I figured when the state rested that the defense wouldn't be ready. What a wasted day for the court and the juror's. They probably get paid the same either way long or short day.

I guess I will be back on Monday sometime. Depending on the JA thing. Then I plan on following the Hayes trial in SC that is if it is live streamed.

Have a great weekend geevee!

Same here, I'll be keeping an eye in JA primarily and I want to see the opening statements in the Hayes trial - are they picking the jury on Monday?

Have a good weekend yourself!

Thanks for the visit over yonder Jewels, I can't believe lil-miss-reality-show wants cameras turned off for the retrial, Nurmi just can't be serious.

P.S. It's probably just for appeals issues but what if she agrees? :(

One more P.S. I'm not doing another Trial By Tweet. lol

I agree with I can't believe she the little drama Q doesn't want camera's in the courtroom.

Sorry about not being able to find the actual pdf file for the motion.

I also agree about the tweeting a trial. i don't think it would be to bad if we had articles to back us up.

I look for this one to be over this week.

Hi guys. Things here have been out of the ordinary with body problems. I am trying to catch up here and each time I do, I then read that court for the following day has been cancelled. I can't imagine how frustrating this has been for you all. So there is no live streaming after all? I was so happy to read on Monday night that somebody was live streaming, or I thought I read that. Anyhow, I'm with you in spirit and miss you all.

Interesting clip from our Lissette Martinez about police officers in Phoenix. She talks about Chrisman a couple of times.

http://www.azcentral.com/video/2625548556001

In getting the backstory on this case, I found article after article about problems within the Phoenix PD. Their union, Phoenix Law Enforcement Association appears very political. There is also a racial undertone of being anti-Hispanic according to what I read. I had no idea initially that Chrisman layered up immediately. He was fired 6 months after the shooting of DR, not sooner because his atty filed an injunction.

This trial has been postponed no less than 6 times. DR family settled lawsuit against Chrisman, dropped the 30M lawsuit against the City of Phoenix and still have a lawsuit pending against Virgillo.

Thanks for posting this. :seeya:

Hi NCE! Hope you feel better by the start of the Hayes trial. :)

Anyone know how many witnesses the defense has? One of the Divas tweeted that Chrisman was going to testify and it would be live streamed but that was the only mention I've seen of the defense's case or anything about streaming, live or Memorex.

Zuri thanks for your comments, this was the first I had heard about problems with the Phoenix PD. I knew AZ had issue's with being anti Hispanic. If I remember the state tried to vote something along those lines a few yrs ago.

A few of us ran across problems with the Albuquerque PD just a few months ago. A trial with their own officer Levi Chavez accused of murdering his wife. Anyway he was acquitted. I believe the feds have come in and investigated. The chief of the force just recently resigned. Here is an article about the APD chief that just left.

Until recently the Arias judge (JSS) had been the judge for this case, haven't heard why the change occurred (maybe because of the Arias case), hope this judge runs a taut courtroom with few sidebars.

Hi everyone, so glad you're all here! :seeya:

Where's our chiquita banana? And Fragile? And Borndem for goodness sake? We may need a search party. ;)

(I've never bolded my own name before :blushing: -- it's weird!)

Thanks, geevee, :seeya:for missing me! So good to "see" ya!!

I just heard about this trial from a comment by our sweetie, NCEast, who mentioned it on the Raleigh, NC, case of the murder of Laura Ackerman (Grant Hayes/Amanda Hayes) board. As you know, jury selection on that one should start this Monday, the 26th, and off we'll go....

When I saw the name Chrisman, I came right over to see what's what here, and saw your name...

I did recognize the name Chrisman, but I just didn't know it was in process. Yeah, where is our chiquita 'nanner and Fragile?

I'm gonna go back & review this Chrisman case... I'll try to catch up.

Hiya BD, so good to see you!! Catching up on this one might be a little here and there between vids and tweets, there's a fair amount missing as some afternoons weren't streamed so no vid, and only one consistent reporter tweeting (Lissette Martinez from 12News), also have the Trial Divas who tweet a lot but not being professional reporters they don't always give the pertinent info (or give lots of non-pertinent lol).

There aren't tons of articles about it, seems like most of the articles are dated from before or the beginning of the trial and then updated (so google searches pull up the old dates).

If we're lucky the TDs are right and RC will testify and it'll be livestreamed but we'll have to wait and see on that, the one who tweeted that didn't give a source and it could have been wishful thinking, who knows. It's been a hard case to follow (intentionally it seems) but we've been trying.

And now our poor Josie has been laid up with a broken foot or ankle, full diagnosis not in yet (posted on TA sidebar thread), I sure hope they do livestream his testimony so she'll have something to watch while she mends.

Really good to see you here, BD. :)

I had no idea that the sentiment ran as deep as apparently it has. I read where the interim DA was the one that charged RC and Montgomery has not been keen on prosecuting this case. It was expected that RC would take a plea deal for 3 years probation and possibly return to his job at the end of it. The plea deal did not happen from what I read.

This case has been very divisive for the PPD apparently. Virgillo had been expected to cover for RC, but did not. Virgillo had as much to lose if not more by coming forward and saying it was a bad shoot. He has been maligned apparently by some fellow officers for not upholding the thin blue line.

I was looking at the booking pic of RC and then that of him in court and he has lost a lot of weight and body mass. There were rumors alleging that RC was doing anabolic steroids back in 2010. RC was also on the PPD Brady list for several instances of officer misconduct, one of which he placed drug paraphernalia on a mentally ill, homeless black woman, while she was in handcuffs being questioned by police as a joke. It was caught on video and he and several officers received disciplinary action.

I am not surprised that other cities have similar problems with the anti-Hispanic overtones. I wish it were not so. There is room for everybody in this country or so I thought. JMO

I also read where the PLEA (Phoenix Law Enforcement Association) had a BBQ fund raiser for RC. It was met with protests from the community and a lot of fellow officers. PLEA is funding RC defense and it has been reported to have "friends" in the media, primarily KPHO, and in the Maricopa County District Attorney's office. Where does that put Juan? Besides in the middle of all this?

What a nightmare. JMO

Hiya Zuri. :)

As you can tell from the trial coverage (or lack thereof, only one reporter from a local news station?) there seems to be resistance to everything concerning it, and 'word on the street' is a jury will never convict a cop for shooting someone while on duty, so even with his bad track record, being on the Brady list and all it seems it may be an exercise in futility.

I don't even recall JM bringing up him being on the Brady list (which certainly seems germaine in this case) or anything else about what kind of cop he is. But I saw that JM did not get Virgillo's deposition until after trial started and he was on the witness stand.

I see too that JM made this motion Thur.:

8/22/2013 MOT - Motion - Party (001) 8/22/2013
NOTE: MOTION TO COMPEL DEPOSITION OF WITNESSES

How can you go to trial with no depositions?? I know the PPD has not been helpful to the prosecution but I can't understand JM allowing trial to begin when discovery was never completed.

Wow -- This sounds like a big dayam mess, IMO. And our JM's having to be right in the mucked-up middle of it. I'm sure it's not his first mess, and it won't be his last, but naive folks like me always just get disappointed, surprised and even more cynical. Shades of D. Peterson, anyone? (Hmmm, can one be naive & cynical at the same time?? I guess I'm just as flaky as the next poor slob, huh?!)

And thanks, geevee, :seeya: for the kind words and the rundown on this wild thing!

Oh borndem I considered myself naive also until I watched the Levi Chavez trial. That was only my 3rd trial and it sure opened my eyes as to how LE is treated in a murder trial. It was a travesty to say the least. As stated above to Zuri in the clip I provided the Albuquerque PD sure has their fair share of troubles also.

I look forward to watching the Hayes/ Hayes trial with all of you.

Me too, anyone have a live stream link yet (or know who got camera approval)?

If Chrisman does take the stand, I'll be waiting for the words 'my jury' to be intoned early and often. lol

I became a bit more cynical after the LC trial, that's for sure. And the way this one is being treated by the media makes it even more irksome.

It will be very interesting to see how Juan handles the cross of RC on the stand. I hope he brings his same vim, vigor and vitality that he displayed in the CMJA trial, giving no one any doubt that he only cares about justice.

The cordiality between Mr. Mehrens and Juan Martinez is a welcome change after witnessing such contentious displays in the CMJA trial. I hope Nurmi and Wilnott are taking notes. JMV

I saw the footage of the guy on the roof, and his 'murder' on FB today. It didn't surprise me for some reason. Very sad for this man's family and my understanding is that there were several bystanders recording all of this so I don't know how the officers involved can screw around with the facts.
Thanks for posting the video Jewels.

Good to see you NCEast! When you said guy on the roof, I had another image in my mind.

O/T We live in a small town and a few yrs ago I was backing out of the drive way and my neighbor was on top of his roof. He flagged me down and said get the guy across the street, there are people trying to get me that is why I am up on the roof. So I went and got the neighbor, he is a police officer and let him take of the issue. Come to find out this guy on the roof is high on some drug and has trashed his house. It was crazy! We lived in a fairly nice neighborhood with all new homes. Not anything ritzy but decent and this guy totally trashed this house.

Sorry for going o/t!

I guess when you have lived almost 60 yrs you have seen some pretty crazy things.
