 2015. He was a partner in a law firm prior to that.

It may be that another court may take a different view of the difficulties of police work, and the pedantics that there was a recording surveillance warrant in place but it wasn't for Jubes' clear-sounding phone, it was for a static-ridden 'bug'.
Another court may know of and believe the morals, ethics and integrity that Jubes is lauded for.

Couldn't agree more, SA. There'd be a lot of interpersonal relationships (and ambitions) at play in the land of the law. IMO.

Speaking outside court, he said he was disappointed at the result and thanked all the supporters who testified on his behalf today.
