Attorneys for 'Street Shooter' suspect seek to bar death penalty after jailhouse video
Attorneys for suspected "Serial Street Shooter" Aaron Saucedo on Thursday filed a motion to bar the possibility of a death penalty in his trial because the Maricopa County Sheriff's Office provided video of Saucedo in his jail cell to The Arizona Republic and other media outlets.

In Thursday's motion, Saucedo's lead attorney, Thomas Glow, asks Maricopa County Superior Court Judge David Cunanan to throw out the state's intent to seek the death penalty as a sanction for violating Saucedo's constitutional rights.

I highly doubt his lawyers will be successful with this argument...seems they are already grasping at straws and he hasn’t even been convicted yet. I guess a denied motion here will offer one more avenue for them to appeal once he is (presumably) sentenced to death.

He is charged with 22 felonies in two separate indictments.
One of the cases contains a single charge of first-degree murder, that of the boyfriend of Saucedo's mother, who was killed in 2015. The other indictment covers the other eight murders, and the County Attorney's Office has filed its intent to seek the death penalty in those eight murders.
The two cases will be tried separately.


I did not know this! So - today's hearing is a motion about his constitutional rights to privacy while in jail?

A judge in a serial killing case against a former bus driver in Phoenix declined to bar authorities from releasing any further video of the suspect in his jail cell.

Attorneys for Aaron Juan Saucedo sought the order while the judge considers their request to take the death penalty off the table as punishment after video was released to news media in January.

Superior Court Judge David Cunanan scheduled an April 13 hearing for attorneys to argue over the death penalty issue.

Defense attorneys said in court papers that the release of the video to The Arizona Republic and other news organizations violated their client's constitutional right to bodily privacy.

The jailhouse video showed Saucedo talking on the phone and looking out of a cell-door window.

Prosecutor Juan Martinez said his office didn't release the footage.

The Republic reported the video was released by the Maricopa County Sheriff's Office, which runs the county's jails.

The Latest: Hearing on Phoenix murder case postponed

all I can see on my Google Alert is:
Attorneys for Aaron Juan Saucedo were initially expected to argue for the dismissal of the death penalty Friday morning but requested more time.

Maybe there is a date of continuance? I don't see a new one in the court site, but they might not have update that quick. I looked tomorrow....

Never mind - DOH! I was looking in the wrong place - rescheduled for June 27th.
