The judge must have not made this clear to us/me. I took it to mean that 2 jurors were released previously but the feed was hard to follow. This is the answer I got. I have no idea what the note was about but I remember that in the last of the feed.

Trial Diva Jen ™‏@TrialDivasJ·11 mins
@(snipped by me) Only 1 juror was excused through out trial but another 1 wrote a note today to Judge & he made them an alternate

So there are 12 jurors and 3 alternates.

I am finished worrying for tonight. :seeya:

Ah, yes! this makes sense. Random draw called punk rock juror and diva smiley (trial diva's descriptions - not mine) and juror #1 was called to judge's office.
This would explain what happened. Juror #1 is the one who wrote the note.

Thank you so much for finding this out. I agree, loose ends are annoying no matter how trivial.

Goodnight!

See ya'll back here Monday:seeya:

No Problem. I offered to do it in Nymeria's absence. If it gets too overwhelming..I'll post that i can't keep up anymore. So far so good though.

:seeya: Still catching up...was down with a cold yesterday....

:tyou: Rhozwen!

ETA- OK Caught up! You did a fine job Rhozwen, way better than I!
Thanks for the comments from everyone else also, even though I missed the day I still got a "feel" for how it went. BTW, that "feel" was slooooooooow...:giggle:

Hope you're feeling better, Nymeria.

Considering how dragged out this trial has been, what are the chances the jury will come back with a relatively speedy verdict? Slim, I think. I don't know how they'll even remember most of the testimony/evidence. A distinct benefit to the defense and a hung jury since it's a capital case, imo.

There really isn't a lot to consider. It is obvious she did it. Had she gotten away with it Flores would have been next and I think he knows that. Just a guess.

This is true, guess I'm still just frustrated with all the delaying in this. Do you know what all lessor includeds there are?

We are in official verdict watch #MarissaDevault jury will deliberate from 10:30 to 4:15 AZ time....how long for deliberations?

Geevee, honestly, I have NOT a clue how this one is going to turn out.
As Lamb said, it seems cut and dry.
But the way this trial was run (and the fact that all we can really get a feel for it is via twitter and news articles), I don't know if this jury is going to convict her.
I ONLY say that because maybe they will buy the "Domestic Abuse" defense.
Hoping not though...

And thanks, I am feeling a little better :)

What charges are the jury dealing with? M1, M2 and NG? I know manslaughter was tossed.

I think MDV and JA were separated at birth. I vote M1, two days deliberations.

  • #852
Shoot, I got busy outside and forgot about checking in. LOL

Wish I'd seen the instructions to know what all charges they put on the form, has there been any tweeting since they went in? I guess there's no live stream to keep an eye on deliberations?

Seems we are live stream-less more often than not these days. :pullhair:

I am only seeing M1 Chelly, looking for info on if they got the manslaughter added.

If DeVault is found guilty of first-degree murder, the jury will then determine if there are aggravating factors -- specifically whether the crime was excessively cruel and whether it was committed for financial gain. If there are, that would qualify DeVault for the death penalty. And if either or both aggravators are found, jurors would weigh them against mitigation before sentencing her to life or death.

ETA- Oops I see you already said they tossed manslaughter, sorry. I missed everything on Thursday and still not had a chance to watch what little was streamed. I could swear I saw the judge giving instructions though, I will try to find that.

For mitigating, the jury may buy into domestic abuse. Based on nothing concrete, I just have a feeling they won't vote DP.

MD had Dale chronically ill, divorced, dying or dead months (or more) before his actual assault and demise, according to people she spoke to...........I think that would be a huge indicator to convict on pre-med murder 1.:jail:

What gets me is Stan.........I REALLY feel bad for him. I think MD only got involved in any VA disability issues to increase the amount of money she could get off Stan for rent (she did say she handled his finances). Nothing she did or asked (probably demanded) of him benefited him, it ultimately benefited her. Seriously, she tells him they'll get married, but has him "slap" her the night of the assault on Dale, has him beat her up a few weeks later for "whatever" (sympathy, insurance?)...and then drafts the confession statement(s) under her guidance? WTH?:banghead: I hope he's in a healthy situation now.

Mr. Flores was just a love struck idiot, but I hope his hard drive get's him charged with child 🤬🤬🤬🤬🤬🤬🤬🤬🤬🤬🤬. It was not really touched on in trial, so I can see that although his statements on the stand can't be used against him, he didn't say anything that could be used against him future in a case specifically on the 🤬🤬🤬🤬. The immunity basically goes to his involvement, or lack of, in Dale's death.

Child 🤬🤬🤬🤬 cases get very long sentences in Arizona.

Good points, Bernina. With the trial's one-week-vacation, then the two-week-vacation, I overlooked some of the Stan stuff.

:floorlaugh: MD is a "masochist"......sounds like she enjoyed getting "hurt" and even asked for it specifically....but the jurors didn't get to hear about the "jogging incident".

I think she gave as much as she got in that department. In her LE interview, she came off as one tough cookie, dislocating her shoulder in the horse incident and then pulling the saddle off the horse ALL BY HERSELF. I call "BS" on that. A dislocated shoulder makes that arm totally useless, and how could she unbuckle or un-cinch a saddle while supporting her "useless" limb? Did she use her teeth?!?!?!:floorlaugh:
